Nel: He said he spoke to Reeva in a 'soft manner'....he became adamant he 'did not whisper', though in his statement he said he did. Why's it important? Because it was important to HIM - he realized you have to be close to a person to whisper.

Go on Nel!

Nel: Why would he bother to deactivate the alarm? You just shot your girlfriend, and you think of turning off the alarm?....furthermore, he thought to take his phone, and put it on the charger in the kitchen.

  • #244
Nel : OP put phone on a charger, he was not panicked.

Nel: They were awake. He knew the alarm wasn't on. He cannot tell the court when he deactivated the alarm, because it wasn't on.

And ?

What does Roux accepting EVDM heard a "voice" have to do with Nel stating in closings that the Defence had "never put it to"(words used by Nel) to EVDM that she didn't hear "arguing". From the transcript it is patently clear the defence did put it to EVDM which is all I was noting, i.e. that Nel made a mistake. I never said Nel said the defence didn't accept EVDM didn't hear a "voice".

In any case one voice doesn't make an argument unless a person arguing with oneself or giving a speech which can also be called an argument.

The point is that the defence accepted that EVDM heard arguing, just that they were trying to say that she was mistaken in it coming from OP's house. Had they said she must've been mistaken in hearing it at all would've been better for their version, but no, they did actually accept that she heard arguing .. just that it may have been from another house (which, clearly in the light of what happened that night, i.e. a woman being shot and killed, is highly coincidental that there would've been an argument in another house, at the exact same time that exact same night .. there's not exactly that many houses around there, and most of them testified as witnesses and it wasn't they who were arguing that night, so that leaves very little others houses were it could've been but for OP's!) The defence should've just said EDVM must've been completely mistaken about what she heard, but they couldn't, because the evidence is overwhelming.

Yes, it's great. I missed you all!

It seems easier to share intensly a common interest "virtually" than in "real" daily life... Strange, isn't it?
It's just wonderful to have the group back together again.

Nel: When he carried Reeva downstairs, Carise arrived. And they attended to her. He never had opp to put his phone on charger. Must have put it on sometime before that...

Judge interrupts and asks if OP was ever asked when he put phone on charger. Nel says no.

Nel: real question is why accused would even have bothered to deactivate alarm, put phone on charger...

Hmmm, naughty Nel really should have put that to OP about the charger. Nel made a point of saying early in the trial that he wasn't really disputing what happened after the murder.

Nel: When asked about alarm, he then said 'I'm tired'. It's just because he could not answer.

Oooooh, I posted about that! All of the couples discussing sounds when they woke up to determine what they were!

Yep :thumb:

Nel : If defence would argue phone was on chrger from previous day, how would we be able to deal with that? Except we know OP said he tried to use Reeva's phone in the bathroom, then went into bedroom, used the phone that was later charged in the kitchen.

It just occurred to me that we've been following this trial since March. Dayum.
I'm so glad we finally made it to closing arguments. And Nel is definitely in his element today! Go Nel!

  • #255
Nel: It's not the lawfullness that's at issue here, it's the culpability. The intention....Objectively judged, there was no imminent attack, the defence concedes that.

Oh dear Nel.

I agree kaos, maybe a fatal mistake.

Wouldn't it be funny if Oldwage got up for the defence after Nel? Now that would be devastating for OP :D

Nel: he acted with Doelus Eventualis??

Help!

  • #259
I love seeing OP in the live trial shot background behind Nel ..... OP looking small, powerless
I think he looks bored. He keeps yawning, too.

Nel: (On OP's version) I went to the bathroom, knew I'd have to shoot someone, reconciled myself and did....even on his own version, he's guilty......'I want to shoot and kill someone, and I do'. It doesn't matter if it turned out to be Reeva......it's damning.
