Wait! Why would it be filed under civil? Isn't AK a criminal charge? That seems really odd. I have no doubt his lawyer filed it but I'm having a hard time with it being civil. Then again, I looked at his lawyers website and he has his illustration posted upside down. doesnt seem like he is paying attention to detail. Lol
Does this mean he is trying to get his bond reduced so he can get bailed out?? (edited)

Going back to the first search warrant that for EA'S car he said he parked in the Blue Martini garage because a friend had recently moved in. Sorry hard to keep up but do we know any more about this? Knowing EA'S habitual lies I wonder, but could this have something to do with his returning to Granite which is north of the garage also?

Does Luminol still shows blood even aftter clean up?
Oh yes! That's why they use it. To be able to see blood residue hidden by clean up. It sticks to the proteins specific to blood. Then they know it's there & can try to find a sample not too contaminated by cleaner to analyze for DNA.

One last thing right now in my head: EA said something like I have a friend who recently moved into the SOL that's why I know of the parking garage by martini bar. Was he speaking of PP or someone else? Could that be why he returned to SOL- friend helped? MOO and IDK- just talking it out.
Those were my thoughts. EA was either referring to PP's apartment or making it up to go with his story.
What if we keep some of our original theories?

What if CM DID willingly get in his car for one reason or another? Drugs? Trip to MM's to get her spare key? etc. I think it fits with the passenger seatbelt, and the time frames for exiting/custer gantry.

Maybe he gets suggestive? Maybe she says oh nevermind I don't want to wake MM I'll stay? Any number of things happen and he turns around to return at SOL.

But then he stops at Granite Park and gets hands-y. Maybe she jumps out of the car, a struggle happens, and she ends up in the trunk.

He's freaking out? Phones are pinging, etc.

What time frame would that leave between Granite Park and his home? Where could he go in that time? I do tend to think that he may have taken the Legacy route home. I think he may have slipped in front of police -- he DID take legacy, he just didn't do it the FIRST time, which is what they were asking about. ;)

I think this is a very viable theory with the info we have. It was 36 minutes from EA's last ping (that we know of) near SOL before he pinged back near his home at 5:32am.

Maybe the passenger seat area was meticulously vacuumed because that is where EA tossed CM's stuff (backpack, etc) & he was worried something might have transferred to his carpet... I only say this because I still have a problem with CM willingly getting in his car..(assuming she DID have her car key)..

But can they put in their warrant they have reason to believe she left in the trunk if they know she probably didn't? This is where I can't go forward with my thoughts. And can they say they believe sexual motive while they know it's something else? Its so confusing and misleading from the first time Tilley said "he goes this way, she goes that way and we don't know what happened" (not exact quote) IMO

I really think they are very selective on what goes in a warrant. Minimum details needed to get the warrant with a little theorizing to show what avenue they are trying to explore, which may or may not be accurate. It's the investigation, not the courtroom. Legalities are much more relaxed.

it is civil because the lawyer filed the writ of HABEUS Corpus. to add to my other question even if the bond is reduced and he is able to make bond they would still hold him at ICE due to the immigration? I will try to google and find my answers but wonder if anyone here knows how this all works

Believe immigration hold is if he's convicted, serves his time- then immigration gets him.
This is what I think. Not 100% sure.
I can't see a judge lowering it but you never know.

Just to add to odoban,
They found a gallon size. You mix that w water and it can produce 32 gallons of cleaning solution.
It was empty.

Someone whether the list maker was EA or not, did their homework. They didn't just use bleach like most.
Hopefully the home computer was used to research and will provide some more incriminating evidence

I have been trying to speed read and catch up to see if anyone posted the same theory I was thinking as I read.

I'm very close to your same one. I'm thinking along the lines of she willingly left with EA because he was going to give her a ride to her dads to pick up her key because he had a spare to her car. EA was going then going to give her a ride back to her car, thus explaining CM's text to HF at 3:58 to leave the door open.

Then, I think someone back at the house sent a text stating they found her keys again. They turn around to go back. At some point when they're back in the area of SOL and he then it goes to crap.

I don't believe he's illegal bc if he was, that should of been brought up for his sprint arrest.
It was reported by Brittany he's a citizen of mexico, so green card it is.

I thought very early on he may have offered (and she accepted) a ride back to the aparment for her keyes. But then I don't know what after that. I just can't picture him assualting her in the parking garage. Too little time for it to go down unless pre-meditated. But then pre-meditated could even be on their walk there if he thought he'd knock her out, put her in the car, and assualt her elsewhere.

YES! This is my same theory. I just went back and re-read the warrant surrounding these "pings" pages 8-9.
I believe both of their phones were continually pinging various towers this whole time so they must know (the area) where these two traveled together. The warrant states, pg 8, para 3 "Affiant is aware other cell towers exist in the area between the shops at a Legacy and EA residence.....the LAST recorded communication......" Continues

Basically I read this as they have ALL tower communications but based on the specific pings that are mentioned in the warrant from each,of their phones, the pings indicate that they were together and they further believe he returned to his house (for the first time) at 5:30am with CM in his trunk.

The keys are a bone of contention again because now her mom is saying they were lost "twice" and found the last time at the apartment after Christina went missing (according to an interview night before last I think?). I am still unclear on the keys.

The key situation is curious. Either someone was jokingly messing with her or purposefully hiding her keys for nefarious reasons.
