To paraphrase: The Judge interjected and said that he cannot say one witness' testimony is true over another. Any one of them can be true, as it varies, person to person.

Pulling this forward, because it seems to me, to be the heart of the matter...



Estelle van der Merwe (EVDM)

– EVDM woke up and heard sounds of woman involved in an argument, a woman talking in a loud voice.
– EVDM looked over at the clock it was 1:56AM.
– EVDM went to the bedroom windows which looks out onto Farm Inn believing the sound originated from there.
– EVDM couldn’t see anything… she couldn’t determine from which direction that voice was coming from.
– EVDM said this argument wasn’t continuous; it started and stopped many times with varying intervals.
– EVDM couldn’t hear the other party involved in this argument.
– EVDM said she couldn’t make out the language or what the woman was saying.
– EVDM was sure it was a woman’s voice because of the pitch and “movements” in the voice.
– EVDM says this argument latest for about 1 hour and irritated her.
– EVDM went a second time to the bedroom windows but still couldn’t see anything.
– EVDM didn’t go to the bedroom balcony because she didn’t want to wake her husband.
– EVDM placed a pillow over her head in hopes of falling back asleep.

Around 3AM…

– EVDM heard 4 loud bangs around 3:00AM.
– EVDM’s husband woke up from those bangs and said to EVDM that those bangs were gunshots.

It's well known that human screams can be discerned over ambient noise even when the scream is only marginally louder than the background noise.

Then why not play the tape of OP screaming in OP's bathroom to see if those neighbours could distinguish whether it was male or female they heard?

Just the way that she started questioning Roux on what he was saying about the Burger's evidence, she sounded very sceptical and some of the things she recalled from memory in order to question him, has made me feel more comfortable that she has taken on board a lot more than I thought .. yesterday she had me quite worried with a a couple of questions she asked of Nel, but actually, she probably felt she had to ask something! She appears to be taking Roux to task a lot more today than she did Nel yesterday, and more crossly so, too.

R: In the bedroom of Mrs Burger it (sound) was def hard to be audible and def not intelligible....Mrs B's evidence of hearing sounds, compared to her husbands - he said it wasn't clear in the bedroom....if she heard emotion, if she was truthful...if she was truthful....it could not have been from the toilet.

It must have been outside the toilet. Who was outside the toilet? The accused....Acoustic evidence supports accused version.

he's getting ready to throw the Stipps under the bus. I don't think the judge will appreciate that. They are a very educated, well respected professional black couple, who 'made it' out of apartheid, and Roux is dissing them in court. And Stipp ran out of his safe home to confront danger because he thought a child was being harmed. And Roux is making fun of them now.

Oh, are they black? I didn't know that .. gosh, that puts a different spin on things then, and they way they've been treated/spoken about by both OP and now by Roux ..

Are you sure the Stipps are black? I had assumed that they are Afrikaans because of the names.
