*Aggravation & Mitigation Hearing (Day 2 of 3) (@ 9am CT) - NE - Sydney Loofe (24) (Nov. 15, 2017, Lincoln; found Dec. 4 & 5, 2017) – *Bailey M. Boswell (23/now 26) charged & indicted (6/11/18) & arraigned (8/6/18) with 1st degree murder & improper disposal of human remains & charged (3/1/19) & recharged (8/9/19) with 2 counts of conspiracy to commit murder. Plead not guilty. No bond. DA will seek DP.
Trial began with jury selection on 9/23/20 & trial began on 9/25/20. (thru 10/16/20). Saline County to Lexington, Dawson County for trial. Jurors: 8 men & 7 women. After the alternates are dismissed-Jurors: 8 men & 4 women for deliberations.

6/30/21 Update: Day 1 of sentencing: A three-judge panel began hearing evidence here Wednesday to determine if Bailey Boswell, his co-conspirator, should get the same punishment. Boswell would be the first woman in Nebraska to get the ultimate sentence. Assistant Attorney General Doug Warner & defense attorney Todd Lancaster presented their cases. Wednesday, which was the first day of a three-day hearing, was a graphic day. Photos of Sydney's dismembered body were shown to the three-judge panel. It included several photos of her arms, head, torso & thighs. State prosecutors did this because they argue that the “Crime was particularly cruel or manifested in exceptional depravity by ordinary standards of morality or intelligence.” Doug Warner, the assistant attorney general, said Loofe was singled out as a victim. “That the murder, where there was apparent relishment of the murder by the defendant, needless mutilation of the victim, senselessness of the crime & helplessness of the victim,” said Warner. Boswell's defense attorney, Todd Lancaster said the state’s case relies on body mutilation, which took place after her death. He says Loofe’s murder doesn’t fit into the specific criteria that warrant the death penalty. “Mutilation cases be limited to cases where the mutilation is not simply an effort to hide the crime. The evidence you’re going to see today is basically an effort to hide the crime,” said Lancaster. Boswell had some family members present. Two left when the photos of Loofe got especially graphic. Boswell kept her head down while many of the photos were shown. The hearing continues Thursday, 7/1/21 @ 9am.
*Aubrey C. Trail (51/now 53) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. 11/15/19: Judge denies Trail’s death penalty challenge. Judge denies motion for new trial. Sentenced on 6/9/21 to death.

Plead not guilty. $750K bond.

7/2/21 Friday, Day 3 of sentencing: Defense witnesses: Eli McBride, an FBI special agent who worked on the case. Dr. Kirk Newring, who did a psychological evaluation of Boswell. Boswell was apologetic & emotional as she pleaded with the three-judge panel to not give her a death sentence. Her team pointed to letters from Saline County Jail inmates saying she’s been a blessing. She thinks she can do that in the prison for women in York. The state put documents into the record that included coded jailhouse messages between Trail & Boswell, that they say attempted to align with each other's testimony. They also say Boswell sought a relationship with Trail & has messaged men & women in jail in exchange for money. Boswell focused much of her statement on her young daughter, saying she’ll later learn what she did, and that still, she wants to have a relationship with her. Closing arguments were not made in court, and instead will be written statements that are due in August 6 & rebuttals on 8/13/21. The three-judge panel must later unanimously agree for Boswell to be sentenced to death. No further court dates in court site as of 7/4/21.

Was serving a 7 year federal prison term for illegal possession of a revolver at the time of his New Orleans’ arrest.

MI - 14 men charged in plot to kidnap Michigan Governor Gretchen Whitmer, Oct 2020
2/11/21 Update: A federal judge Wednesday delayed the trial of five men accused of plotting to kidnap Gov. Gretchen Whitmer by almost seven months to give defense lawyers more time to prepare. The move by U.S. District Judge Robert Jonker to reschedule the trial from March 23 to Oct. 12 in federal court in Grand Rapids follows a request from defendant Brandon Caserta who cited voluminous evidence amassed during the FBI investigation. The trial is scheduled to start Oct. 12 in federal court in Grand Rapids. Ty Garbin, who plead guilty will be sentenced on July 8. Preliminary hearing for rest (except Croft & Garbin) on 2/17/21.
4/5/21 Update: A document filed in federal court lists over 200 items attorneys are looking to seize from locations where several men suspected to be involved in a plot to kidnap Gov. Gretchen Whitmer met & trained. The Bill of Particulars for Forfeiture of Property span 18 pages, filed in US District Court of Western Michigan’s Southern Division & Hon. Robert J. Jonker against Adam Fox, Barry Croft, Ty Garbin, Kaleb Franks, Daniel Harris & Brandon Caserta. The prosecution also reserves the right to seek the forfeiture of later-identified assets pursuant to the notice provided. The Forfeiture Allegation filed on Tuesday [3/30/21] provided notice to the defendants that upon conviction, the U.S. would seek forfeiture of any firearms & ammunition involved in the commission of the crime.

Defense plans to call Dr. Phil Danielson as expert on DNA. Dr. Danielson will not be called this morning so Judge can look over a report from Texas Commission on Forensics regarding his reliability as an expert. The judge advised the defendant this morning of his right to testify/not testify. He did not require an answer now, that will come at the end of the defense case.

ICE logged an immigration detainer on Rivera. Confessed to killing Mollie.

GUILTY - IA - Mollie Tibbetts, 20, Poweshiek County, 19 Jul 2018 *Arrest* #50
6/4/21 Update: Judge Joel Yates ruled on the motion on Friday. The ruling comes exactly one week after Bahena Rivera was found guilty of killing Tibbetts back in 2018. The Court was informed that a witness for the prosecution had viewed the livestreamed coverage of the trial on May 20 from a room outside the court. The court disclosed that information to attorneys & after conferring with his lawyers, Bahena Rivera requested a mistrial based on the livestreaming viewing. The Court used an oral ruling denying the motion, finding no party sought a sequestration order from the Court & no prejudice resulted from that witness viewing the livestream. In his written ruling, Judge Joel Yates noted under Iowa law, exclusion of witnesses isn't a right, only obligated upon court order. Without such an order, the witness who viewed the livestream didn't violate any court mandate. Judge Yates has denied a motion for a mistrial in the first degree murder conviction for Bahena Rivera in the death of Mollie.

*Trial set to begin (@ am ET) - SC - Samantha "Sami" Josephson (21) (last seen on video March 29, 2019 @ ~1:30am, Columbia, found Friday (3/29/21) afternoon in a rural area by turkey hunters in a field near a wooded area about 40 feet off a dirt road along Black Bottom Road close to the town of New Zion in Clarendon County) - *Nathaniel David Rowland (24/now 27) arrested & charged (3/30/19) & indicted (4/18/19) with murder, kidnapping, possession of a weapon during the commission of a violent crime, refusal to stop for police command, & possession of 28g or less of marijuana. Plead not guilty. Bond denied.

Josephson was last seen by friends between 1:30am & 2am this morning, 3/29/21 on the 700 block of Harden Street. Shortly after 2am, Josephson was seen on surveillance video getting into a dark (black) vehicle, possibly a newer model (2017) Chevy Impala. Friends said to have gotten into a car shortly after 2am. EDT but “then her Uber was cancelled.” Her phone was tracked to a house in the Rosewood (neighborhood) but she wasn’t there when (her) friends checked in,” the friend told us. When she didn’t show up at her downtown residence & didn’t answer repeated phone calls, her friends became concerned & notified CPD,” police said in a statement.
3/30/19: At a press conference Saturday evening, Columbia Police Chief Skip Holbrook said that 25-year-old Nathaniel David Rowland had been charged after a joint investigation by the Clarendon County Sheriff's Office, South Carolina Law Enforcement Division and Columbia police. Just before 4 p.m. Friday, Clarendon County sheriff's deputies responded to a report of a body found in a rural area. Turkey hunters found the body in field near a wooded area about 40 feet off a dirt road. Josephson’s blood was found in the back seat & trunk of the Impala as well as her cell phone found in the passenger compartment.
3/31/19 Update: At a hearing on March 31 at the Alvin S. Glenn Detention Center in Columbia, Rowland exercised his right not to be present & the judge said his bond hearing would take place at a later date (4/22/19) in General Sessions Court. Rowland is still being held at the Alvin S. Glenn Detention Center & has not been offered bond.
4/22/19 Update: Rowland had been scheduled to appear in General Sessions Court at 9am at the Richland County Judicial Center in Columbia. It was pushed back indefinitely. A preliminary hearing on 5/9/19, which was delayed.
4/18/19 Update: Richland County Grand jury indicted Rowland for murder, kidnapping, refusal to stop for police command, possession of 28g or less of marijuana, and possession of a weapon during a violent crime.
6/11/20 Update: Video conference. Richland County Judge DeAndrea G. Benjamin said she denied Nathaniel Rowland’s request for bond because he could be considered a danger to society. Tracy Pinnock, the public defender represents Rowland. The prosecution presented a pile of evidence stacked up against Rowland, including: Samantha’s blood and hair found in his car. Rowland seen on video using Samantha’s debit card and attempting to sell her phone in the hours after her death. Samantha’s blood found on his clothes that he was seen wearing on the night of her murder. The murder weapon was found at a home Rowland had visited that evening. Cleaning products and rubber gloves found at his home. Child safety lock was on in the car he was driving. Video showed Samantha getting into Rowland’s black Chevy Impala. Cell phone evidence tracked Rowland and Josephson’s phones in the same locations, including where the body was located. Detectives also found a footprint in the car on the window belonging to Samantha — evidence showing she fought for her life in her last moments.
4/20/21 Update: On Thursday, 5th Circuit Solicitor Byron Gipson told the State that Rowland’s trial is tentatively scheduled to start in a Richland County courtroom on July 19. The trial is expected to last a week or more. State Judge Clifton Newman, a trial judge with 21 years on the bench, will preside. Prosecutors include Fifth Circuit Solicitor Byron Gipson, Dan Goldberg, April Sampson & Amanda Gaston. Attorneys from the Richland County Public Defender’s office will represent Rowland. They are Tracy Pinnock, Alicia Goode & Robert Pillinger. Jury selection will begin Monday, 7/19/21.

7/19/21 Update: Johnson appeared in court Monday for a motion hearing. His lawyers are claiming there was a coercive environment from law enforcement that led to the confession. But now, his defense attorneys are trying to throw that confession out ahead of the murder trial. Court documents for the motion to suppress say police gave Johnson 15 breaks to smoke, eat, drink, and go to the bathroom throughout the interrogation process. At Monday’s suppression hearing, detective, Lanis Geluso, testified on the stand. Geluso also went into specific details about what exactly Johnson told her that day he admitted to killing her. The hearing will continue on 8/4/21 on whether the confession will stay as evidence or not. A new trial date has not yet been set.

7/21/21 Wednesday, Day 4 of Trial: State District Judge Tina Clinton declared a mistrial. Jurors were divided 11-1 in favor of convicting Edwards. Lawyers questioned the holdout juror in a hearing that was closed to the public. The juror said she did not believe that Edwards was guilty & felt that reviewing the evidence wouldn’t change her mind. Jurors deliberated about 2 hours Tuesday (7/20/21) before being released for the evening. During the first day of deliberations, they sent a note asking if they could consider other charges besides capital murder. The judge said they could not. After deliberating about 30 minutes Wednesday (7/21/21), jurors sent several more notes. In one, the jury foreperson said that one juror refused to look at all the evidence, specifically photos. The foreperson asked if the juror could be excused. An alternate juror waited in another room.

4/21/21 Update: On the 10-month anniversary of Linda's disappearance, law enforcement discovered human remains behind Smoker's workplace, Dutchland Inc. They feel confident the remains are that of Linda's. They were in a grave, wrapped in a tarp. She was moved here several days after homicide. Investigators believe Smoker moved Linda's body from a site off Harvest Drive in Ronks to the grave he made behind Dutchland Inc. in Gap, where he worked. Body had a bonnet & clothing matching Linda’s autopsy on Friday, 4/23/21. The coroner said the cause of death was asphyxia caused by strangulation with a knife wound to the neck as a contributing factor. Next Status conference hearing on 7/23/21 with Judge David L. Ashwroth presiding. Smoker will be pleading guilty per news articles.
7/23/21 Update: Smoker's plea deal. Plead guilty 3rd degree murder. Besides the 1st degree felony homicide conviction, Smoker also plead guilty to felony kidnapping & misdemeanor charges of: abuse of a corpse, false imprisonment, possession of an instrument of a crime & 2 counts of tampering with evidence. The abuse of a corpse charge stems from the moving of her body from an initial grave to a second, more secluded site. Prosecutor “This is not a compromise” necessary to "Bring Linda Home". Prosecutors said they entered a plea deal with Smoker because they believe they never would have found her body without his help. Smoker led police to the area. Smoker had been facing the possibility of the death penalty, but under the plea deal, he avoided that & instead will be looking at a minimum of 35½ years in prison (and maximum of 71 years) that will only start after he completes a sentence for violating parole that could run 17 years. If the parole board assigns the maximum sentence for his previous robbery convictions, he would serve a minimum of 52½ years & a maximum of 88 years. All of his sentences handed down Friday for the Stoltzfoos case will be served consecutively, meaning one after the other.

Was serving a 7 year federal prison term for illegal possession of a revolver at the time of his New Orleans’ arrest.
Trial began on 2/11/20 with pretrial motions & jury selection started on 2/19/20. Trial started on 3/4/20. Jury: 8 women & 4 men. 11 alternates. (1 alternate excused on 5/18/21) Now 10 alternates. (1 juror (#3) excused for medical reasons on 7/8/21). Now 9 alternates. (Trial expected to last 5 months). Plead not guilty. Bond denied.

7/23/21 Friday, Trial Day 4: State witnesses: Danny Conyers, financial crimes investigator (retired) with Wells Fargo fraud dept. Showed CCTVs footage outside of bank ATM. 2 attempts were made on ATM card with incorrect pin #; at another bank where the same person tried to use ATM 9 times. Destiny Catina, former gf. Eric Grabsky, former SLED agent & cellular location analysis expert, explaining to jurors technical issues & acronyms in lead up to talking about what phones of Josephson & Rowland show about their location the night Josephson disappeared. Kimberly Mears is a forensic scientist for SLED, fingerprint analyst. Verona Herrera, used to work for SLED, evidence processing technician & forensic serologist. Rachel Nguyen, works for SLED as forensic serologist. Ryan DeWane, DNA scientist for SLED. Expert in DNA analysis & serology. Results: Samantha's DNA found under defendant's fingernails (right hand), but Rowland's DNA was NOT found under Samantha's fingernails; Samantha's & defendant's DNA found on flip-flop in trunk of car; Samantha's DNA found on passenger back seat of car; Samantha's DNA found on front seat headres; Samantha's DNA found on front seat seat-belt; Samantha's DNA on black gloves & paper towels found in white Family Dollar bag discarded in trash; the soles of child's shoes found in his girlfriend's closet have Samantha's DNA on them; Rowland's pants has Samantha's & his DNA on them; Rowland's utility tool has Samantha's DNA on it; hair on the multi tool was hers.

Found incompetent to stand trial; in State hospital in Pueblo. Found competent to stand trial (5/25/21).

*Madani "Ama" Ceus – Child: Termination of parental rights hearing on 8/20 & 8/21/20. Sentenced for murder on 6/19/20 to 64 years in prison. Restitution hearing on 9/11/20.
*Ashford Nathaniel Archer aka Nathan Yah aka Nathanyah Nitchitu (50) – found guilty & sentenced to 24 years in prison. 5/8/19: Appealing his guilty verdict. 1/29/20: The notice of appeal document from July is for now restricted to case parties; the opening for appeal 4/14/20. The appeal will be handled through the Colorado Attorney General’s Office.
*Nashika Leonie Bramble (36) – Jury verdict guilty of 2 counts of 1st degree murder. Sentenced to two consecutive life terms in prison without parole. Bramble’s appeal brief had been due Thursday 2/27/20, but the Court of Appeals granted an extension until July 16. Until the appeal is filed, the specifics of what Bramble is contesting are not public.
*Frederick "Alec" A. Blair – Plead guilty. Sentenced to 12 years in prison.


Thursday, July 29th:
