@AM980_Court Rafferty, was somehow able to pop the trunk after the sexual assault, but he was in the back passenger seat. How could that happen?

McClintic may have been capable of murder, Gowdey says, but she was adamant that this was Rafferty's plan.

Did McClintic kill Tori at Rafferty's urging? Was it planned, was the hammer brought out, even before the assault?

Gowdey again reminds the jury, no matter how the view the killing, they must only find Rafferty and McClintic acted together.

I wonder if LE or the lawyers ever asked TLM if MR ever discussed with her prior that he wanted to rape a child. I know that he mentionned taking people out of their homes but if were going to the guts of this motif, as I see the Crown is doing (a fabulous job I might add) to tell the story, are they saying "this is is the only logical reason" referring to the rape and that MR wanted to do it which is why he took Tori, as the only story they are AWARE of or that could possibly make sense? Are we and the Crown missing something here that maybe Rodney knows?

If rage drove McClintic to kill, Gowdey suggests she would have killed the rapist, not the little girl.

This crossed my mind also. As a past victim (was she not?), I would think she would want to go after a man who raped the little girl who represents the man who raped her. She probably added the I would murder again, but I only feel bad because it was a child to her godmother to further bring credibility to her changed story. Did TLM not tell her godmother this recently. That MTR is a really dangerous man. The wolf in sheeps clothing!! MOO!

I don't know the answer to your question but I've always believed this was a Karla/Bernardo copycat. If God forbid, they would NOT have been caught (and McClintic confessing), I think Victoria would not have been the last victim. I think Rafferty thought he had found the perfect crime partner.

I can see the Crown's comments and questions in regards to TLM's testimony about being the one who actually killed Tori are very similar to our thoughts and comments here. Why would she kill Tori and not MR?? Exactly, WHY!! They do not believe that she did it, they believe he did IMO

Don't worry, he is about to get exactly what he gave...karmas a B*** and where he is going I'm sure he will get to appreciate what it feels like.
 
According to previously-heard evidence, this is simply not true. At the very least, TLM also changed her version as to whose idea it was to purchase the hammer and garbage bags.



And yet, in previous in testimony (evidence) by TLM, she claimed that she did. So, was this another lie, or is Gowdey trying to minimize the number of lies she actually told?

It seems to me that the Crown wants the jury to do exactly what <modsnip> JMO

Even if I do decide what I want to believe and what I don't, it does not exhonerate MR in my view. I listened to both sides. I was unimpressed, and unconvinced by Derstine's side. I felt he skipped over a lot of things, and suggested things that may or may not have happened rather than just flat out present a solid case to show exactly what happened (in MR's version!) and what did not. A little evidence to back up his client would have helped immensely as well! Strangely, I do not believe every word spoken by TLM. I won't even bother to explain the testimony that she gave that I do not believe except this:

I don't believe that Tori wasn't targeted by TLM. BUT - even if she was - I do not care! MR had an opportunity, several infact - to step up and defend that kid and get her home to her mama safely! Whether TLM walked into the school to get Tori or she picked up from the outside of the yard makes absolutely no difference! The fact remains, that MR drove them all out of town, and someone's spunk bit was found exactly where Tori's blood happened to land (in a most unusual place too if you ask me!). And Tori's brutalized, broken remains were found, half naked discarded in trash bags in the middle of nowhere!! Targeted or not, what did MR do to try to help her? To protect her? Thats right, nothing - because the defense would have you believe he spent the time walking away, playing angry birds (making that up, there is no link to support this) or some crap on the internet on his beloved BB as Tori was murdered while she peed in a field.

I definitely make choices about what to believe and what not to. I choose to believe that despite the gaps in her testimony, and despite the lack of credibility in her account of the specifics, that essentially they were both involved, both failed Tori, and both harmed her physically and emotionally, then killed her and left her behind in a rock pile. I rest my case.
 
McClintic often lied, Crown admits

"I know you won't believe everything she says. We don't ask you to."

But Gowdey said at least 25 specific details from her testimony about April 8, 2009, the day Tori disappeared, can be confirmed by independent evidence, including surveillance video, Blackberry records and items that were found by police.
