I won't take the bet because your intuition has been very good. But man there is nothing good about that video for OP. If it was 2 months ago when PSD was their defense and they wanted to show that OP could arm himself and go kill an intruder, by mistaken self defense, then yes it would be good. But his convoluted uncertain testimony led to Dr. V and now Dr. D droning on about how helpless he is. My thinking is that the video increased in value because of this, and that is why a sale was accomplished. This is the perfect time for a news organization to drop a bomb!

Im not seeing any upside for the DT to leak this video. There is talk here of a mistrial, but with three judges deciding the outcome I doubt that is possible. And if there were a new trial they would still retain evidence presented in this trial, it does not go away. So if not a mistrial then what is the upside? I realize that no one knows at the moment but it should be obvious, I would think, if there were one.

If the DT gets the injunction, which is pretty easy thing to obtain, I'll believe it was not a stunt.

If the DT has an application on Monday regarding this video, I'll believe it was an engineered stunt.

The only thing I can see about a mistrial is 1) buying some time 2) try to do it over better with a new Judge 3) new defence and/or DT

I cannot believe that the DT would do this to try to get a mistrial. I don't believe that OP can afford to do this again, his money is gone. His uncle would have to pay the bill for the next go round, and with the evidence being what it is I cannot see him spending ~$2M (US) of his money for another shot at this. I could be wrong, but unless something happens in the courtroom that severely prejudices OP there should not be grounds for a mistrial. Here we are talking about a video that the DT created themselves, and it has not been shown in court, yet.

My understanding is that the judge banned the psychological report from publication and stated she would hold anyone that does so in contempt. Therefore, I have unapproved the links to it for now.

The judge would only have jurisdiction on citizens of South Africa. If you are in another part of the world, you would have to abide by your laws only

Saying they would not object to the Zombie stopper video provided it would be the 1st and last time the PT would do this… is not a legal argument… it's something a mother says to her child.

I suspect the DT knew they could not win the objection so they conceded to the PT in that colorful manner.

Can't think of a legal problem by asking an expert to comment on the latest video which shows exactly what the expert is stating is improbable or impossible.

I'm not a lawyer and I don't really know if this correct or not, but the PT didn't make any comment after Roux made this statement, so I don't know if the PT actually agreed to this or not.

The Pistorius clan is sufficiently wealthy to afford another Trial… I get the feeling that they see themselves just as much on Trial (or the Pistorius name) as OP.

I didn't say that an attempt by the DT for a mistrial would actually work… but it would give them more grounds for an Appeal… and the DT has shown a propensity for the "throw a bunch of stuff out there and let's see what sticks" approach in this case.

It is no longer available in the UK. This usually means it has been pulled. However it cannot be put back in the box at this stage. It has been viewed worldwide. Surely there is no way this evidence can be ignored. That would be such an injustice to RS.
