They heard most of it just not his opinion. But, it will get in I have no doubt.

Do we know if they had a hearing to determine if he can offer his opinion? TIA

Oh wow.
I assumed the opposite.

Is there really an expert can tell whether the first shot hit him, or whether it was the second shot?

I can’t visualize any way they could tell, but then, I’m not an expert.

They have not produced any witnesses nor evidence so far that shows she intentionally went to his apartment and killed him.

That is their whole case, that she knowingly and intentionally went to his apartment to kill him.

No. That's indeed not their case at all. Not once did they state that in their opening.

I bet I know what she's going to say:

"I didn't see the red mat. I was focused on getting home after a long day. I had saved so many lives. Protected so many people from bad guys. I put my key in and it fit. But something was weird about it. The key didn't turn but the door was unlocked. And I smelled the devil's weed!! That put me on instant alert! I believed a burglar had possibly broken in! So I cautiously entered, not sure d he was there or not. When I opened the door I yelled: "Police! Show yourself!" It was sort of dim and but I suddenly saw a figure of a man. So I yelled, "Police! Freeze! Show me your hands!" But he ignored my direct and clear commands. Then he began rushing toward me in the dimness with his hand raised! I had no choice! I was in such fear for my life! So I shot him!!

When I discovered it wasn't my home I was horrified! I immediately called 911 and checked to see if he was alive. I checked for a pulse. Looked for the bullet hole. Tried to make sure his head was elevated. I prayed of course, that God would save him.

But he died. I will never be able to live with what I've done. My sadness for his family is endless. I'm sooooo sorry. It was a terrible accident. If he had only just obeyed my clear commands he would still be here today! But he was probably so stoned he couldn't think straight..."
Followed by sobbing that's so uncontrollable that they have to take a recess so the witness can compose herself. Wait for it.

Sounds about right!

I can see it now. ****

I guess we can expect a bunch of character witnesses also. Telling us what a kind and giving person she is, and how nice she is to waiters and such. And how absent minded she can be sometimes. She's a daydreamer. She's been like that since she was a little girl. Her parents will attest to that with lots of pictures of her as a little girl.

Angry that someone broke into her apartment?

Maybe angry in general and then yes. Angry that someone was in there. Having seen her social media comments i understand why some might think she fancied herself a tough guy who would kill anyone who she perceived as messing with her.

Don't forget the cardigan!

IMO, if that was the case, her 911 call would not have sounded like it did.

Why not? I kind of think realizing you made a huge mistake and killed someone in their own home would turn the anger to fear and dismay pretty quickly. Why would she have to stay angry at that point?

Why didn't the 911 operator ask her why she shot him?

They didn't have to. She explained. She thought she was in her apartment.

the analyst says "it was normal" to shoot someone sitting on a couch eating ice cream! I think not and I am a gun owner! putting a bullet into another being is the last line of defense. She should've gone back out the door and called for help.

Side note- earlier in the thread it was discussed about wearing the uniform home. My coworker's husband is LEO and I asked her if he dresses for work at home or at the station. She says in the 18 years they've been together, he has always gotten dressed at work. He puts everything into his work backpack to go to and from work.

But does he change before coming home?

As much as we can not fathom it, at that exact moment she thought she was going into her apartment and there was a burglar. She did not set out to kill him or murder him. That was her perception at the time of the shooting.

Cops don't fire warning shots.

I agree and listening to that 911 call changed my mind.

I will also say that watching the footage of the attempts made to save Botham’s life made me cry, and I’m a tough nut. This is a case I won’t soon forget, or his sweet face.

Amateur opinion and speculation
I cried too.

Have a name for that, "Jane Wayne syndrome"

Where did that come from? I heard that she had one on a couple of times, but never saw her wearing one. I tried to remember if it had gotten cooler here by then but couldn't remember.

Short video of Texas Ranger offering "reasonable" opinion and judge's ruling. For those who missed it yesterday.

:) Hello,

Several months ago, I read a statement analysis of AG's 9-1-1 call ... my first impression was that she was more concerned for herself and her job than the INNOCENT VICTIM she shot and killed!

I just found out 2 days ago that the Trial was underway in Dallas ... so I came here to Websleuths to get caught up!

I read some MSM articles about the Trial last night and today, so I was able to learn some of the facts. But I still have a LOT of questions because what AG did just does not make any sense, IMO.

So off to get caught up here ...

:)
