The mosaic must be viewed as a whole. We say, if each piece of circumstantial evidence is viewed as a whole, and each piece is viewed as the weight of a feather, the scales will tilt in favour of the State.

  • #122
Nel discussing how circumstantial evidence should be taken. There is a prior case decision that says not to look at each individual piece of circumstantial eveidence, but that it must be looked at as a whole.

I'm glad he cited a court decision for the judge to rely on. She seems the type who would having a prior decision to rely on. Not that with her experience she is not familiar with dealing with circumstantial evidence.

The State says there's a great grouping of shots. The State says we don't have wild shooting in the bathroom. We have a good grouping.

  • #124
There will be argument that it's not possible to reconstruct a scene. Nel says Mangena conclusively did it.

  • #125
Nel says Mangena said it was black talons, the defence says it was Ranger. The results are the same.

Nel: I'm asking the court to reject the accused's version.

We are saying there are a good grouping of shots, a, b, c, d, we at least don't have wild shooting, through the window, shots high, shots low.......

after going through all experts (listing state and defence) Mangena reconstructed the events, the deceased was standing near the door. Her right hip is where a is, m'lady, we make that point again that the deceased was fully clothed, pants, vest, fully clothed, we say the accused used Black Talon ammunition.
There was screaming, the door of the toilet locked on the inside, door broken down by cricket bat, deceased phone found in the bathroom.

The accused phone was found in the bathroom, under a towel, after everything was lifted up.

Reeva's phone was found in the bathroom. OP's phone was found in the bathroom, underneath a towel. Mr Wolmerans couldn't link any of the bullet holes to E, but Mangena did.

Discussing "sight alignment" regarding the pattern of the bullet holes in the door.

I have Comcast and I am watching the trial on 206 in Atlanta... CNN1
You probably don't have Comcast huh?

All posts are MOO

Yah! I didn't know I had that channel in addition to standard CNN on channel 34 CNN! Hmmmm, I'll have to call Comcast as not all my tv's are getting that channel, just the main box tv.

THANKS!

If he heard movement - he heard sounds. I'm not buying the argument that the two are contradictory

Thought exactly the same... and same applies to a couple of other jumps Nel's made. JMHO

Why does it matter if there was sight alignment or not?

#oscartrial Nel: Wolmarans agreed that accused was on stumps in normal firing position, arms stretched out, gun in hand with sight alignment

Nel: sight alignment is a factor that must be taken into account.

Nel: "the results of black talon or ranger ammunition are exactly the same." ie devastating damage to the body.

eNCA ‏@eNCAnews 1m
Nel says Capt Mangena was able to link the bullet holes to the wounds but Wolmarans unable to do that.

If OP had sight alignment, then he aimed. If he aimed, then he intentionally discharged his firearm.

Nel claims the angle of the shots suggest aiming and not panic. #OscarPistorius #OscarTrial #Pistorius

Nel: we say the accused used his phone to make calls from the bedroom and then the kitchen areas. BB

Nel: caused said to people who arrived on scene - Stipp, Stander, Viljoen that he thought she was an intruder...a burglar.

I forgot. :(

It was never put to the Van der Mewre that she didn't hear an argument.

I didn't think that was in dispute. Not in my mind anyway

Nel: Van der Merwe was never told she couldn't have heard a woman arguing.

  • #139
Why does it matter if there was sight alignment or not?

Sight alignment is Aiming! It matters that OP AIMED as opposed to shooting randomly.

  • #140
OP said to Baba "I am fine", Baba said OP said "Everything is fine". We never have OP saying "Security, security, help me. Can you help me Can you phone the police". We don't have that.
