State rests case in Stobaugh trial

The beginning of the defense case was in question today because of an expected ice storm, and Judge Bruce McFarling told jurors that he had a prior obligation for Thursday and Friday, so it could be Monday — Valentine’s Day, the judge wryly pointed out — before the trial would resume.

The jury is deliberating his guilt or innocence, and earlier in the morning they heard the last efforts of each side to sway their decision.

Using circumstantial evidence and not providing evidence of a body is allowable to convict somebody under Texas law.

“The laws of Texas don’t reward someone just because he got rid of her body real good,” he said.

That is, there is no body, no murder weapon, no witnesses, and no blood or DNA evidence; there are no fibers or hairs or any type of forensic evidence establishing that a murder occurred or linking Charles to a murder; and there is no confession or directly incriminatory statement by Charles. Charles argues that the circumstantial evidence presented by the State at trial is insufficient to establish beyond a reasonable doubt that he acted with the requisite mens rea to commit the offense of murder.....”`

I hate to see convictions overturned, but after reading the appeals court opinion in this case, I don't see any other option. There's just not enough evidence to get past reasonable doubt.

Thanks for posting that Al. imo the court made the right decision. I wonder where she is and if her husband got away with the perfect crime. :seeya:
