Has anybody else noticed that OP's father didn't come back after the tea break? I haven't got to the lunch break yet so don't know if he makes another appearance later today.

Someone in court sounds like they have whooping cough. Maybe he's caught it....

Nel: The fact that someone is disabled or not, the court should not take that into account. It's the fact that he's armed.

I'm worried, too, jay-jay...The scepticism in her expression is horribly palpable:

.. isn't it just .. can only hope her two assessors are a bit more on the ball, and are able to convince her.

  • #424
Nel: What we have is an unarmed, vulnerable woman in a toilet...

Nel: If the door had opened, at least there may have been some cause....he cannot escape, Milady.

  • #425
Nel: It is PREPLANNING

  • #426
Nel: "I have to remember where I put the firearm/get the firearm/unholster it/ walk at least 5m/ take up position...."

Milady, it was planned....Not spur of the moment. He had time for reflection....Preplanned, not for months, but he had time. It was preplanned..'

Our argument is, accused should be convicted on all counts."

Nel steps down.

Roux wants to start 9am tomorrow.

Bet Milady will say has to be 9.30

  • #428
Oh, Milady wants court to continue for half an hour.....

As regards the father shooting himself between the legs , maybe he thought he saw an intruder with two fat cheeks and a big long nose lol.

  • #430
Uncle Arnold looks like the cat that got the cream...

  • #431
I had a computer crash problem for a time so did I miss Nel explaining about bats first shots last? I really wanted to hear that?

  • #432
Is preplanning same as premeditated in South African law?

  • #433
Roux is going to point out state's mistakes in material facts, before starting on heads of arguments.

  • #434
Roux: We were waiting for state to tell us what was the first noise....they also don't deal with the sound of the cricket bat.

  • #435
Roux using analogy of a witness seeing a man driving fast, and can you presume if you don't see him later and there's an accident, can you presume he was still driving fast when it happened?

  • #436
Now using example of a man who is happy at one time, then anxious later...

Judge pulls him up, is he talking about this case?

He says yes. Gives expert's evidence: "That there are two Oscar's milady. He testified there are two Oscars".

  • #437
Roux just quoted where Nel said to OP: "You are lying".

  • #438
R: We know that Hilton Botha was the investigating officer...he told blatant lies to incriminate the accused...

  • #439
Roux: The state says 'defence relies on this conspiracy, who would move the fan..' Milady, we are not talking conspiracy. It's common cause..it was repeatedly put to accused that he couldn't run out on balcony as fans were in the way....But Col VR said he walked out on the balcony when he walked thru the house, and couldn't recall if the fan was on...

The police came in, the fan was in the way....the police moved it. That's all the accused was saying....they picked things up. We know it.

  • #440
Roux: They wouldn't have known at the time it was important. But things were disturbed.
