SAN ANTONIO — A horrific case of child abuse involving a woman who was already on Child Protective Service's radar. The woman is accused of starving her six-year-old daughter to death.
Among those outraged is State Representative Elizabeth Campos.
“I'm working hard right now in the interim, trying to figure out, you know, what legislation that I can pass this coming session to protect our children,” State Rep. Campos, (D) San Antonio said.
The child is Samantha Jimenez. Her mother 38-year-old Stephanie Jimenez is behind bars accused of starving Samantha to death.
In October 2021 Stephanie called 911 and said her daughter was vomiting after hitting her head.
Officers said she was 'small and thin for her age' and suffering from dehydration, kidney infection, pneumonia, lice and COVID-19.
“This was a very horrific case, my best guess, based on my former experience, as an investigator, and as somebody that's been working in this industry for over two decades, is that somebody knew about this,” Carrie Wilcoxson a child abuse prevention advocate said.
“If this child had been abused for some time and I don't understand how it wasn't reported. I mean, she had to have gone to the doctor, possibly, I mean, even going to the grocery store, like somebody had to have seen her,” State Rep. Campos said.
Stephanie is still serving a 10-year probation from a child abuse case that happened in 2012.
So, we asked CPS why a case worker wasn't assigned to Stephanie and were told "case workers aren't assigned to families unless there are allegations of abuse or neglect."
A CPS Spokesperson said "no allegations were made between the 2012 case to October 2021 when Samantha died."
We asked the Bexar County District Attorney's Office why Stephanie was just arrested this week when her daughter died in October 2021. They said they can't comment as this case is pending

An arrest affidavit in the case said 38-year-old Stephanie Jimenez told investigators her daughter was injured in a fall, but the medical examiner said the child's condition was much more dire.
The affidavit details how the child was small and thin for her age and that she was also suffering from kidney failure, pneumonia and COVID. The report says she was also infested with head lice and it was obvious that she hadn't been kept clean.
The Medical Examiner ruled Samantha died from neglect and malnutrition.
The report points out the other children in the home and the mother all appeared to be in good health, and that the mother told investigators Samantha had not received any medical care for one to two years.

On Tuesday, July 26, a San Antonio police report obtained by KSAT said an arrest warrant was issued for Jimenez. Jimenez was arrested and charged with injury to child — serious bodily injury by omission, records show. She was reportedly booked into Bexar County Jail on $200,000 bond.
