10/4/22 Tuesday, Trial Day 11/Penalty Phase Day 2: Prosecutor Phil Groenweghe & Defense attorney Stephanie Zipfel gave final arguments. After roughly two hours of deliberation, the jury unanimously recommended Emery should die. Judge Fagras will formally sentence Emery on 11/3/22. If the Judge confirms the death sentence, an execution date will be set.

11/4/22 Update: Emery was convicted of murdering his girlfriend & her family days after Christmas in 2018 will suffer the death penalty in state prison, a St. Charles judge ruled Thursday. Judge Michael James Fagras affirmed the jury’s recommendation of capital punishment for Emery. “This is a difficult decision to make, and I don’t take that lightly,” Fagras said. Emery will be moved to death row at the Potosi Correctional Center. The execution will take place at the Eastern Reception, Diagnostic & Correctional Center in Bonne Terre. The exact manner & time of the execution will be determined by the Missouri Dept. of Corrections, Fagras said.

*Sentencing Hearing (@ 9am MT)- CO – Barbara “Bobbie” Jo Oberholtzer (29) & Annette Kay Schnee (21) (both last seen on Jan. 6, 1982; Oberholzter last seen about 7:59pm & found on Jan. 7, 1982 about 3pm, 300 ft. south of Hoosier Pass Summit about 20 ft. off Hiway COl 9 in a snow embankment; Schnee last seen Jan. 6, 1982 about 4:45pm at “The Drug Store” in Breckenridge & found July 3, 1982 in rural Park County 20 miles south of Breckenridge in Sacramento Creek south of Alma) - *Alan Lee Phillips (31 @ time of crime/70/now 71) arrested & charged (2/24/21) with 2 counts of 1st degree murder after deliberation, 2 counts of 1st degree kidnapping & 2 counts of 1st degree assault with a deadly weapon. Plead not guilty. Held without bond.
United Data Connect, new information was developed with genetic genealogy to identify the potential suspect in the case.

9/15/22 Thursday, Trial Day 13: Phillips was found guilty on 2 counts of 1st degree murder after deliberation, 2 counts of felony robbery & 4 counts of kidnapping. His trial started Aug. 29, 2022 with jury selection. The jury began deliberations at about noon Thursday & returned with a verdict just before 5pm. Sentencing hearing on 11/7/22.

*Jury Selection continues (Day 9) (@ am ET) – NJ – Daniel Griner, Jr. (23 mos.) (reported missing @ 6:30pm Feb. 8, 2019, Bridgeton; found 2/9/19 @ 3am buried in yard, burned & dismembered in her purse) - *Nakira Monae Griner (24/now 27) arrested & charged (2/9/19) & indicted (6/19/19) & arraigned (10/7/19) with 1st degree murder, 2nd degree endangering the welfare of a child, 2nd degree desecration of human remains, 4th degree tampering with evidence & 2nd degree false public alarm. Plead not guilty. No bond. Denied pretrial release (9/12/22).
Said beat toddler for not eating & not listening to her. Died from blunt force trauma & multiply bone fractures.

*Trial continues (Day 37) (@ 10am ET for jury) - OH - Pike County 8 people dead: Christopher Rhoden, Sr. (40), his ex-wife, Dana Manley Rhoden (37), their three children, Clarence "Frankie" Rhoden (20), Christopher Jr. (16), Hanna Mae (19); Frankie's fiancée, Hannah Hazel Gilley (20), Christopher Rhoden Sr.'s brother, Kenneth Rhoden (44), & a cousin, Gary Rhoden (37). Hanna Rhoden's baby girl (5 days old), another baby (6 mos.) & a young child (3) were unharmed. (April 21-22, 2016, Pebbles) – for *George Washington Wagner IV (27/now 31) (Jakes’ bro) indicted (11/12/18), arrested (11/13/18), charged (11/15/18) & arraigned (11/28/18) with 8 counts aggravated murder, (plus gun specifications on each), 1 count of 1st degree conspiracy, 4 counts of 1st degree aggravated burglary, 1 count of 5th degree unlawful possession of dangerous ordnance, 3 counts of 3rd degree evidence tampering, 1 count of 5th degree forgery, 1 count of 5th degree unauthorized use of computer or telecommunications, 1 count of 4th degree interception of wire, oral or electronic communication, 1 count of 5th degree obstructing justice, & 1 count of 1st degree engaging in a pattern of corrupt activity. Plead not guilty. Held without bond. DA will seek the DP. Per Jake’s plea agreement, DP is off the table only for Jake if his testimony is truthful. But George still faces the DP as he did not take a deal.
Trial began on 8/29/22 with final jury selection & the jury was seated on 8/30/22. 12 Jurors & 6 alternates. Jury: (9 women & 3 men) & 6 alternates: (5 women & 1 man). 9/30/22: Ill juror replaced with alternate. 12 jurors & 5 alternates. Jury: (9 women & 3 men) & 5 alternates (4 women & 1 man). A few are in their late 20s or 30s, but most are in their 40s or 50s.
Trial began with opening statements on Monday, 9/12/22. (Trial is scheduled for 8 to 9 weeks (56-63 days).

11/4/22 Evidentiary Hearing: Prosecutor Wilson also says the defense will get the case Monday or Tuesday. Judge Deering says if he allows truck pictures, jury needs to be instructed to provide weight as they see fit. On the transcripts and snippets - they have the weekend to review. He is going to allow truck pictures as long as foundation laid with jury instruction.

So today is cancelled for trial - and jury will be sent home. Final decision on the transcripts & wiretap snippets will be played will be made Monday. Defense will be calling their witnesses starting Monday - out of order but the jury will be made aware of that.

Tuesday, November 8th:
*Must report to prison (by 2pm PT) CA - Sherri Louise Papini (34 @ time of crime/39/now 40), whose kidnapping (11/2/16) & sensational return on Thanksgiving day, 11/24/16 captured global attention, has been arrested & charged (3/3/22) with making false statements to a federal law enforcement officer & defrauding the California Victim’s Compensation Board of $30K. (Paid victim assistance money based on her kidnapping story. From 2017 thru 2021, Papini’s request for victim assistance caused approximately 35 payments totaling over $30K, including for visits to her therapist & for the ambulance that transported her to the hospital after her return. No bond. Unsecured bond reset (3/8/22) @ $120K ($70K secured/$50K unsecured). Bonded out on 3/8/22.
Papini plead guilty (4/11/22) to lying to a federal officer & 2 counts of mail fraud. The plea agreement calls for Papini to pay restitution topping $300K. That includes $30,694.15 to the California Victims Compensation Board, which reimbursed her for things including visits to her therapist for "treatment for anxiety & PTSD" & for the ambulance ride to the hospital after she surfaced near Sacramento. She also will pay the Shasta County Sheriff's Office nearly $148, 866.23 & the FBI more than $2,558.35 for their expenses during the investigation. She also owes the Social Security Administration at least $127,567.60. Total is $309,686.33. Defendant further agrees that she will not seek to discharge any restitution obligation or any part of such obligation in any bankruptcy proceeding. Sentencing on 9/19/22.

9/12/22 Update: Papini should be sentenced to eight months in prison, prosecutors say. "A lesser sentence, such as the one month of imprisonment recommended by probation or home detention in lieu of incarceration, is not sufficient to achieve the purposes of sentencing," prosecutors wrote in a sentencing memorandum filed Monday in U.S. District Court for Eastern California. They also recommended three years of supervised released after time served. Papini’s attorney William Portanova said in a sentencing memorandum for the defense that Papini should be sentenced to a “term of no more than eight months with one month in custody & seven months of home detention under appropriate terms & conditions.” Sentencing on 9/19/22.
9/19/22 Update: U.S. District Court Judge William Shubb ordered Papini to serve 18 months in prison Monday, more than double the amount of time federal prosecutors recommended. Judge William Shubb ordered Papini to turn herself in to begin her prison sentence by 2 p.m. on 11/8/22. Shubb concluded that the sentencing recommendations from the prosecution & defense were both insufficient & said Papini would likely still be perpetuating the hoax had she not been caught in a web of lies. In addition to prison time, Shubb ordered Papini to serve three years of supervised probation when gets out & pay $309K in restitution, which the judge said will likely never be paid.

*Trial set to begin-MAYBE! (@ am session ET) - NC - Mariah Kay Woods (3) (Nov. 27, 2017, Onslow County; found Dec. 2, 2017 in Shelter Creek in Pender County) - *Adolphus Earl Kimrey II (32/now 37) (BF of Mom) arrested & charged (12/2/17) & indicted (2/23/18) with 1st degree murder, felonious child abuse inflicting serious bodily injury resulting in death & felony concealing a death, obstruction of justice, felony 2nd degree burglary, felony larceny & misdemeanor possession of stolen property. Plead not guilty. Held on no bond. DA will seek DP.
The cause of death was chloroform toxicity. Details of death sealed, search warrants & 911 call were unsealed Feb. 24, 2018.
Trial was set to begin on 3/21/22 continued to 11/8/22. (expected to last 2 months).

7/5/22 Update: As Onslow County continues into its post-pandemic phase, District Attorney Ernie Lee is still trying to put a dent into the backlog of pending murder cases that COVID-19 restrictions halted in the past two years. Lee said over the next couple of weeks his office plans to schedule even more trial dates. However, scheduling can often be difficult & has a lot of moving parts as he has to speak with prosecutors & defense attorneys. Kimrey's trial has been moved multiple times, but Lee said the office plans to start his trial in the fall. However, he added that Kimrey's trial will be based on how things go with another murder case. Kimrey's trial is a capital case & the DA's office is seeking the death penalty.

Karun (21 @ time of crime/53/now 56) charged (12/14/19 in Maine-Federal ) & indicted (11/6/19) & arraigned (12/14/19) with possessing a gun with an obliterated serial number, stemmed from allegedly owning a rifle that had its serial number filed away. Plead not guilty.
Police found 60 weapons & 15,000 rounds of ammunition in his Stetson home. As a convicted felon not legally allowed to own firearms.
*Indicted (3/10/21 in Maine-Federal) charged & arraigned (5/18/21) with possession of child p0rnography. Plead not guilty.
Trial was set to begin on 9/6/22 with jury selection continued to 9/7/22 & trial begins on 9/8/22 was continued to 11/8/22.

Thursday, November 10th:
*Sentencing Hearing (@ 10am CT) – MI – Susie Zhao (33) (last seen by her mother on July, 12, 2020 @ 5:30pm leaving home, found July 13, 2020 near Pontiac Lake State Recreation park in White Lake Township @ 8:30am, Detroit; due to severe burns (90%) to her face & body, authorities needed a week to identify Zhao) - *Jeffery Bernard Morris (60/now 62) was arrested (7/31/20) after being pulled over on a warrant in Ypsilanti & charged (8/4/20) & arraigned (9/24/20) with 1st degree premeditated murder & charged (3/8/21 & 1/11/22) & arraigned (4/15/21) with homicide felony murder. Plead not guilty. Denied bond.
Zhao was bound with zip ties, tortured, sexually assaulted & set on fire after meeting a convicted sex offender at a motel the night before her badly burned body was found. Morris is a Tier 3 sex offender.
Trial began on 10/3/22 & ended on 10/5/22. State & Defense rested their case on 10/5/22. Jury found Morris guilty (10/7/22) of all counts.

10/7/22 Friday, Trial Day 4: Closing arguments by Oakland County’s lead prosecutor John Skrzynski & defense attorney Michael McCarthy & Judge Martha Anderson gives jury instructions. And jurors started deliberations.
It took a Michigan jury less than an hour to find Morris guilty of murdering Susie Zhao. Morris was found guilty of 1st degree premeditated murder & felony murder in Oakland County Circuit Court for the killing of Zhao. Sentencing for Morris will take place on 11/10/22, according to Judge Anderson. He faces a separate life sentence without parole for both counts.

*Fabian Elias Gonzales (33/now 39) (“mom’s” BF) – 8/1/22 Found guilty of all charges. Sentenced on 10/27/22 to 37 ½ years in prison.

*Trial set to begin (@ 9am CT) - TX – Charine Marie (Young) Wilson (29) (last seen Nov. 10, 2018, Houston, reported missing Nov. 12, 2018, found Dec. 12, 2018, Richland) - *Johnny Leon Wilson (48/now 52) charged (11/12/18), arrested (1/30/19), indicted (4/16/19) & arraigned (6/18/19) for 1st degree murder & tampering with evidence (human corpse). Plead not guilty. $100K/murder & $25K/tampering. Bond made 2/29/20.
Was on the run from 11/12/18 but on Wednesday (1/30/19) Wilson was arrested by a fugitive task force in Las Vegas.

11/7/22 Update: Judge Stephen Broome sentenced Phillips to two terms of life in prison after the women’s relatives called for the maximum punishment for the slayings that forever changed their families. Broome said he would impose a life sentence without the possibility of parole for each of the two women, ordering them to be technically served one after the other, rather than at the same time, to allow the maximum penalty under the law. Prosecutors had asked for that to allow the loss of each woman’s life to be recognized.

10/17/22 Update: On July 19, 2021, this Court denied the Defendant’s motion to dismiss the indictment in the above matter & set the case for jury selection on August 4, 2021. *Sentencing Hearing (@ 10am CT) – MI – Susie Zhao (33) (last seen by her mother on July, 12, 2020 @ 5:30pm leaving home, found July 13, 2020 near Pontiac Lake State Recreation park in White Lake Township @ 8:30am, Detroit; due to severe burns (90%) to her face & body, authorities needed a week to identify Zhao) - *Jeffery Bernard Morris (60/now 62) was arrested (7/31/20) after being pulled over on a warrant in Ypsilanti & charged (8/4/20) & arraigned (9/24/20) with 1st degree premeditated murder & charged (3/8/21 & 1/11/22) & arraigned (4/15/21) with homicide felony murder. Plead not guilty. Denied bond.
Zhao was bound with zip ties, tortured, sexually assaulted & set on fire after meeting a convicted sex offender at a motel the night before her badly burned body was found. Morris is a Tier 3 sex offender.
Trial began on 10/3/22 & ended on 10/5/22. State & Defense rested their case on 10/5/22. One hour after deliberations the jury found Morris guilty (10/7/22) of all counts. Sentencing hearing on 11/10/22.

Sweet (38) arrested (11/28/21) & charged (12/1/21) with neglect of a dependent resulting in death & unlawful possession of syringe.
No actions were taken by her adult caregiver to rescue Emma from the dangerous environment & this inaction resulted in her death," the Bartholomew County Sheriff alleged in a statement, "and thus the manner of death is homicide."

10/18/22 Update: Clements was convicted Sept. 30 of 1st degree murder & kidnapping in the death of Maribel. He was scheduled to be sentenced Wednesday, 10/19/22 in Pima County Superior Court, but the date has been moved to 11/14/22. Court officials also said Clements’ attorneys have filed a motion for a new trial & a motion for judgment of acquittal not withstanding the verdict. A 11/7/22 motion hearing is set for both motions. A judge also will hear testimony on 11/14/22 for a possible change of venue for Clements’ other murder trial, scheduled for 2/2/23 involving the death of Isabel.

The defense also sent subpoenas to West Chester police Capt. Seth Hagaman, who questioned Wagner IV in the Rhoden case in 2017 when employed by the Bureau of Criminal Investigation & Clinton Canter, a former corrections deputy in the Ross County Jail in Chillicothe where Wagner IV was held from his arrest in November 2018 until late 2021 or early 2022.

10/17/22 Update: Holmes is pregnant with her second child, a key prosecution witness told a judge at a hearing today. U.S. District Judge Edward Davila quizzed former Theranos lab director Adam Rosendorff, who made an uninvited visit to Holmes' Silicon Valley home in August. On Friday, Judge Edward said during a Zoom hearing that he intended to ask Rosendorff a few questions about why he visited Holmes' home and whether the visit was driven by any doubts about the testimony he gave under oath during six days of the trial last year. Davila emphasized that he expected the hearing to be brief and limited in scope after quashing a subpoena from Holmes' lawyers seeking any non-privileged communications about his testimony.

11/7/22 Update: Judge Edward Davila denied all three of Holmes' motions requesting a new trial. A sentencing hearing, previously scheduled for last month, is now set for 11/18/22.

11/7/22 Update: Pima County Judge James Marner rejected two motions by the attorneys of convicted child killer Clements. Denied a request for a new trial & judgment of acquittal notwithstanding the verdict. Clements will be sentenced at 11 a.m. Monday, 11/14/22. He faces up to life in prison without the possibility of parole.
11/14/22 Update: Clements was sentenced Monday to natural life in prison. Judge Marner also sentenced Clements to 17 years in prison for her kidnapping. That sentence will be served consecutively with the life sentence.
*Isabel Mercedes Celis (6) - Murder trial for Isabel set to begin on 2/2/23 for jury selection (2 days) & trial starts on Monday, 2/6/22 thru 3/3/23.

11/9/22 Update: Holmes & her legal defense team are asking for an 18-month period of house arrest, as opposed to the maximum 80 years of potential jail time the Theranos founder faces. In a lengthy memo pleading for leniency, Holmes requested that the court “look beyond that caricature,” of her in the media & “examine Ms. Holmes the human being.” Sentencing hearing on 11/18/22.

Judge Davila concluded the total loss in share value that can be attributed to Holmes' fraud is $121M. He concluded the guidelines for her sentencing is 135-168 months (11 to 14 years). Judge Ed Davila sentence Elizabeth Holmes to 11.25 years in prison plus 3 years of supervised release. The judge set a surrender date for 4/27/23.

8/31/22 Update: Randall Abney had his jury trial this week at the Dent County courthouse in Salem. After 90 minutes of deliberation Wednesday, he was found guilty by a jury of his peers for 2nd degree murder & abuse or neglect of a child resulting in death. His wife Susan was the key witness, testifying against her husband in the trial. Susan had already cut a plea deal in Crawford County court on a change of venue from Dent County. She pleaded guilty to abuse or neglect of a child resulting in death & her 2nd degree murder charge was dropped. Susan still awaits her sentencing which is scheduled for 10/11/22 & Randall is set to receive his sentence on 11/18/22.
11/18/22 Update: Abney has been sentenced to life in prison for the starving death of his adopted daughter in October 2020. Abney was found guilty in August, 2022 of 2nd degree murder & neglect of a child & was sentenced to life in prison on both counts.

11/17/22 Thursday, Trial Day 2: On Thursday, testimony & evidence were permitted by the judge on the case about a separate 2012 incident in which Harper was charged with capital murder. San Antonio Fire Dept. paramedic Carlos Segura testified that in 2012 he responded to a call of an unresponsive child that was concerning to him. Harper was questioned about that incident since he was with the baby at the time the incident happened but wasn’t initially charged. The interrogation footage from 2012 was also admitted & shown to the jury Thursday.
The special prosecutors on the case still have about seven witnesses left to testify and the trial is expected to go into next week and possibly the week after Thanksgiving.

*Trial continues-Closing Arguments (@ am CET) - Germany - *Irmgard Furchner (18 @ time of crime/95/now 97) Indicted (Feb. 5, 2021) on 10,000 counts of accessory to murder in Nazi Camp. Furchner is accused of having contributed as an 18-year-old to the murder of 11,412 people & 18 additional counts of accessory to attempted murder when she worked as a secretary, stenographer & typist to SS commandant Paul Werner Hoppe & would have had a hand in transport lists of detainees due to be sent to Auschwitz for execution, the dictation of Hoppe’s orders, radio messages & his correspondence at the Stutthof concentration camp between 1943 & 1945.
Trial began on Oct. 19, 2021. Trial is scheduled to continue over the next few months. Sessions are limited to about two hours a day, based on medical advice.
After trying to escape the trial in late September, leaving the retirement home in Quickborn where she lives & traveling by taxi to the outskirts of Hamburg, she was arrested several hours later & placed in police custody for five days before being fitted with an electronic wrist tag.

June 7, 2022 Trial Update: The trial was interrupted for 8 weeks because she was ill. The latest is that the trial has resumed & they had to stop after 2 hours because both the defendant (96) & the witness (95) were exhausted. This was on June 7, 2022. Trial continues on June 13, 2022.
June 13th to June 17th: No idea what’s going on – trial continues on Monday, June 20th thru Friday, June 24th.
Nov. 11, 2022 Update: German prosecutors called Tuesday for a 97-year-old woman who was the secretary to the SS commander of the Stutthof concentration camp to be convicted as an accessory to murder & given a two-year suspended sentence. Furchner hasn't responded to the charges against her during the trial. There are no formal pleas in the German judicial system. Furchner is being tried in juvenile court because she was under 21 at the time of the alleged crimes. Closing arguments are to continue on Nov. 29, 2022.

*NV - Jason Scott Quate - In custody in Nevada, Clark County (#17F10214X): 3/12/20 Plead guilty to multiple counts of sexual assault on child. Sentenced on 7/14/20 to 28 years to life. Was extradited to Illinois 10/4/20.
Trial was set to begin on 10/3/22 was cancelled. Plead guilty (10/25/22) & sentencing hearing on 11/30/22.
