Pistorius's father Henke, takes a deep breath as Judge Masipa reviews case law about the illegal possession of ammunition

Masipa points out that Henke Pistorius refused to make an affidavit saying the ammunition was his. Masipa says this doesn't matter

She just said 'aberration of justice' but not in the same context I am seeing this taking place.

“Section 1 20, 1 A, I quote, a person is guilty of an offense if she or he failed to comply with any provision of this act.”
"“The accused stated he did not contravene this act…

We're now talking about a previous case...about a firearm charge in a commission of a robbery

Dear oh dear, all this kind of detail on the relatively minor charge .. if only so much attention to detail had been paid to the murder of Reeva.

Wouldn't surprise me if the CH decision gets delayed...for a month of course

  • #165
I'll be damned.. he even gets off on this one, too.. slap me silly and call me susan

Quick O/T kinda... many WS'ers go through so many trials and folks *get off* of charges that folks don't think they should.... well, I assume for most in SA, they don't follow on tv like we have options for and experience...this is really gonna be hard to swallow for S Africans...

J: accused father refused to make an affidavit.....state needed to introduce evidence to contrary....state has FAILED to prove necessary animus

Not guilty.

Masipa points out that Henke Pistorius refused to make an affidavit saying the ammunition was his. Masipa says this doesn't matter

Masipa says the state failed to introduce evidence that proved Pistorius intended to possess the ammunition

Wait a minute... we saw a receipt for a .38 special gun that he was buying... does that not prove his intention to use .38 ammo??

  • #171
'From the above the State must prove that there must be an intention and animus from this previous case...'

'It would be an abberation of justice to convict unless he clearly had the intention to use/animus of the firearm...'?

Oh no this is going to a not guilty...also I feel unsure about this judgement...doesn't sound logical, though there is a precedent which still sounds different?

So culpable homicide and the restaurant only guilty verdicts right?

  • #173
Thats probably the last GUILTY VERDICT we will hear from her in this case

Judge: Count

1. (Killing of Reeva) Evidence unreliable....accused gave version that cld reasonably possibly be true...all law requires

  • #175
What a guy! Give him another medal and a slap-up meal.

Killing, firing guns, illegal ammo possession. IT'S ALL FINE!

  • #176
He is going to walk. Sickening.

  • #177
After every result there is a slight murmuring in the court, sounds like soft agitation.

  • #178
J:..from the above it is clear state must prove accused had necessary mental intention (animus) before there can be conviction....clear it's possible to possess a firearm innocently

.. kinell .. he's not even going to be found guilty of that!

So it's just going to be Tasha's then .. and CH, for which he will get a suspended sentence .. I have no words ..

  • #179
(Still count 1)

J: There is no basis on which crt could infere accused wanted to kill deceased
