Well, this was a confusing day, wasn't it? I get the impression that she doesn't know which of them did it. Maybe Rafferty tried to tell her she did it. I don't know. She could have done it, like she says, but I find it strange because buying garbage bags and a hammer and having everything ready was apparently his idea. Also, how did she get the hammer out of his trunk in her rage? I would think she wouldn't have the presence of mind to do that.

I wonder if they're going to try to perjur her on the stand and make her admit she was not the one who killed Tori but it was Rafferty and she took the fall for it to protect him?

n/t I believe you are spot on. The Crown wants to show it was MR who did the actual swinging of the hammer, that he was the mastermind/planner behind this whole sickening abduction, sexual assault and murder. They want to bring forth the truth because it will back their evidence which is to come. Of course JMO. Just starting to read tweets so excuse me if I quoted something someone has already covered.

Everyday is a bit more heart wrenching..

How is this possible? If someone had just kicked her and fractured her ribs, hard enough to lacerate her liver -- then how it is she had "no wounds" on her body?? She'd have had bruising in the area where she was kicked. :twocents:

I believe she said the killing happened at dark?

Hmmm, would bruises show up right away?

Depends i would think, I have had bruises just show up days after i hit my leg or soemthing .

Justice Thomas Heeney is now instructing the jury on inconsistent statements. He says the jury cannot use statements made by McClintic on May 24, 2009 to decide the current case because at trial she has maintained that it was her who hit Tori Stafford with a hammer. However, they can use those statements to determine the credibility of McClintic as a witness.

Heeney tells the jury the court needs to examine more legal arguments and will not be needed until Wednesday at 10 a.m. He reminds the jury that they have only heard Crown evidence and the case is far from over. "Your job is to keep a completely open mind" until beginning deliberations, he tells the jurors.
