My point is CW removed himself from the situation/argument, rather than staying & engaging in whatever NO chose to do. He walked away. Jmo
How do you know this?

Nichol's youngest daughter was shot in the head and neck. That tells me (a shooting range instructor for women's classes) that WHOEVER PULLED THE TRIGGER WAS AN INEXPERIENCED SHOOTER. This killer flinched at the sound of the pistol firing which caused the muzzle of the gun to drop. When the muzzle dropped, the bullet missed its intended target and struck the child in the neck not her head.

In the interest of having a civil conversation, I will admit to little knowledge of guns and shooting. I see your point. Since you have some experience, I would like to ask though is it not possible, especially if she was the last one shot, that she was fleeing, ducking, bending, covering her head? Or other possible scenarios you can thinkg of? And in that case would that explain the two shots? I am NOT asking you to agree nor to change your opinion of what you think, I would seriously like to know the possibilities... Or which possibilities would fit...

Do we know where any of them were actually found within distance and positions and such? Again, that is a serious question, I am not being facetious.

I am asking in the interest of keeping my mind open on all possible explanations.

The physicians at Bexar are board certified in forensic pathology. They supervise and train physician residents and medical students.
Bexar County Medical Examiner's Office and Toxicology Laboratory

The Bexar County Medical Examiner's Office offers a one month Forensic Pathology rotation for third and fourth year Pathology residents who have completed the required prerequisite training in autopsy pathology. The rotation is organized through the respective Pathology Residency Program.

During this required educational experience, pathology residents will be exposed to the basics of forensic pathology and gain experience with the medicolegal evaluation of sudden unexpected death. The resident will observe the practice of forensic pathology in the morgue as well as attend conferences and lectures.

Supervision and instruction is provided by board certified forensic pathologists at the Bexar County Medical Examiner's Office located on the UTHSCSA campus.

Pathology residents interested in rotating through the Bexar County Medical Examiner's Office should coordinate through their Residency Director.

Granny, I have seen all your posts. I get it. My mind is open. I am undecided at this point. I have seen posts both ways on this part of the discussion and points made both ways. I have nothing personal against your ME or any others. My mind remains open until the entire investigation is concluded, not just one part of it.

what gun battle? did I miss something? i have read of nothing more than an argument and not much is said about that.

He removed himself from what apparently was an ugly situation. He chose to not remain in his home. If he wanted to harm N or the kids, imo, he would have remained home. Moo

From msm.
We know that is his alibi and his version of what happened. We also know that it has not been verified nor corroborated and that there is an open investigation.

The question was regarding a gun battle? imo if there is any fact to that he should have been calling 911 as he left if anyone was brandishing a gun. I have seen nothing anywhere but for that remark hinting at such a thing. If there is anything to it, he should have been on the line to the authorities if she had it and if he had it, she should have been on the to them. He left so he clearly had such an option.

That being said, no offense intended, but gun battle is total conjecture is it not?

In Bexar morgue, the physician medical examiner isn't the only person who exams the body.

There are certified pathology technicians, pathologist lab assistants, physician residents, investigating interns, medical students, and morgue specialists that are there to assist and/or learn.

Fudging a forensic autopsy report would require the secrecy of many people. It didn't happen with Nichols' murder-suicide.

What would even be the reason they’d want to “fudge” an autopsy? Or three autopsies?
With students & interns assisting/learning, I would expect the procedure to be more stringent. Jmo

Maybe he did then left to demise a plan with the family he was allegedly staying the night with. JMO

We only know what has been released in news articles.

There are numerous scenarios that might have occurred, but in my experience the failed first execution attempt (shot in the neck) was because an inexperienced shooter missed her target. Most inexperienced shooters flinch when the gun fires or move their wrists in anticipation of the gun firing. I frequently see women who are trying to learn to shoot with their husband's thick Glock. If they learn not to flinch, they can still have poor accuracy because the grip is too thick for their small hands to hold tightly.

(Now awaiting my beat down by happy Glock owners. lol)

Thanks for your response. I am here to find things out, I like the sleuth part of the site--and discuss, and then make up my mind, if indeed I ever even do sometimes... :) As in every case, too bad we don't know a bit more, just even some basic knowledge...

You can handle the beat down by the Glock owners--you don't strike me as incapable of dishing it out... That IS a compliment...

I find it interesting both of her parents died at a young age. One at 43 and one at 33. I also found where NO mother had placed a restraining order on her father during their divorce.

But guns initially pop upward immediately after being fired. Flinching at the firing sound would have occurred after the bullet left the gun.
In my opinion, the bullet would have hit exactly where the gun had been aimed.

I lean to the neck injury resulting from a moving target, after the older sister was shot. If accurate, the fear and betrayal that little girl must have felt is unfathomable.

I find it interesting that both were born and died in December. I was dropped on my head as a small child and all of the math fell out. Otherwise, I'd be able to provide some probability equations to this coincidence.

Probability should be around 0.0048% IMO.
