Indeed, the intoxication was voluntary and he knew very well what he did, even though this doctor says he's not reliable.

But, IMHO, they are trying to save his life.

From what I read about BD, he was out to shoot someone that night. To me, he seemed to take his time stumbling around in the Wal-Mart aisle, like he wanted to be challenged. I apologize, I've tried to catch up, but has his roommate Dante testified?

According to this article (if accurate) it appears BD loved challenging the police, dating back to Colorado.

Well, what should be done and what is actually done is not always the same.

Defense attorneys like to tell their experts not to write reports, so they don't have to turn it over to the state.

If the defense knows this witness's testimony will be involved and that notes will be part of it IMO it is unethical not to turn them over to the other side. I would think the attorney withholding reports/notes would be reprimanded by the court and if behavior continued sanctioned and or fined?

Yes, guess he is lucky the judge stayed in the courtroom during the break, so he would have someone to chit chat with.

He seemed to be the last one BD saw or spoke with regarding the Wal-Mart trip. According to Dante, BD was looking for trouble. He certainly didn't need to shoplift, from the looks of things.
