The person in custody is not being called an "uncle"...they are calling him a "family member"!

I don't know why they won't just say his name. It's obvious based on that information - 1992, family member, hispanic male, on immigration hold. There is no doubt who it is once you search the jail records.

He is the only suspect, he has not yet been arrested for the homicide, he is being held on a retainer

He is the only suspect at this time. He has not been arrested for this crime. They are dotting their i's and crossing their t's. Taking their time since there's no way he will be getting out right now.

Once the arrest warrant is issued, they will release his name.

(But come on, everyone knows who it is.)

Once they prepare the affidavit for the arrest warrant and have made the arrest they will name him

They have a good idea of motive but won't be saying that right now. Waiting for autopsy results.

I am sure media will still release his name...right? I mean, it's pretty freaking clear who it is at this point.

LE says one more question and out of all the questions that could be asked, they ask what happens to the reward money. ugh. She was found in between two properties/one of which is where he lives

I felt like the main Sherriff talking really wanted to name him. He almost did but then looked to FBI agent for approval, who of course stepped in to stop him. It's obvious who it is, especially since they gave birth year and refused to call him an uncle.

It appears that the spouse of the male that is in custody, who was born in 1992, has taken down her FB. I no longer can find

Gotta be! LE never took their eyes off him. Sounds like LE did it right too. Waiting for search warrant even though they had property owner's permission to search! Poor Kayla! In that awful well for so many days!

I can't imagine if he didn't give a confession, why he would have offered them to search his property. Did he possibly claim she was put there by someone else ?

Relative of deceased Kayla Gomez-Orozco in custody


A relative of Kayla Gomez-Orozco is in custody at the Smith County Jail.

Gustavo Zavala-Garcia was booked into the Smith County Jail on an immigration hold on Nov. 6. Zavala-Garcia, 24, is married to a cousin of Kayla. He is said to have been the last person to see Kayla.

Court records show he has been previously charged with assault family violence. It is unknown whether additional charges will be filed.

This is just my opinion but the media down there seems to be pretty lax with how and what they report. They kept perpetuating the "uncle" thing and the questions during the presser were not what I would call hard hitting or insightful or even what the public wants to know. I have seen where there was a previous deportation because of an assault/physical harm but is now able to be in jail because of coming back illegally. If that is true...the politicos are going to have a field day with his illegal status

I'm glad texas takes such a tough stance with sentencing these crimes I understand from this link he will possibly be charged with Capital Murder as it is not known in Texas. They don't have first degree murder in Texas. It looks like he could face life without parole or even the death penalty. Does the fact it looks like he may be here illegally change anything about him being charged? I understand Texas isn't a sanctuary city.

In addition to the above criteria, in order for the charge to be capital murder, as opposed to just "murder' in Texas, one of the following must apply:

The defendant intentionally commits the murder in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat;

I did a little research earlier and since he's a non-citizen there will be additional coordination of agencies. I'm all for perfecting the case. That - and non-citizens are still eligible for the DP.
