“Are smart people immune from these kinds of memory failures,” Kilgore said.

No, Brewer said. “That makes them in no way immune to them forgetting…The very best of us are not immune from having failures in anything that we do.”

Brewer said he couldn’t find anything in Harris’ day that would have signaled to the dad something was amiss.

Brewer claims that he didn't see anything that would jog JRH's memory.

He just testified that JRH having a conversation about escaping his son would make it less likely he forgot his son.

He also testified that seeing/feeling Cooper beside JRH would make it unlikely that he forgot his son.

He also said that NOT having a Chik-Fil-A bag would be an absence that might trigger his memory.

This guy needs to make up his mind.

I think he said "assuming" there is a failure of memory. Then he stipulated that he is not trying to testify in favor or against any theory in the courtroom.

But loads of the other parents who.left their kids in hot cars also had conversations about their kid, even conversations with their wife about who was going to pick the kid up, or other triggers such as picking up their kid's swimming kit or driving to pick up their kid from daycare, with the dead kid still in the back.

I call BS on this distraction that the DT is trying to make into something like Ross forgetting Cooper. Ross wasn't distracted AT ALL when he went to CFA. He wasn't distracted when strapping Cooper in his car seat at CFA. He wasn't distracted when Cooper was watching tv before they left the house to go to CFA then to day care. Ross got sex messaging all day long and yet he continued to go about his day. He didn't forget the lightbulbs, and yet he could have been distracted... But when it came to Cooper, his living breathing son that should have been the MOST IMPORTANT thing that day, he was too distracted and suddenly FREAKING FORGOT?? Not buying it!!!! NO, NO, NO!!!!!

And many other parents have remembered other things yet forgot to drop their kid at daycare. Judge Naramore remembered to do several errands, pick up his son's swimming kit then drive to daycare, all with his dead son still strapped in his carseat. Other parents have remembered to drop off the older kids at school or daycare but then forgot the baby. It can happen.

He can not talk about RH specifically. They can not give an opinion ultimately about RH. That what has been said at hearings.

How frequently did JRH shave his beard? Not shaving that morning, when he obviously had ample time, is interesting to me. I wouldn't want my mug taken without being clean shaven. However, the prostitute described him as being dumpy and insinuated he was unclean and unkept so it may not bother JRH. He looks haggard this morning.

Kilgore finished by saying that "all of this means nothing and he just forgot because he forgot."

So the testimony of his own witness means nothing?

Now Brewer is saying JRH isn't responsible for his own memory loss, only moments after agreeing that JRH chose to stay up late instead of getting sleep.

Even under best case scenario performance is not perfect, Brewer said.

Witness just made such an important point. No one would expect such disastrous results from staying up late. Boring needs to know when to stop.

Can people be so negligent that they self-inflict memory lapses? Boring said. Harris was staying up to all hours of the night sexting women, he pointed out.

I don’t think that’s a fair characterization of what’s going on here, Brewer said.

“He didn’t choose to be tired. He didn’t choose to be negligent,” he said. But that doesn’t mean he knew what dire consequences there could be, Brewer said.
