Attempting to demonstrate how disordered TH was then in order to be spared the DP now.

Yet, one after the other, each witness has conceded TH was actually common and not very remarkable.

He had so many caring adults in his life, he had opportunities to be not a murderer.

witness is being questioned outside presence of jury. Defense witness is being voir dired. Her name will not be used :rolleyes: and she will be blurred. FFS I am sick of this ish.

She was an in-home facilitator for the autistic kids in the district. She works along with the teacher on behavioral issues. Goal is to reduce erratic behaviors so they can focus on teh work and aren't disruptive to the other students. Also teach parents how to respond to and address inappropriate behaviors so everyone is on the same page.

I like how Athena's mum sits right behind him second row - he must feel like his neck is exposed all the time hes sat there and keep wanting to flinch and scream like a little girl in case she pounces on his neck - but shes too classy to.

TH had challenges. Does anyone dispute that?

So do many students.

Not a predicter of anything.

TH didn't have to do what he did.

But he did. Because he wanted to.

Despite all the early intervention he was provided.

Choice. He made a choice.

she cannot say what the diagnostician did, she only had access to that individuals report 2003 or 2004 was her first contact with Tanner. Last contact was last month of school that same year at Azl Junior High.

She created the plan for Tanner using teh report created by the diagnostician. She is expected to testify about Tanner and how he was, his behaviors.

Tanner was a great kid, great kid, he behaved, we enjoyed each otehr. We might go to the ark or to the restaurant and learn to order, how to sit and wait for that order to be served. We went to pet deer.

State challenged relevance. Judge ways to see what she's expected to testify to. To determine if she'll be allowed to testify before the jury.

Maybe they'll bring all of our middle school teachers to testify to nothing today.

She will only be testifying to what she herself saw and she will not be testifying about all the plans she created using the diagnostician's report. (so is the diagnostician's report never going to be entered? it isn't sounding like it, must have been disallowed)

Indeed it is. I half expect them to bring in a juggler he admired in the 3rd grade and a man wearing a fireman's coat because in the 6th grade he wanted to be a fireman. And they'll all be blurry, and crying.

This is why people can't stand defense lawyers. They'll bring in the entire circus just to get their client a lesser sentence.

state objects to any testimony as to what any other expert told her. She can testify only to what her own interactions and experience of Tanner was. She cannot bring up the diagnostician's report or what it contained.
