"LUBBOCK, Texas (KETK) – A Lubbock man who is charged with murdering an infant by stuffing her in a backpack has requested that he be let out of prison due to the coronavirus.

Trevor Rowe, 27, was arrested January 8 and charged with the capital murder of 11-month-old Marion Jester-Montoya. His bond was set at $2 million.

According to the petition, “The government’s interest in continued incarceration cannot be justified where incarceration itself exacerbates an ongoing and devastating public health crisis and brings a heightened risk of illness and death to people inside and outside the jail.”

Rowe also argued in his petition that he has yet to be indicted for the murder. In Texas, the district attorney’s office has 90 days to get a grand jury to hand down an indictment for a felony, a deadline that has passed in Rowe’s case.

The statute states that if the deadline passes, the person must be released on a personal bond....

...on April 10, a Texas judge issued a temporary restraining order blocking the executive order from taking effect. A hearing on the permanent status of the order is set for Friday, April 24."

I can’t even- what was he thinking??? That she’d be fine in the backpack?? Was this intentional?? Did he mean to harm her or did they not have childcare? He even went and got food with her in the freaking backpack?? I just can’t...

This sounds like Casey Anthony. Tape little Caylee's mouth so no one could hear her. Give her Benadryl to make sure she slept thru the night (which this guy did not, I assume), and make her comfortable in the trunk of the car for just a few hours. What could possibly go wrong?

So he "swaddles" the 10 month old and tried to make her comfortable in a sleeping bag -- um, wait a minute -- it was a backpack. He would come get her out in just a few hours. What could possibly go wrong?

Way back in the day (croppers) would take the bottom of their toung children's nightgown and put it under the leg of the bed while they went out to pick the crops. Women have used open dresser drawers as baby beds, years gone by, A zipped back pack? No way. This sounds like murder, the planned kind.

Agreed. If this is true (it's inconceivable to me, but I am not doubting your post in any way, please be sure) I hope this is on record and that it will be followed-up.

If that sweet little miracle was actually found with meth in her bloodstream, and no follow-up was done such that she was not removed from the home or it was not reported to law enforcement for a thorough investigation, it sounds like it is mighty close to criminal negligence. Just my own opinion.

Family of baby killed in backpack speaks out after accused killer wants out of jail

EM, Marion’s father, said she died before celebrating her first birthday.

“He needs to rot in jail for the rest of his life,” EM said. “Because he doesn’t deserve to be free.”

Marion’s grandmother, SM, said hearing the news that he wanted to get out reopened wounds that will never heal.

“He doesn’t deserve to get out because of COVID-19,” SM said. “COVID-19 isn’t half as bad as what he did to her.”
