He performed EEG MRI and Petscan.

Q. Both actual Doctors who read them indicated defendant's brain activity was within normal range, unremarkable?
A. yes
MRI and Petscan you indicated most of the things on there were normal and intact yes?
A. yes

The Defense just lost $40,000 in the wind.

Q. How is it with all of these abnormalities you discussed that the defendant isn't sitting in a room somewhere drooling?
A. well all of these abnormalities would be defined as mild.

and there you have it. ETA I love the state.

Witness hasn't watched the tapes. Can't speak to the activities jury saw on the tapes.

TH exclusively has issues in the social-cognition area of the cortex.

Sociopathy.

I could have told you that $40,000 ago.

He is literally describing the physiology of sociopathy.

This doesn't excuse TH. It explains him.

Back on the stand. This expert has testified in 7 or 8 trials on behalf of defendants. cross by the state.

Q: How many times have you done that spiel with the PowerPoint? (LMAO)
A. just a couple of times.
Q. how many times have you worked with these defense attorneys in the past?
A. About 4 times maybe. I haven't worked with her (names one of the defense attorneys) before.
Q. but she's a part of the same organization (firm) right? Objection from defense. granted jury wil disregard.
Q. What is your bill for this service.
A. including costs for the actual scans about $40,000.00 (holy shnarkies! all at taxpayer expense)
The Good Dr. should be ordered to cut each juror a sizeable check just for having to listen to and survive his huge, steaming pile of drivel.

So no subponae for experts? They get to decide whether to be a witness or not? Genuine question.

Otherwise I agree with your post.

His payment for this case = $40,000

Well, let me think about that. Is my personal integrity worth $40,000?

Wow. Well, I am retired from teaching now. But, could I actually state unequivocally that TH has mental impairment that he does not understand his actions or consequences?

I think that like most criminals, he thinks about immediate gratification. But he did understand his actions would have had consequences and he didn't care.

$40,000. Wow. But honestly, I would not be able to truthfully testify that TH has a mental impairment. That does not mean that he does not have psychological issues. But he was cognitive and understands the crime he committed. Based on my credentials and experience with children and adults with disabilities.

"Every behavior has an anatomy." Wonder what the anatomy of Tanner's abduction and brutal murder of a 7 year old child looks like?

ETA I sure hope the state asks him that on cross.

  • #2,259
Do you know why the Defense expert witnesses are all academics?

Because there's no factual medical basis for any actual qualifying mitigating disorder or defect in TH.
