Tarrant docket is only showing the 2023 sex assault cases

Is it this: Tarrant County #1760265, 1760269 & 1760276 ??

Last update I have is he was supposed to have an initial hearing on 1/3/23 & have had no updates since 9/16/24. That was the last time I could access the site.

  • Tarrant Co court records were updated to show that the case has been assigned to the 297th District Court, Judge David Hagerman.
  • This is the same court that is handling the three unrelated sexual assault of a child cases out of Tarrant Co.
  • All four cases are set for a status conference Nov. 18 in Fort Worth.
  • The timeline for a trial is unclear. With a new judge, a new schedule will likely be issued.

Reported missing by mom @ 6:40pm on 11/30/22; found deceased along the water’s edge of the Trinity River southeast of Boyd on the evening of Dec. 2, 2022 about 9 miles from her home). *Tanner Lynn Horner (31/now 33) arrested (12/3/22), indicted (2/17/23), charged & arraigned (3/6/23) with capital murder (under the age of 10) & 1st degree felon aggravated kidnapping. Bond $1M (murder) $500K (kidnapping). Surety Bond total $1,545,000. Plead not guilty (3/6/23). DA will seek DP (2/18/23). Wise County #CR24559 (Murder)/CR24558 (Kidnap)/Now in 297th District Court-Tarrant County

8/28/24 Update: Horner’s attorney with the Regional Public Defenders Office (RPDO) filed a change of venue motion in 271st District Court in Decatur Wednesday, according to court records. RPDO attorney Susan Anderson argued in the motion that “inflammatory pre-trial publicity” about the case would prevent a fair trial. She cites publicity in newspapers (including the Wise County Messenger), television, radio & on social media since Strand’s disappearance on Nov. 30, 2022, from her father’s home in Cottondale. Defense counsel retained the services of Bryan Edelman of Trial Innovation, a national jury research firm, to assess the impact of pretrial publicity on Horner’s ability to obtain a fair trial. He reviewed 125 news articles published by the Wise County Messenger, Fort Worth Star-Telegram & Dallas Morning News, with 72 of the articles appearing in the Messenger, according to the motion. DA James Stainton said he believes this is a Wise County case & should be tried locally. Both sides are expected to make their arguments on the motion in front of District Judge Brock Smith at a court motions hearing 9/16/24 @ 1:30pm. No trial date has been announced.
9/16/24 Update: Defense attorneys for Horner & prosecutors made their cases Monday for & against moving his capital murder trial outside of Wise County. Dr. Bryan Edelman of Trial Innovations testified about his report on the pretrial publicity in the case, reviewing 125 news articles published by the Wise County Messenger, Fort Worth Star-Telegram & Dallas Morning News. A couple of television news stories were also shared in court that mixed audio & video of memorials for Athena with facts of the case, which Edelman said was particularly impactful in creating bias in potential jurors. RPDO investigator Mike Johnson testified that he came to Wise County to interview residents around the county & found that only about 20 out of 100 would talk to him & he received four affidavits from people saying Horner could not get a fair trial in the county. DA James Stainton called Bridgeport Mayor Randy Singleton & Wise County Judge J.D. Clark to testify as elected officials with knowledge of the community that Horner could get a fair trial locally. District Judge Brock Smith said he would try to have a ruling on the motion by the end of the week.

9/20/24 Update: 271st District Judge Brock Smith has granted Horner’s motion to move his capital murder trial out of Wise County. In an order filed Friday afternoon, Judge Smith granted the change of venue motion & ordered the case be transferred to Tarrant County. A hearing on the motion was held Monday in 271st District Court in Decatur & Judge Smith considered the testimony of four witnesses, two for the defense & two for the state, as well as affidavits from local citizens. In granting the motion, Judge Smith pointed out that although the 271st District also includes Jack County, moving the trial to that county would not be possible. At Monday’s hearing, Dr. Bryan Edelman of Trial Innovations testified about his report that found pretrial publicity in newspapers, television & social media made it difficult to find a fair jury locally in the case & had created what he called “a presumption of guilt, rather than a presumption of innocence” in the case. RPDO investigator Mike Johnson testified that he spoke with local residents about the case & received four affidavits from people saying Horner could not a get a fair trial in Wise County. DA James Stainton called Bridgeport Mayor Randy Singleton & Wise County Judge J.D. Clark to testify as elected officials with knowledge of the community that Horner could get a fair trial locally. Stainton said Friday he was disappointed that Wise County citizens would not be able to hear the case, but it won’t change how his office handles the case. 271st District Judge Brock Smith on Monday issued a scheduling order in the case with jury selection set to begin in late January/early February with a trial date in mid-March. Pretrial hearing on 1/21/25 & 1/22/25. Full jury questionnaires submitted to the Court & finalized by 1/21/25. Full jury panel in central jury room on 1/30/25. Individual voir dire begins on 2/3/25 & trial will begin on 3/17/25.
10/17/24 Update: The capital murder trial of Horner may not take place early next year as originally scheduled. Just days after a scheduling order was issued in the case by 271st District Judge Brock Smith setting jury selection to begin in late January/early February with a mid-March trial date, Horner & his defense team with the Regional Public Defenders Office (RPDO) filed a notice that he does not consent to Judge Smith continuing to preside over the case. According to state law, when a judge grants a motion for change of venue, the judge continues to preside over the case only if all parties agree. As of Wednesday, 10/16/24 no public record could be found indicating if the case had been assigned a judge & a court in Tarrant County yet. Since a new judge & a new court will now be taking up the case, it is likely a new scheduling order will be issued at some point in the future.

12/21/22 Update: Wise County jail records now show he's also facing three counts of sexual assault on a child. However, these charges are not related to Strand's death & appear to have been filed in Tarrant County. The charges are related to three separate incidents which all occurred in 2013 in Tarrant County. Next initial appearance in Tarrant County on 1/5/23 @ 10am.
10/25/24 Update: Murder case was moved to Tarrant County & his 3 sexual assault charges will be tried with his murder case. Status hearing on 11/18/24 @ 10am.

The capital murder trial for a FedEx driver accused of killing 7-year-old Athena Strand is set to begin next year in Tarrant County.

Pre-trial hearings are scheduled for January, with jury selection beginning Feb. 3, according to Tarrant County court documents. The trial is scheduled to begin March 17. An attorney for Horner did not respond to a phone call or email from The Dallas Morning News seeking a comment.

They've changed the court site and I'm not able to search by case # or name. There's a docket search for the 297th District Court but he's not on it for those dates. I'll look at this again tomorrow. My brain is tired and I may be missing something. :confused:
