That the police are looking towards the water treatment plant that is connected to the sink hole... I believe they are searching for Human Remains.

Toddler didn't meet Amber Alert criteria

The Irving Police Department could face an informal reprimand for issuing an Amber Alert for 2-year-old Elian Majano, who disappeared from a park more than a week ago and is still missing.

Several criteria must be met before authorities issue an Amber Alert:

Confirmation that an abduction has taken place.

Child is at risk of serious injury or death.

Child is 17 years old or younger.

There is a description of the child, such as height, weight, hair color and clothing.

There is a description of the captor or captor's vehicle.*

I think someone should change the requirements for Amber Alert. ANY CHILD who goes missing should get Amber Alert treatment, IMO.

Just a quick update, still no sign of little Elian. The mother and the officials are disagreeing in the amount of time he went unsupervised while she is trying to regain custody of her other son. The boy's father does not express concern over her parenting skills.

From what I understand so far, the childs' father ( Gilberto Bercian) who has lived with her for 6 years is NOT the boyfriend (Alvaro Martinez) she was at the park with. 2 different men, right? So...if she was living with one man but at the park with another, could she perhaps have let the kids out so she could have some time alone? Looking at the map of the park, the child would have had to cross over or by the sinkhole on the way to the playground or hiking trail. The other way is a residential area. She must have been preoccupied for a small child like that to get so far.....

I truly hope the child is OK but I have this gut instinct....

I don't understand this thing about the sinkhole. If this is a deep hole caused by a broken pipe why in the world haven't the park people had workers out there digging around that hole? If it is possible for a little child to fall into one of these holes they can't just leave it like it is and it would seem to me that the broken pipe has to replaced. Why haven't they done anything with that sinkhole? That is just crazy if there is any possibility that the little guy fell in there. They are still talking about the possibility that he was kidnapped yet they haven't gone into that sinkhole to see if he is down there. It just doesn't make any sense at all.

My neice's car fell into to a "pothole" which I know is different but the city took full responsibility and totalled her car without a question asked.

Not quite the same but if this baby fell into a sinkhole the city should pay. Maybe that is why CPS is sooo quick to step in. Lots of people have affairs, lots of people watch their kids at the park from their vehicle. I don't think Alexis should have been taken away unless there are obvious reasons.

I'm thinking the same thing. They don't know how long the boys were out of the mother's sight. From what I understand the sinkhole wasn't far from the car. The park is responsible if some pipes burst and caused a hole big enough for a little guy to fall into. I want to know if they have done anything with that sinkhole. I swear, if that were my baby and it was said that he could have fallen into a big hole someone from the parks would either be digging around that hole or I'd get a bunch of people and shovels and we would dig down to the bottom of that hole. The mom doesn't even speak english and she probably doesn't have a clue what to do. On top of that she now has to fight with CPS over her 4 year old.

I just sent a email to Star Telegram.com to see if that paper has any news about this little guy and I asked about the sinkhole and what has been done with that. I hope they answer. I'll post it if they do.

Thank you so much for posting this news. I'm so glad that they are looking in that sewer system for the little boy. I can't stand the thought of him falling into that and dying in there. It's just horrible. If the 4 yr old said that his little brother fell in that hole then he must have. I just hope that they find his little body. Regardless of the length of time the mother wasn't watching it is something that she will have to live with forever. I wouldn't want to be in her shoes. I don't know that I could stand it.

Sounds like his brother saw the happening. This would be another
worst nightmare for parents.

Surely Elian would be contained in the sewer line and plant if he fell in and drowned. Hopefully there is no way that he could have been washed out into the Trinity River. I don't think it should even matter whether the mother can speak english or not. She was changing her story around and could have hurt the child for all CPS or Le knows.

If this sink hole was wet, especially beneath the ground level could it be possible that he fell down and was stuck and possibly sucked into the earth surrounding the sewer lines-so he may still be there, not visible beneath mud and debris? I've stepped into small sink holes after winter thaw and had my foot sucked down and stuck to where I had to dig my own foot out.

That's what I was just wondering. Maybe Elian is stuck somewhere up in mud due to another burst in a pipe along the route of the sewer line.

I posted earlier about the same thing. They keep focus on the sewer pipes and have not publicly said anything about clearing the area around the sink hole. I wish someone who lived near the park could tell us if they have worked on the sink hole itself.

I believe the 4 yr old. There isn't any reason when he was with the cop that he would be close to that sinkhole and point to it and say his baby brother fell. I would also like to know if they have looked in the mud. Have the done any digging at the sinkhole? He is down there somewhere. I wish I lived around there. This would drive me crazy and I would be asking questions.

I'm not going to blame the mother. She may not be changing her story but just trying to explain in her language what happened. I live next door to a spanish/mexican family and I have a hard time understanding the parents. I have to have them clarify a lot of the time because different words mean different things to each of us. The mom might have let the boys get out of the vehicle while she tied her shoes. She may have been trying to explain that she didn't get out of the vehicle at the same time the boys did and it was taken that her and the guy sat in the vehicle and let the boys roam while in reality she didn't get out right away because she was putting her shoes on. If that baby fell in the sinkhole he could have been out of the vehicle for only seconds. Little kids are so fast. Even the dogs went to the sinkhole didn't they? I hate to think of that little guy getting sucked down into mud and dying there. What a horrible thing to have happen.

Yancy Majano once spent her days watching her two young sons. Now she can't bear to be alone in her apartment.

It's been one month since 2-year-old Elian Majano went missing while playing in Irving's Lively Park with his brother. Four-year-old Alexis was taken into protective custody a day later.

Elian's disappearance remains a mystery. Police stopped receiving tips more than a week ago...

The couple has weekly visits with Alexis, who is in foster care. They are not permitted to ask about what happened that day in the park, Mr. Bercian said. CPS is still deciding whether to place him with a family friend...
