Juror Selection to Begin for 'American Sniper' Murder Trial

Jury selection is scheduled to begin today in the trial of Eddie Ray Routh, the Marine veteran accused of shooting Navy SEAL Chris Kyle, the central character portrayed in the blockbuster movie “American Sniper.”

Kyle -- who’s widely recognized for having made the highest number of confirmed kills in American military history -- was fatally shot at a gun range in Texas in 2013. Another man, his friend Chad Littlefield, was also killed.

About 800 potential jurors have been summoned for possible selection in the trial, based upon the expectation that only about half will show up. From that jury pool, the judge and attorneys will select 12 jurors and two alternates.

Someone please help me out here. I do not understand why or how they would expect that only one half of the 800 potential jurors to actually show up. I thought that if you were summoned for jury duty you had to report for duty or face legal action.

There are several exemptions one can claim to be excused from jury duty but it still needs to be approved by the court. The list is different for federal court though. I can be exempt in my county due to children under the age of 12 but had to report to U.S. district court.

Reasons for exemptions here:
Sec. 62.106. EXEMPTION FROM JURY SERVICE. (a) A person qualified to serve as a petit juror may establish an exemption from jury service if the person:
(1) is over 70 years of age;
(2) has legal custody of a child younger than 12 years of age and the person's service on the jury requires leaving the child without adequate supervision;
(3) is a student of a public or private secondary school;
(4) is a person enrolled and in actual attendance at an institution of higher education;
(5) is an officer or an employee of the senate, the house of representatives, or any department, commission, board, office, or other agency in the legislative branch of state government;
(6) is summoned for service in a county with a population of at least 200,000, unless that county uses a jury plan under Section 62.011 and the period authorized under Section 62.011(b)(5) exceeds two years, and the person has served as a petit juror in the county during the 24-month period preceding the date the person is to appear for jury service;
(7) is the primary caretaker of a person who is an invalid unable to care for himself;
(8) except as provided by Subsection (b), is summoned for service in a county with a population of at least 250,000 and the person has served as a petit juror in the county during the three-year period preceding the date the person is to appear for jury service; or
(9) is a member of the United States military forces serving on active duty and deployed to a location away from the person's home station and out of the person's county of residence.

Erath Co. Texas has a population of around 38,000 I believe. It's very likely that a good number could be over the 70 year age. There is also a university there. I would think they would have to at least call the court to explain why they couldn't report. Many years ago I moved from Texas to Oklahoma for a couple of years. About 2 weeks after I had established residence in Oklahoma I received a jury summons from my prior Texas county. A phone # was included with the summons so I just called back to the Texas county & told them I was no longer a resident. I wouldn't have been comfortable just ignoring the summons.
 
The article makes it sound like people just won't show up... Exemptions are one thing but ignoring a jury duty summons is another.

The same thing applies to all their other crime reporting. IMO, the title in the link is misleading because it is strictly reporting. Please let me know if I will be able to use this link from time to time.

This is an interesting read about why some of the potential jurors were disqualified. Some of those freely admitted that they had already formed an opinion. 3 Tarleton University journalism students reported that a British reporter was attempting to interview a person who was still in the jury pool & the reporter has been ordered to report to the judge. There is a gag order in place for all involved in the trial. The only exception is that prospective jurors already disqualified may speak to the media.

It appears that people are wanting to do the right thing & Routh will be able to get a fair trial. JMO
