From Friday, April 1st 2022:

D’Lanny Chairez, who is accused of tampering with evidence in the death of her son, is still waiting for her trial to begin.

“If we're not going to be their voice then who is?" Gomez says.

We checked with the district court in charge of Chairez's case.

She’s scheduled for April 27th but Gomez believes it will more than likely get moved again.
Child advocates honor, remember 13 children who died from child abuse in 2021

I can't find her on the Bexar county court site. Does she use a different name? I also tried entering variations on her first name.

Plea Deal
In a hearing on Thursday, prosecutors waived one count of tampering with evidence in exchange for D’Lanny Chairez pleading no contest on the second count of tampering with evidence.

D’Lanny Chairez will be sentenced in August, following a pre-sentencing investigation ordered by 144th District Court Judge Michael Mery. She could face additional criminal charges as the investigation into baby James’ death continues.

More at the link. Possible sentence of 10 years. Her lawyer says bringing homicide charges would be difficult. Hopefully the prosecutor disagrees.

It looks like the article has been updated. Now it says:

Just before D’Lanny Chairez was sentenced, Bexar County District Attorney Joe Gonzales announced that a grand jury Monday indicted her on a new charge.

She is now charged with injury to a child-intentionally or knowingly causing serious bodily injury to a child. D’Lanny Chairez could get up to life in prison if she is convicted on that charge.

So only one new charge, nothing about omission or about a deadly weapon. But at least that one charge still carries the possibility of a lengthy prison sentence.

Is the consensus on here that Mom harmed him on purpose because she was "tired of being a Mom"? Or do you think it was an accident? Will we ever know what she did and why?

It's possible D'Lanny Chairez could face an extended prison sentence, after a Bexar County grand jury on Monday returned a multicount indictment on charges that she caused her child's death. According to District Attorney Joe Gonzales, the indictment was for injury to a child-intentionally or knowingly causing serious bodily injury to a child.

The indictment alleges that on April 28, 2021, Chairez intentionally or knowingly caused serious bodily injury to her baby, a child who was 14 years of age or younger, by manner and means unknown to the grand jury.

Gonzales said the charges amount to a first-degree felony, punishable by five to 99 years or life in prison, along with a possible fine of up to $10,000.

"We have every intention of moving forward and seeking justice for Baby James," the district attorney added.

Two years after 18-month-old James Chairez disappeared and his mother was arrested for his death, family members are still seeking justice.

[...]

D’Lanny Chairez was arrested and charged with tampering with evidence. She took a plea deal on that charge and was sentenced to five years in prison. On the day of sentencing, more than a year after James was found, D’Lanny Chairez was also charged with injury to a child. She has yet to go to trial on that charge.

Recently, her attorney filed a reduction-of-bond motion in her case. Benavidez is not happy with that filing.

“I hope she never gets out,” Benavidez said. “She needs to suffer the consequences of this.”

D’Lanny Chairez’s next court date is scheduled for March 20 and the bond reduction motion could be considered.

Precious James!

From your link:

In January 2021, Benavidez notified San Antonio Police Department that she couldn’t find her niece D’Lanny Chairez or D’Lanny’s son James.

A search for the two began in February and while D’Lanny Chairez was found safe, baby James was not. <>

In April 2021, his remains were located underneath the trailer where he lived with his mom.

On the day of sentencing, more than a year after James was found, D’Lanny Chairez was also charged with injury to a child. <>

Chairez is facing charges of tampering with evidence in connection with the death of her son.

The rescheduled trial date has not yet been announced.

The DA’s Office also told Benavidez that a plea deal could be offered, but it is something she doesn’t want.

“His story needs to be heard for the simple fact that we’re losing too many children in the world right now, and because they take plea deals they aren’t being heard fully,” Benavidez said. “I also want her to be reminded that this was wrong. Put some hurt in her heart, the way I hurt for him. He did not deserve this, and if we take a plea, that’s like saying James’ life didn’t really matter.

In a response to KSAT, the district attorney’s office said in part, “we maintain regular communication with the relative in this case, including providing notice of the August, October and November court dates.”

Benavidez told KSAT 12 she has kept a log and record of all communications and the response is inaccurate.

Meanwhile, court documents indicate that Chairez is requesting a new attorney and a new court date has not been scheduled.
