Utah County Attorney plans to file formal charges against Tyler Robinson on Tuesday

The Utah County Attorney, Jeff Gray, plans to file formal charges against Tyler Robinson on Tuesday, his office tells the Guardian.

Gray’s office “is carefully reviewing all the evidence in this case to determine the appropriate charges to file”, his chief of staff said.

Gray plans to describe the charges at a news conference at noon local time on Tuesday.

If charges are filed on Tuesday, Robinson’s first appearance would be a virtual hearing at 3pm Mountain time that day.

Please remember we are not here to argue Charlie Kirk's beliefs. We are only discussing the upcoming trial and the evidence for or against Tyler Robinson.

Here is the link to the last discussion thread.

OREM, Utah — Below is a list of Tyler Robinson items seized, according to search warrant returns and as written in those documents, unless otherwise noted.

Documents show Utah law enforcement also served warrants on Apple, Google, and Discord seeking access to various messaging accounts or electronic devices belonging to Robinson.

Preliminary hearing dates in question

Prior to discussion on the motion to exclude cameras, the court heard arguments on another defense motion to delay Robinson’s preliminary hearing, currently set for the week of May 18.

Richard Novak told the court Robinson’s attorneys have not received complete discovery from the prosecution – namely a DNA analysis report – so they can’t mount an adequate defense for the preliminary hearing.
(…)
Prosecutor Ryan McBride refuted the claims, arguing the preliminary hearing is limited in scope. Its purpose is only to establish probable cause in the case, he said, contending the defense was trying to attach Robinson’s late-stage trial rights to an early-stage hearing.

The preliminary hearing scheduled for May is for prosecutors to show they have enough evidence to proceed to trial. Authorities have said DNA consistent with Robinson's was found on the trigger of the rifle, the fired cartridge casing, two unfired cartridges and a towel used to wrap the rifle.

But the defense argued Friday it cannot move forward with the hearing until law enforcement agencies turn over more details about their DNA analysis of evidence.

Prosecutors responded that they have sufficient proof beyond DNA to tie Robinson to Kirk's killing. That includes surveillance video of Robinson near the university from the morning of the shooting wearing the same clothes as when he turned himself in. Robinson left a handwritten note for his romantic partner confessing to the crime before it happened, and also confessed to friends on the chatroom platform Discord, prosecutors said.

Rescheduling the preliminary hearing could delay the proceedings six months, Deputy Utah County Attorney Ryan McBride said.

"...The report reveals that one bullet jacket fragment that was recovered from Kirk's autopsy matched a .30 caliber class bullet. Four other lead bullet fragments were also recovered.

'The ATF lab described the item as a ".30-caliber class deformed/damaged bullet jacket fragment,"' the filing reveals, citing evidence included in the report after the FBI lab conducted analysis of the bullet jacket fragment.

That matches the same caliber as the Mauser 98 30-06 rifle recovered near the scene, that prosecutors claim was allegedly used by Robinson to kill Kirk. Robinson received the gun as a gift from his grandfather, authorities said. ..."

Tyler Robinson deserves a fair trial and a vigorous defense, as would we all.

Have to say it's not looking very good for TR at this time ?
The handwritten notes and the confessions via discord friends makes it seem that LE have the right man in custody.

I have to say that I'm rather surprised by the thrust of these articles so far. Surely Robinson's defence aren't going to argue that their client didn't do it. It's all on video! I rather imagined that the trial would revolve around the question of whether Robinson was guilty of murder or guilty of aggravated murder under the laws of the State of Utah, given that with one verdict Tyler Robinson lives, and with the other he probably doesn't.

This Brian Entin interview discusses the value of cameras being allowed in the court room as it pertains to conspiracy theories about this case.

The lawyer that BE interviews explains that the trial will likely not take place for years.

While watching the latest court proceeding my take-away thought was, it makes far more sense to allow live streaming from the court, so that the public has a first hand account of what was said, wasn't said, what evidence is presented, and isn't presented, etc. Of course "content creators" can spin it all they like, and they will any way.

But if the public is already informed because they watched it & heard it themselves, those content creators will have a much harder time creating any traction with the wild theories.
