I will preface this by saying this is my own opinion and a possible scenario. After reading that Gianni, Sal and Ilona were indeed involved with drugs (heroin, Xanax), when it was vehemently denied by everyone at first, is it possible that Christina wasn't planning on leaving the apartment? She has a known connection (which we can't sleuth, so I won't say). It's not terribly unheard of for after hours parties to continue on partying. Could everyone in the apartment that night who wanted something give her some money and another party-goer who was wanting to leave walked her back to the garage where a sale would take place or she would drive to the sale? Said connection would know she had $$$$ on her from everyone at the party. The drug connect and herself would be somewhat known to one another in a general, peripheral kind of way and thus the sense of trust to voluntarily get into a car or meet up alone.

If that theory is simply to add a prior motive for her to have intended to get into EAs car at all, even if it could be proven to be true, it still wouldn't really change the rest of the story.

We're stuck with the simple fact that the DNA and blood of CM was found IN THE TRUNK of EA. As boring as it is to some, all by itself that presence of a large quantity of DNA and blood of hers in his trunk eliminates tons of other alternatives. When he left the garage at 3;58, so did she (in the same vehicle), and she wouldn't have ever been IN HIS TRUNK willingly or for her welfare. There's your abduction. Maybe a murder too.

In addition, if there had been some sort of semi-benign tale of how she happened to be in his car, EA would have undoubtedly offered that explanation long ago, in addition to telling where he left her and what else happened, in order to keep from such a serious charge of kidnapping and perhaps murder. His failure to say anything like that at any time truly speaks volumes.

I have to say thread 3 is very good ...

I believe she lived at her boyfriend's apartment (she is not on the lease, I think?). But, let's say she was on the lease and it's also her place - yet she invites/allows another man to spend the night/crash. Only for him to wig out on something apparently. She has no utilities for whatever reason and then some neighbor is kind enough to let this guy shower. Who does this? And by that I'm asking both things - who asks their neighbor to let a friend shower? and what neighbor says...hmm, ok.?

This screams strange drama and happenings in her life.

Steve I know her DNA was found but there are ways
to get DNA in a vehicle without murdering a person.

When drugs are the reason a crime is committed there is silence all around.
Lies are told!
No one knows anything or anyone.

Is he guilty maybe probably!
Im just not 100 percent sure.

This Little Lady had a lot going on in her short life and NONE of it was GOOD!

EA is in Jail and not getting out.
HF is in jail ans as I see it hes not getting out.

I try to keep up with 36 threads here, (and a couple other cases that I read) but I miss some posts or pages. When was EA indicted for AK?

TIA.

EA hasn't been indicted yet. Only accused & in jail on a $1000,000 dollar bond, that a judge refused to reduce, after hearing a minimal amount of evidence.

If they have video of them parking next to each other and walking away they have video of exactly what happened in that garage! Right?

I think they only know they parked next to each other by what someone has TOLD LE
I don't think they were seen parking JUST SEEN entering

I'm only quoting what was in the affidavit, to me it's entirely possible that the CCTV cameras were able to see the front of each car but not the area surrounding them or the trunk or the doors so I don't think you make any assumptions. I guess we all make out own minds up on whether we believe the affidavit. My personal view is that being able to see the cars drive and and park up doesn't logically lead to the fact that everything that happened around the cars would also be seen.

You can deny what the DNA tells, but the fact is, it creates a virtual (and conviction-worthy) certainty that EA put CM in his trunk.

It makes no sense to deny what we do know, and then try to build the truth using thin air tales, tales for which we really have no actual evidence, just pure conjecture.

To get to the rest of the story, you start with what you know, and work from there.

We know what happened in the 3:55 video. There are no stories (and therefore, no lies) used to prove that. We know she was in his trunk - her DNA and blood in there wasn't from someone's story either. We know the tales he told that didn't add up, which came from his own mouth and not someone's story, and the pings (some we know of, many more we don't) which come from technology not druggie words.

I just looked up the difference between kidnapping and abduction

http://law.onecle.com/texas/penal/20.04.00.html

§ 20.04. AGGRAVATED KIDNAPPING. (a) A person commits an
offense if he intentionally or knowingly abducts another person
with the intent to:
(1) hold him for ransom or reward;
(2) use him as a shield or hostage;
(3) facilitate the commission of a felony or the
flight after the attempt or commission of a felony;
(4) inflict bodily injury on him or violate or abuse
him sexually;

As I'm sure you know, LE could probably pull an indictment whatever day they choose. The GJ meets in secret, so we can't go and see, but no reason to think LE didn't convene one and start showing evidence back in Dec, and clearly they have way more than enough to get an indictment. All they gotta do is ask for one at some point of their choosing, rather than continuing the process. But I see no reason for them to be in any hurry.

What did LE find when they searched CM's home? I've only followed a few missing persons cases, but it seems it is customary to search the missing person's home to rule things out, find evidence - maybe.... and what not. TIA>

Frisson, are we sure they searched her home?? I don't ever remember hearing that? It would be very odd to me if they did not search her home.

If I ever go missing make sure the police do a thorough search of my house!!

Detective Stamm said that during the interview. Enrique Gutierrez Arochi said he went to the Shops of Legacy with a group of friends which included Christina Morris. At the end of the evening, he left his friend Paulina Petrosky’s apartment with Christina Morris and they walked back to where their cars were parked.

[from later]

Affiant Busby believes Christina Morris would have had to have been placed or forced into the trunk of Arochi’s vehicle without her consent by Enrique Gutierrez Arochi in order for her DNA to be present in that location. Affiant further believes based on the anger Arochi displayed at Petrosky’s apartment towards Sabrina Boss when she refused his sexual advances towards her that Enrique Gutierrez Arochi intended to violate or abuse Christina Morris sexually. Affiant believes Enrique Gutierrez Arochi was sexually frustrated that Boss rebuffed his sexual advances and an opportunity presented itself for him to act upon his anger and sexual frustration when he found himself alone with Christina Morris.

Not sure what your point is here[modsnip]. But points for confusing the issue.

Seems to me that the point is, EA left the apartment angry, with CM.. nothing confusing about that to me...

She lived with HF at the time this incident happened? That was a weird story, I remember it. Very heavy drug culture, I am so sorry she got drawn into it. I want to say thanks for your comments and for keeping us lively around here. It's all good. Nothing is set in stone yet! LE is doing a great job IMO.

Anybody could have put her in his trunk, maybe when he wasn't looking. Everybody lies, that's not a crime. Perhaps the drug cartel kingpin that orchestrated it is threatening to tell EAs parent about his crack addiction.

Maybe someone else put her in his trunk...
Well, there's a thought. :peace:

Defense could say that when they got to the garage, they were both attacked by a third party. EA got his marks and wounds from the attack at this point or later. Or EA was not attacked, just she was but he was threatened to not do anything as the person attacked her. The attacker put CM in the trunk and put EA either there or in the back seat (regarding eA see previous note). He didn't tell police this because one, who would believe him. Two, the person threatened his family and/or him. The third party drove away, as we have heard the video is grainy of the car driving out and they can't make out the driver.

The prosecution has to prove that EA put her IN the trunk. I can see the defense casting doubt or at least they should that someone else did do it. Considering MANY of us believe that someone else was involved, I believe a jury is also going to have some doubts.

Are you going with sex trafficking in this scenario? Honestly just curious. Why would that person make Christina bleed significant amounts and be put in the trunk? Then he beats up EA and tells him to keep his mouth shut? I'm confusing myself now. No snark intended.

Not sex trafficking - they wanted the purses.
