City of Dallas dismissed from wrongful death lawsuit in Botham Jean killing, federal judge rules

The city of Dallas has been dismissed from a wrongful death lawsuit submitted by the family of a man who was killed in his own home by an off-duty police officer, a federal judge has ruled.

The city filed a motion in November 2018 requesting to be dismissed from the lawsuit, citing Jean's family's attorneys' -- Lee Merritt, Ben Crump and Daryl Washington -- "failure to state a claim" against them, according to the online records. The civil case proceeded simultaneously with the criminal matter until the murder trial commenced in September 2019.

Federal court chief Judge Barbara Lynn ruled on Dec. 23 in favor of the city of Dallas and dismissed them from the lawsuit "with prejudice," according to the judge's decision.

The Jean family's legal team filed a notice of appeal on Friday, according to the documents obtained by ABC News.

"Amber Guyger was off duty at the time, but it has always been our argument that when she took Botham Jean's life, she was on duty," said Washington. "She testified that she responded to what she thought was a crime and whenever an officer says they respond to a crime, they are considered back on duty...the Supreme Court has ruled on this before."

Guyger remains the sole defendant on the lawsuit. She is currently housed in Mountain View Correctional Facility in Gatesville and will be eligible for parole in 2024, according to online records.

I'm just disgusted with the judge hugging her narcissist little self ....who TF does that !!! I have no doubt she really was scared for herself but SO WHAT stop shooting people! yes very hurlworthy!!!!

I think it was a motherly reaction, although I agree inappropriate.
The gesture from Botham's brother was amazing tho.

Any raw emotion she showed was for herself, not for "that guy" the victim.

( edited to add: Trial? .. evidently she has not changed! Interesting that this was filed in 2018 and they prob waited for the ruling on Dallas law enforcement suit decision to respond. )

I am not surprised. I still with the Jean family peace and continued healing. They will be put through this all again. Once again, Ms. Guyger will be trying to clear her name and escape responsibility. I don't believe, at this point, that she ever will.

I am glad the NFL featured the Jean family as part of their campaign.

But what does serving 10 years solve? She didn't do it deliberately. She did not set out to deliberately kill him. It was bad, it was a terrible mistake.
Why is 10 years in prison the final answer?

I do not believe she is any type of threat to the free world. Consequences yes, 10 years no. Now hang me.

Criticize me but have you even been in a State prison? For one day? I have been in 3 State prisons hundreds of times, actually too many to know, and it is not always the ultimate answer. No, it is not.

State prison in the terms of being a Corrections Officer then an ARUM in charge of a housing unit then an administrator for altogether 26 years. So I know what I am talking about. MDOC

Good question. I'll ask around what officers in the control center and some of the housing units think. But you are right. Consequences are appropriate and yes I get that 100%. 911 should have been called, no doubt. I never meant to minimize her involvement in any way. Not sure I should have even posted - too hard to explain what I have experienced as seen through other eyes. Prisoner eyes. Guess I'll keep it to myself. Maybe I'm not politically correct in 2020...:oops:

She had other options. She could have retreated and call officers to investigate. She could have wondered why her front doorway had a red mat that was not there before and checked the apartment number. But instead she chose to shoot blindly into a dim apartment.

Yes. Agree. Never meant to minimize her guilt. Only questioning the sentence which is really too complicated to mention. Wish I hadn't. You would have to work in corrections to get it. There just are so many other ways. Other than 10 years in State prison only. I don't agree with the hard time 10 years in State Prison. Period. One year in State prison is like 3 years. Nothing like you could ever imagine in your wildest dreams.

Sit in your bedroom for one week. Don't leave except maybe some time in your living room and yard for a few hours here or there. Have your partner bring your 3 meals to you. No choice in menu. Lights out at 9 10 or 11. Depending on facility. You would crack up in a week. You would be done. Now imagine 10 years.

What difference does it make if apartment #1378 and apartment #1478 had the same floor plan? It is not like she got inside Botham’s apartment and walked around and then saw “a stranger” sitting on “her” couch. She barely got inside the door before she murdered Botham Jean. I am wondering how Botham's brother feels about this issue.
