But the prosecution doesn't have a clear motive for why Nelson would kill the boy. The lead Houston Police investigator, Sgt. Brian Harris, testified he was "extremely disappointed" that Nelson's statements never clarified that issue.

At one point, Nelson turned tearful when her defense attorney asked about her overhearing police describe how Foster's body was terribly burned and that neither of his parents wanted him.

On Monday, Nelson's attorney, Allen Tanner, asked a Houston judge to toss out the statements, saying his client was sick and exhausted after hours of interrogation. A prosecutor pointed out that when Nelson was ultimately examined they failed to find anything seriously wrong with her.

She was charged with capital murder. Did the DA state they would NOT be seeking the DP?

More likely teared up that Jonathan Foster's body was found as she hoped that his remain would never be found. She knew she was done for.
