Yes, that too. I guess how they worded their plans for a meet up will decide whether those texts are included. I guess I assumed from the way it was worded that the meet-up plan included sexual overtones too. MOOIMO Sounded like there was some sexual banter going on in the texts and that is what will be excluded, not that she was planning to see him later.
But the prosecutor can't show that content - texting for a meet-up - because it is in reference to their relationship. That is my understanding anyway. If the jury were to see that she was texting about the meet-up then I agree it would be pretty damning. That is why I am saying a win for the defense if the prosecution must exclude those conversations.

So they did go to Guyger's apartment?State said his sister will be a witness to tell that he used pot & why. State also got in the fact that his apt smelled like pot- Ambers apt did NOT.

IDK if that helps the state. IDK why the smell would be relevant except to show that the defendant should have realized it was not her apartment if it had a strong marijuana odor and she does not use. Marijuana use does not justify murder.

Not to mention she is a police officer who is trained to act in stressful situations. I used to work overnight EMS call, and when those alarms went off, even from a dead sleep, you were on and functioning. Never would it cross your mind, "I am tired".I always knew that the 911 call sounded staged just by her language. She was coached and I knew it. It sounded so blah !!! And fake. What gave that away? She said “I am so tired” and not “I was so tired or I must have been so tired.” (As in that’s how I missed my apartment)
I can promise you, once you “think there is a burglar in your house” or “you shoot someone and then realize it’s not your place.” You aren’t tired anymore. You’re adrenaline has to be crazy high at that moment.

IIRC, the prosecutor said something like "presumably her apartment didn't smell of marijuana". Nothing to indicate if it did or not. moo
