I had to step away for a minute and was afraid that when I came back everyone would be gone.

Look in the dictionary under "masochist", says "WS member".
 
Is this supposed to be the Judge's last case? If the State does intend to appeal, I wonder if they have chosen not to indicate this during sentencing to allow the Judge to wrap things and exit proceedings without further ado.

I hope it is Masipa's last case. She needs to retire now and let there be Judges with no bias. I was not impressed with her at all, nor her female advocate.
 
Sorry, not caught up, but I think the State will appeal. There are grounds in both the judgement and the sentencing to do this with.

She said, this time, that it was clear that he acted with intention towards the intruder.

That's murder, surely?
 
I think AV the social worker/probation officer has ruined her own career as effectively as Oscar has ruined his, through her ridiculous 'I take note thereof' testimony. Which the judge ignored anyway, because it was so unreliable.

I wonder how many appeals will be lodged due to testimony from her and Dixon?
 
Not neccesarily. National Prosecuting Authority may consider an appeal if they feel the law has not been upheld.

ETA: Oops, in response to posts saying it's over because Nel and Arnold have said no to appeal.

I just saw NPA announce that on twitter, and was trying to work out what the initials stood for, so thanks!
 
Former prisoner interviewed on Sky and confirms Defence's case that prison conditions are truly horrendous. Even the hospital section is dangerous because prisoners break plates and use them as weapons and, in this case, the General has given an order...

Well let's hope so .. I'm of the opinion now that society will have to take the law into their own hands, as the justice system in SA clearly cannot be relied upon.
 
Carl was allowed to go down to the cells with OP for a few moments. Oscar fans were weeping and wailing in court.

NPA 'has an appetite' to appeal.

If this is correct, then I am REALLY angry.

Feel free to correct me but that wasn't at ALL clear from what we heard.

If I HAD heard that, I would have been REALLY ANGRY right then and there.

As it was, it seems like no one really knew what was going on.

I thought we were looking at something related to 5 years in PRISON, although less time, I know.

But TEN MONTHS and then HOUSE ARREST?????
 
I suspect the defense is releazing there is no point in them appealing because they got off easy and rather than have OP worry on the outside waiting his appeal, it is best to just get him behind bars to begin his term and get out ASAP on house arrest.

It makes no sense to appeal for defense because he has a chance being out sooner than waiting on any appeals.
 
A defence attorney said Nel could have stood up and told Masipa that they were going to appeal, but if he did this, he would have had to give reasons then and there. The attorney said it was better to use the 14 days to consider everything and there was no need to rush.

Prosecution not going to appeal the sentance but the actual charge op ch is one they may pursue

BBM .. yes, that is the one they should be appealing on and what I was hoping for, not the sentencing because that is meaningless considering it was against the wrong verdict .. but they have to wait until sentencing is over in order to do it.
