Unless, of course, it was a final good-bye, a last supper of sorts. I have been trying really hard to remain open-minded, but I feel that I am approaching the beyond a reasonable doubt standard with respect to intent. It makes me mad and sick!

I have a more sinister theory about why LH went through with the divorce, especially since the divorce was finalized around the start of the original trial.

I'm just going through the charming texts between RH and his many, many, sexting partners. Freezing and reading. He texts Leanna and others in between the sexting. How he managed to keep track of which conversation he's in is mind-boggling.

6/17/2014 4.41.49pm - Ross (On screen as Sp..): NEVER! Except that one time

Seriously? Only the day before? That is huge.

That is why my original post I asked if the time stamps were correct since there was testimony today about times being off. (with different witnesses) I did not watch the testimony carefully today and was just checking to make sure these times WERE correct. If so, this is BAD for Ross as it shows he was preoccupied when he pulled into the parking lot and left Cooper in the car.
Wouldn't that be good for him? It adds credibility to the notion that this was an accident. He was preoccupied, and since he was in the parking lot already, he had to have dropped Cooper off already. He was negligent, yes, but the intent is gone.

Ross should have taken Cooper to day care when leaving CFA, not when he pulled into his work parking lot.

I agree that they will convict him of negligence since he was. It will be interesting with the makeup of the jury to see what the outcome will be.

Katy, we keep agreeing that we agree, and then you assume I don't agree, about criminal negligence, that is.

The smoke and mirrors I'm referring to are about intent. The recreation of how hot the car is just the latest example. My DH is a (civil) trial attorney. I know all about how each side can manipulate expert reports and expert witness testimony, including by essentially shaping the results of the investigation/interview /experiment/report they want the expert to undertake. The question asked determines the reply given.

It's common practice, but juries don't know that. Smoke and mirrors.

Doesn't have anything in the world to do with not loving either kids or spouse, it just means needing time and opportunity to continue being one's own self on one's own. Nothing new about the idea at all, think girls' night out, etc. etc.

I agree. Taking a break from your kids is healthy. I was known to sometimes walk straight out the door when my husband arrived home from work. On Mother's Day , every year, I sent him and the kids to the park without me for a few hours so I could 'celebrate' by myself. lol


But taking a 'break' does not include having that break while you are in charge of caring for your toddler. And it does not look good for him that he is saying how much he needs that break, minutes before he abandons him in a hot car. JMO

How can JRH forget Cooper if he's actually talking about him?

IMO intent has been proven 100%.

You do not "forget" your kid at the same time you are having a conversation about escaping them.

I missed the latter 50% of todays trial. I came here for the facts and opinions tonight. Time for me to go read about 20 pages

I don't think it is that good for him. If he was preoccupied with a sick parent or a pending IRS audit, then it might be helpful to him to create sympathy and understanding that he was distracted.

But these texts/sexts started at 6 am. So he was CHOOSING to be distracted and focussed on something besides caring for his toddler.

If a child drowns in a pool, and it is because a parent is playing a video game or on social media, they usually go to jail for manslaughter. This is very similar. I don't think we can say he 'forgot' if in fact, he was choosing to do something that took all of his attention away from HIS LEGAL RESPONSIBILITY to care for his baby.

WOW. Good point. I think these texts are very bad for him. He is talking about his son, and needing a break from him, right as he turns the wrong way, and drives him to the work lot.

That is huge if the state can establish that he actually forgot him once before. If so, there is NO EXCUSE for it to happen again. NONE. He did nothing to prevent it from happening again, like a post it note, or the baby bag in front seat, or his briefcase in the back seat, etc.

I'm going in the opposite direction. IMO what the State is presenting for intent is smoke and mirrors, shell games, and bad character diversions.

They're making a strong case for criminal negligence, but imo the rest is about inflaming jurors to loathe RH. Sure hope jurors all told the truth in voir dire they could be impartial and base their decision on fact, not emotion.

Right on the money! I agree.

Does anyone know if Ross took Cooper to day care from June 3rd - June 17th? I do listen to some of the trial when I have a chance, but I also fast forward through all the boring stuff :blushing: Yeah, I do.. I try to listen on You Tube so I can do just that.. :crazy: So I may have missed some things..

If I remember correctly RH took Cooper to daycare 19 out of the previous 25 days before his death.

The more I think about it, the more I believe that people should be held responsible, even if the 'forgot' the baby was there.

If Dr Diamond is going to prove it is possible to just forget, then parents should be FORCED, by law, to take precautionary measures. Just like they legally have to use seat belts and car seats, and inoculations. They should be forced to do something to prevent the ability to just 'forget' their kids. There are many very simple methods. Put the Teddy Bear in the car seat and take it out an put it in the front passenger seat when your baby is riding with you. DONE. :baby:
