Roux explaining why OP was an argumentative witness, why he was defensive and apprehensive on the witness stand. Roux really needed to address this.

He addressed it by saying it was all Nels' fault, for accusing him of murder...ridiculous, imo

  • #203
Now Roux seems to be covering bases as though the subsequent is not common cause?

  • #204
Roux conceding it on OP's behalf. Said the court should find him guilty of that count.

Yes, in answering the judges question.

He said look- OP admits he made a mistake.

OMG! Defense atty just said we're guilty!

LOL, going for the lesser charge!

Oh dear, you couldn't make all this up, could you .. OP was adamant he wasn't guilty of that charge, now they've done a complete U-turn because they don't want OP's lying on this charge to create a precident for the 'possibility' he lied about the main charge of murder.

Sneaky, v.v. sneaky. But then I guess this is what defence teams do, and what they are paid huge sums of money for. It's vile, imo.

R: Third fact, (something about screams. Missed it)

Fourth fact, there were two sets of sounds. Both sounded like gunshots.

  • #207
Roux talking about the sequence - gunshots first, cricket bat second. Says it's common cause.

Common cause that after the shots, Reeva couldn't have screamed.

Two sets of sounds - both sounds were like gunshots to a layman, although technically cricket bat hitting door is not as loud as gunshots.

Now Roux going over timeline

Whoop lost is feed. :(

R: The main count; four shots fired. Four holes in door and four empty shells.

Subsequent to the shots, the door was damaged by a bat....that's common cause it was a subsequent event.

I don't think it has been taken as 'common cause' by the PT, has it .. Nel said yesterday .. bat first, gun shots second.

Yes, in answering the judges question.

He said look- OP admits he made a mistake.

But the problem is, on the stand, under oath, OP DENIED the entire thing, called everyone else liars, and took no responsibility for it at all.

Is anybody's feed still up?

  • #212
Anyone have a live feed?

Okay, it's back.

  • #213
Talking about witnesses who heard sounds and called police.

Wow!!! Roux telling My Lady that the Court should find OP guilty of the Tasha's incident! I'm gobsmacked!

Having said that, I think Roux is only saying that as a clever tactic to try to trick the Court into believing that OP wants to take responsibility for it. The thing is: OP pleaded not guilty on that charge. Also, when the incident occurred, OP asked and allowed someone else to take the blame.

But the problem is, on the stand, under oath, OP DENIED the entire thing, called everyone else liars, and took no responsibility for it at all.

Exactly.

Sounds like Roux is trying to use Batman to counter what Derman did? The difference is that Derman claims to be an expert about the cause and effect of the startle/fight/flight/freeze so should have definitely explored the sound/s that caused OP's response, or lack of response that morning, whereas Batman was given a job to see if the bat could have been used to "break down" the door and possibly to help reconstruct it, not to count all the scuffs and marks on it.

R: If you try and put time to their movements it's not possible but takes me to about 3.12am which correlates with Mr Johnson. So that's the sound of the first shots....let's look at the accused who said he shouted help, help, help.

  • #218
Interesting how 4 or 5 minutes don't matter for Roux at this moment. Those 4 or 5 minutes were pretty crucial when he was crossing the state's witnesses.

Really? I didn`t know that.

Edit. As for taking responsibility, "he made a mistake" is sarcastic to me.

R: Carise said call came from her father about 3.19 and she heard help, help help about five mins before. That's 3.14....we know now about 3.14 there was a sound of someone calling help help help.
