This was very rare. It will be a brand new jury deciding the penalty so hopefully there will not be another mistrial!

The fact that it's so rare is what is concerning me. I found this link that speaks to the issue when there was a mistrial in the penalty phase in Texas. The defendant WON on appeal, but it was ultimately reversed by a higher court, The Court of Criminal Appeals then reversed it.

I guarantee Temple's attorneys will come up with some argument.... and considering Temple's last appeal, which he should have lost, this makes me nervous.

The most dangerous time of a woman's life is when she is pregnant. Number one cause of death for pregnant women is homocide.

I believe that anyone convicted of murdering a pregnant woman should have Capital punishment. The death penalty.

You state the truth and it is the saddest thing----- what is wrong when pregnancy for some women is a death sentence?

20/20: Texas Love Triangle Watch Full Episode | 2019-10-29

Watched the 20/20 episode on this murder/trial last night and I literally gasped when they said that until the recent trial, Belinda's family had not seen their grandson, nephew, cousin, Evan in 20 years.

That's just wrong....

HOUSTON — David Temple's request for a third murder trial was denied Wednesday.

Temple was seeking a third trial following the jury's inability to agree to a punishment in his second trial.

Prosecutors in this case also asked a judge for a change of venue for Temple's second punishment phase. That request was also denied.

Penalty trial expected to start late March per news video.

Investigative ID did a program last night about this case--did you
see it? i thought it was riveting----unfortunately because of the virus
justice will have to wait-- after watching the show, i am more convinced
than ever he is guilty-- his son Evan was in tears when the guilty
verdict was announced--- i guess he forgot his mother was murdered,
and as so often happens, the children side with the murderer--refusing
to believe he is guilty

I saw it. I'm curious ...did he chase her up the stairs in to her closet, or was she already up there changing her clothes when he shot her.
They showed where she had dropped her keys at the bottom of the stairs.

I am not sure about that either- however i think the police theorize he got
her as soon as she walked into the house

I saw it, he seems so smug. The son clearly believes he isn’t guilty. I’m sure he has ptsd that has manifested in various ways...denial?

Anyone know how or if the divorce has affected the case?

Yes, I wanted to say that I thought he seemed awfully Smug too.
And his fake tears on the witness stand...gmab!

I believe this is from when it originally aired on ABC on Nov. 2, 2019, only it appears it was split it into two, hour-long episodes when it aired on Discovery ID (this version is two hours long):
