I went thru some of my notes today. and I can see where would be easy to have 35 or so. A "HI" is considered a text/chat/comment. Just with the now married witness K,Hickey Floyd, she testified just prior to RB Smith. 1st was RH "Good Morning at 5:49 a.m. then a response back from her at 10:52 a.m. then he reply back at 1:17pm and they chit chat back and forth. This is the one he asked to her to send a pic of her breast and she replied if he asked nice and he said "please madam" he replied ummm. then she asked if he wanted to play with them 1:32 pm RH F yes I do.. KHF, well good thing come to those that wait. RH well I shall wait 2:07 KHF Good... There are about 18 if i counted right back and forth between them. She is the one who sent him a pic of her crotch 6/13/14 (and now is in evidence) and met him at a Rotono Park (sp?) for a bj.

There are the same way with others. I don't think it was a sitting there constant thing as it is being suggested. Maybe the phone alerts when someone replies like when get a text message. jmho

Even if it is not a 'constant' thing--if one is texting/sexting 30 + people in one day, it is pretty distracting from other important things.

There were a flurry of text/chat messages prior to the one "red image" Whisper msg. EMT Payton testified that RH said fed Cooper at 845. Possible that RH gave that time thinking about being at CF. We do not know what time they arrived into the parking lot of CF. We know when they walked in and out. Very well could have been in the parking lot texting. JMHO. We know Cooper ate in CF.

Kilgore also said in OS that the former Mgr (who testified) did not know Cooper and was first time had seen him inside. That RH usually went through the drive thru in mornings and they couldn't see him from drive thru. That was the testimony from the CF mgr. Another reason I think they will have RH debit transaction for CF. Habit.

One more I am thinking may call, RH boss. Or someone from HD

Kilgore made statement about "work" late at night and texting and emailing the Travel Agent. (he emailed her after midnight, she sent him an email, he didnt respond but records show he started googling carnival cruise kids at like 942? Anyway it was shortly after he arrived to work.

Possible they have some "work" documents that RH was working on?

Kilgore stated this day was a normal day. JMHO he means the amount of texting chatting and so forth. Brandon Miller the coworker said they all had couple monitors on their desks and would have videos going, looking up stuff on line Reddit... they all did it.

I will be really surprised if any of his bosses take the stand for the defense. I bet Home Depot is mortified by this trial. And they certainly will not appreciate his lack of work focus, not to mention all the other horror stories already mentioned. I doubt the DT wants to open up this :worms:

JMHO after listening to Det Raisse testimony and after he stepped down, Kilgore and Rodriguez both stopped him and spoke with him. I thinking he may be recalled.

Det Stockenger interviewed LH and Det Raisse was 2nd chair. Stockenger was not called to testify (wonder if he will be for Defense prior to LH?)

He was asked by the Boring on ReDirect if Raisse was familiar if ALABAMA had any homicide with Malice or Maliouce Intent?
Raisse: no ALABAMA does not have Malice or Maliouse Intent in their code sections. It is something specific to state of GA.

It just seems that there are so many things piled on that Ross 'never' saw, heard, smelled, thought of, looked at, etc etc... He never looked towards the car seat, never heard anything, never smelled anything, never thought about him as he got to the drop off turn, and so on and so on....it just seems so convenient for him...

JMHO lots of other people "never" saw, heard, smelled or thought of either, or even put in a report... yet :thinking: testified different. Again JMHO from watching testimony, taking notes and rewatching to make sure.

If they are subpoena they have no choice but to. JMHO It could go either way.. Brandon Miller said that possible RH was stressed that day, he had heard in the lunch room that RH was behind on a sprint project and others were having to chip in and assist. Could show if he was working from home in the evenings. So forth.

Some could say if he hadn't been doing all the "other" stuff than work then maybe not behind. I don't know what his job consisted of. So again JMHO could go either way. But made me curios since Kilgore mentioned "work" late at night.

RBBM, where are you getting that RH texted or sexted 30 people+ in one day?? I have scanned my notes and no where have I seen that even suggested nor testified to that I can find, nor does Google. 6 people in this case. But they are not even counting LH or the chats with coworkers.

Yes. There are 3 nurses and two children of police officers on the jury. I think they will be helpful in the jury room. I also think seeing the car and car seat the other day will be a huge obstacle for the defense to overcome.

JMHO I bet the children of LEO or their parents, wouldn't appreciate the investigation that we have seen testified to thus far. (the unfactual information used to get SW's and so forth)

Two Questions: 1. What would happen legally if let's say the cops agreed it was just an accident in Georgia? Is the state obligated to file charges in each and every case where a child died in a car from the parent leaving them?
and 2. How many other cases like this resulted in no charges for the parent?

I ask as I wonder if Ross read somewhere that this type of " accident" results in no charges ?

The PIO talked about the smell at the initial press conference, but there's no proof of that now, unfortunately.

If you go back and listen to the Jan or Feb 2016 Hearing various Media outlets had filed Motions to have it live streamed and be in the courtroom. Kilgore list many instances that the media got wrong, LEO giving their opinions instead of facts and so forth. Some as you say no longer avail. He had some saved that had been since removed CNN iirc. He was right on the money. He warned Judge Staley that it was going to cause problems getting a fair trial. Thus we are now watching it 300 miles away.

The state has rested their case in the Justin Ross Harris murder trial and defense lawyers were expected begin to call witnesses Friday afternoon.
As the defense for the father accused of leaving his 18-month-old son in a car to die prepares to call witnesses, one question looms over the trial: When will Harris' ex-wife, Leanna Taylor, testify?

when Ross made the " there was no malice " comment at the police station it made me wonder what research he had done if any in order to state that. We don't know he never ever searched or read it online. His history was deleted regularly if sounds.

It is most often the case that the parent who does this gets off with no charges. If charged and convicted the punishment has been lenient. If I remember right there are two people in Georgia facing charges for kids dying in hot cars. One is a dad of twins - he was drunk. The other is a grandma who left her grandson in a car during the winter with the heater on because she didn't want to wake him up...for something like 5 hours.

The medical examiner -- the State's own expert witness -- said there would be no smell of decomposition at that time.

Plus, there are other cases where a parent has left a child in a hot car all day and then driven around doing errands with the body in the car - and they never smelt anything. Unless all of those parents intentionally murdered their child, it shows that it is possible to forget your kid is in the car and then drive around with their body without smelling anything.

I saw where Stoddard stated same thing about RH. Yet he testified that when he went to Pipers patrol car he told RH where his son's body was being taken. Det Raisse testified that Det Stockenger took LH and him first to LH/RH residense and dropped Raisse off and Stockenger took LH to CCPD. I feel certain that she was told where Cooper was taken just as RH was. Reviewing Raisse testimony right now.

LH knowing where Cooper's body was taken and asking to see him one last time are two different things. My career is as a coordinator for organ/eye/ tissue donations and I've never experienced a mother not wanting to see their child again. Usually we had to wait for them to be finished saying their goodbyes. There were plenty of times that parents actually waited at the hospital or outside of our private surgical facility until the anatomical gift was recovered and they knew their child's body was picked up by the funeral home. Everyone grieves differently but I've see a lot of broken-hearted parents and never any like LH and RH.

I don't think FBS is what happened in this case, but I do think forgetting may be behind it Let me explain. Have you ever played a video game and lost track of time? Have you ever been so immersed in virtual reality that you don't notice what is going on around you? I once played a new game and spent all night at it, not realizing I had done so until the rest of the family started getting up. Another example, although a benign one, has to do with my dog. She loves to play fetch and I noticed a few times while immersed in a virtual game that I wouldn't notice her bringing me a toy and I would only notice it later when I noticed the toy left on the floor next to me . After that I have made an effort to pay attention more. My hubby is a programmer and when he's "in the zone" I used to joke we could have monkeys hanging on the ceiling fan and he wouldn't notice!

None of the above is an excuse but it might possibly be an explanation. I think it's possible RH was just so glued to his phone and texting that he really didn't pay any attention to what was going on around him. Ever have to avoid hitting someone at a cross walk because they were glued to their phone? If that happened he still is guilty of Cooper's death. Remember a few years ago when a couple of new parents got so caught up in the newest release of a computer game they let their baby starve? I'm not up on the law but wouldn't this be manslaughter or criminal neglect?

I have a hard time believing RH planned to kill his son, mostly because he seems like he is too big a "doofus" to come up with one and too lazy to carry it out. Pretty much RH shouldn't be responsible for taking care of anything including a house fly.

I can certainly see being zoned out on a cellphone or computer game. But the minute you turn it off you return to reality and see that dogs ball and baby in the car seat.

Ross was inches from his son. He didn't forget the things on the seat next to him.

He saw Cooper. I'd bet my life on it!

I'd say it's pretty darn inconvenient for him. His son is dead and he's on trial for murder. Oh, and his wife divorced him and he's been in jail for 2.5 years.
