*Trial continues (Day 3) (State case) (@ 10am CT) – TX – James (Jamie) Williams Faith, Jr. (49) (Oct. 9, 2020, fatally shot while walking dog, Dallas) - *Darrin Ruben Lopez (48/now 51) (BF) arrested & charged (1/11/21) & indicted (2/5/21) with murder. Extradited from TN to TX January, 2021. $1M bond.
Trial set to begin on 7/21/23 with jury selection & trial to begin on 7/25/23.

State witnesses: Jason Schneider, a friend of James. Oak Cliff homeowner Emery Wilson. Dallas PD homicide detective Chris Walton. Several members of the Dallas PD. Text messages & other evidence led police to Jennifer Faith & Lopez. Some were shown in the courtroom on the first day of trial & explained by cell phone experts. An FBI special agent & ATF special agent.

7/26/23 Wednesday, Trial Day 2: State witnesses: A firearms expert. The jury spent a majority of the time hearing the content of emails between Jennifer & Lopez. Dallas PD Det. Eric Barnes. The Medical examiner.

Darrin has nothing to lose! Surprisingly to me -- his voice is strong and clear.

Also, IMO, the young girl, and man seated next to her in the gallery are Darrin's daughter and his brother.

Sorry, still find Prosecutor Mitchell beyond annoying today! The objections without stating the legal basis for the objection are becoming gross interruptions and seem to be trying the patience of the Judge. :mad:

Really strange testimony by DL.

He's telling the most ridiculous, nonsense, account but I truly believe he believes what he's saying, and that he had all the trust in the world in Jennifer. He couldn't imagine that this woman that he's been carrying a torch for over 30 yrs would ever lie to him!

No idea if jurors find him sympathetic but I'm concerned they might be turned off by Mitchell's hostility.

Knowing the defense doesn't have to prove anything, this case is missing a professional or expert on TBI and questioning why the defense is not going there. JMO

ETA: Also, it appears from testimony that DL has several supporters present in the courtroom.

Wow -- the Judge just suggested the defense call Jennifer Faith as a witness!

This ^^ coming after an objection by the defense that the State is misrepresenting to the Court what the defense is calling the affirmed Pleaded Statement by JL in federal court, for a Life Sentence. that she was responsible for all of the communication received by DK, and that she authored every email, text, phone call for the purpose of duping DL.

The defense is objecting to what appears the strategy of the Prosecution to paint DL as a liar and/or creator of imaginary 'soldiers' he was communicating with and this misrepresentation to the Court and jurors is a violation of DL's due process.

Having followed Jennifer's federal case (no trial), this is where I think some here are finding the Prosecution being disingenuous at trial here.

And putting my personal bias against the shooter aside, I have to agree with the defense because I think jurors would be upset to learn after the fact exactly what evidence the federal investigation and Court found against Jennifer (in regard to DL) that was withheld from them intentionally.

... Evidence that caused the Federal Judge to call the defendant EVIL and DISGUSTING at sentencing.

Of course, Mitchell vigorously objected to the defense's objection calling Jennifer's Plea Statement "hearsay," and the Court's position is Jennifer's sworn statement is not valid evidence in his Court, and stating the defense did not call her as a witness to say the same!

The objection was more or less left as a question about calling JL as a defense witness (who would be subject to perjury), before moving on to the next defense witness.

For clarification, I've nowhere seen the defense denying or attempting denial that DL was the shooter. DL took the stand and testified how many times and where he shot Jamie.

I also don't see Jennifer being used as an alibi for the defense of murder. However, I think when you have an individual diagnosed 100% social and functioning disabled due to TBI from combat deployment, I think Jennifer's actions are relevant. JMO

It's 5:30 pm and the court taking 10 minute recess and will return so the attorneys and the Court can continue working on the jury charges without the presence of the jurors. (Court started late today).

After more argument and the Court asking for the citation by the Prosecution--still fighting admission of Jennifer's confession statement, the defense withdrew the proffer by Jennifer.

Personally, I think calling Jennifer just to read her proffer would do the trick. However, I also see how calling Jennifer could backfire on the defense because I think her presence alone would be extremely detrimental to DL mentally, and more important, especially difficult on Jamie's family.

Seems the judge is hoping to wrap up on Friday.

What a mess this evil and disgusting woman caused! MOO

ETA: I think I have a copy of the subject proffer by Jennifer filed in federal Court records-- I'll look for it tonight.

Talking heads evaluated DL's body language, expression, etc., during his testimony on Thursday-- all agreeing that DL's forward position, arms spread, and resting on the desk is very indicative that he's being truthful in his testimony-- he believes what he's saying.

Also, pointed out his hands balled to his chest when describing how he shot Jamie is a sign of remorse, a stab/pain to the heart.

DL is going down but I think I'm seeing what the feds saw, and I don't want him to have the same sentence as Jennifer. JMO

Trial moved into the sentencing phase -- impact statements underway.

Jamie Faith was a good man who deserved much better than the likes of Jennifer!
