HOUSTON — The district attorney's office has filed a new charge against Derion Vence.

Court records show he is now charged with injury to a child/ serious bodily injury in Maleah Davis' death. The new charge was filed Monday.

Vence is still charged with tampering with a corpse. A grand jury indicted him on this charge on July 25.

In the context of injury to a child Texas criminal cases, “serious bodily injury” means physical pain, illness, or any impairment of physical condition to the extent it creates a substantial risk of: death; serious permanent disfigurement; or. protracted loss or impairment of the function of any bodily member or organ.

I was wondering about that. The way I'm interpreting this, he could have caused say a head injury that led to her eventual death?

I'm also wondering if there's room for charges against BB under this or similar charge (i.e., by omission)?

District Attorney’s Office will be required to prove the following elements (essential parts) of Injury to a Child beyond a reasonable doubt.

The Texas Penal Code 22.04 for Injury to a Child lays out what must be proved.

Someone is guilty of Injury to a Child if the person:
  • intentionally acts or by omission;
  • knowingly acts or by omission;
  • recklessly acts or by omission; or
  • with criminal negligence acts
causes to a child
  • serious bodily injury;
  • serious mental deficiency, impairment, or injury; or
  • bodily injury.

Harris County prosecutors have charged the ex-fiance of Maleah Davis' mother with felony injury to a child in the death of the 4-year-old girl.

On the surface, DV's charges may not seem like much but I'm hoping there are enough aggravators to his charges to stack them for the greatest penalty.

There are enough aggravators, no doubt. The most agregious part is that DV intentionally and knowingly caused injury to Maleah. I hope DV gets charged with the death penalty.

There are enough aggravators, no doubt. The most agregious part is that DV intentionally and knowingly caused injury to Maleah. I hope DV gets charged with the death penalty.

Vence is expected to appear in court on the new charge on Wednesday. The charge of injury to a child/serious bodily injury cares a penalty of five to 99 years in prison. The previous charge -- tampering with a corpse, a second-degree felony -- carries a penalty of two to 20 years in prison.

He hit Maleah with his hand and also with a blunt object causing her to strike the floor. Then threw her body away. What a disgusting sickening coward.

Oh I agree. But right now? This makes me feel better. This case, above all of the ones I've followed, has absolutely enraged me.

She died later from the injuries is the way I read that charge? Odd.
