I guess one of the reasons that the DA is looking at charges "is this is a marked standard of difference from the norm", a person died and several other people were injuried.

It is not something that can be said of as "oh well"....

I will say that when I was 17, I could see myself letting my 12 year old sister take a hand at driving...just to show how cool I was and that we were getting one over on our parents. Siblings conspire like this all the time. It's tragic that this ended in the death of their Mom. I bet both the kids are out of their minds with grief.
