I keep finding angry British lawyers on Twitter.

They refer to the rules surrounding an European Arrest Warrant, and claim that these do not apply in the case of Ashya's parents.

Tweets along the lines of:

Can someone explain how a European arrest warrant can be issued when no offence has been committed?” < It can't (legally).

Keeping his family away from him has got to be the worst case of 'child cruelty' imaginable :banghead:

It's a shame these 'authorities' can't seem to put this much effort into helping the thousands of kids who are truly being abused.
I'd think the Police have better things to do with their time & (lack of) resources!


ETA ~ I'm not criticising the Police at all here, they're just doing their job.
I meant they probably don't want to be involved in this debacle at all.

Dr Jiri Kubes, a proton therapist in Prague, said cancer clinics in the Czech Republic could treat Ashya "within a few days" if they received a request from his doctors in the UK. He told Sky News: "

"If we received a request from his paediatric oncologist, we can arrange everything within a few days."

Janice Atkinson, UKIP South East MEP, said: "This little boy needs his mother at this time. He is five years old, probably doesn't speak Spanish, and will be lying in a hospital bed in distress.

"I call on the Home Secretary to contact the Spanish authorities so that Ashya's parents are released immediately."

This whole debacle has made me heartsick. I agree with everything that LittleJedi has posted. Extreme cruelty towards the family masquerading as "care". I cannot stop thinking about that dear little boy, sick, alone and terminally ill while his caring parents are handcuffed and criminalised. Things are all wrong in this society of ours

From the above link, the judge has ruled the parents to be held in custody in Spain for 72hrs max.
Ashya's eldest brother will be allowed to visit Ashya in hospital later today.

PTC can treat Ashya immediately if eligible for proton therapy. The costs can be dealt with later.

Proton Therapy Center Czech is the most advanced proton therapy center in Europe as recognised by international specialists. So far, the center has been treating patients from 22 countries. “The center is ready to accept Ashya King immediately if the specialists receive proper medical documentation from the UK doctors,” says Dr Jiri Kubes, the Head of proton therapy. “If Ashya is indicated for proton therapy, the center is keen on starting the treatment in a few days. The costs would be dealt with later on,” says Mrs Iva Tatounova, Director of Strategy at PTC Czech.

The center cooperates fully with paediatric oncologists in the UK and consult with them concerning treatment. The oncologists here at the proton center need all the necessary medical documentation before they can agree on appropriateness of treatment for patients. PTC informed Mr King about possible treatment for Ashya after having received the necessary medical documentation. PTC has not received this documentation until now, so no specific statement can be made. In general, proton therapy is recommended for meduloblastoma. This indication is treated at all proton centers and also recommended by the ASTRO - American Society for Radiation Oncology.

The parents are fighting extradition back to the UK, so they've been returned to jail. Ashya's being kept in a guarded, private room and it doesn't look like parents will be able to see him - but his 22-year-old brother will be allowed in today.

I didn't know there was a 'child' that old when reports said the other 6 kids had been left 'alone' in a hostel. The plan of the parents was apparently to sell their Marbella home to fund the cost of the treatment in the Czech Republic. Which is less than a quarter of the cost of the same treatment in the US.

Thing is though, the housing market in Spain is in dire straights at the moment. It takes at least months to sell homes, if not years. So I still do not understand why Ashya's parents didn't take care of raising the money first, before taking him abroad and away from a country where treatment is free. It's not in Spain. Surely they could have arranged a mortgage on the Spanish property from the UK, then just flown straight to the Czech Republic?

Petitions on change.org calling for the release of the Kings so they can get medical treatment for Ashya have now totalled nearly 20,000 signatures.

It comes after Portsmouth City Council revealed on Monday that the little boy was made a temporary ward of court on Friday.

Julian Wooster, the council's director for children's services, said: "At the request of Southampton hospital the council obtained a temporary Wardship Order on Friday, only to direct that Ashya King be presented for medical treatment.

"The order will be reviewed by the High Court on Wednesday. We understand this is an extremely difficult time for Ashya and his family."

As if the hospital in Southampton is the only place on earth where Ashya might be presented for medical treatment.
The baby-snatching British style has begun .... Ashya's parents are losing the rights over their child .... if this is not stopped I fear he will die in foster care.
No 5 year old kid should be forced to undergo chemotherapy without his loving parents and family at his side!

Judge Ismeal Moreno ordered that the couple be held in custody for up to 72 hours while he studied medical reports and documents from the couple’s defence lawyer.

If the court orders their extradition, the couple can appeal against the ruling, leading to the prospect of a lengthy legal battle.

Ashya’s parents took him from Southampton General hospital on Thursday and travelled with him on a ferry to France along with his six siblings. They were arrested at a hotel in Velez-Malaga on Saturday night on suspicion of “neglect”.

A court source said: “The judge has decided they should be detained in prison for a maximum period of 72 hours. In the meantime he has asked for urgent medical reports from the hospital where the child is being looked after and a translation of documents which the defence lawyer has provided. On the basis of those reports and documents he will decide whether to approve the extradition or not.

“The couple were asked if they wanted to be extradited and said they didn’t.”

I wasn't aware that the language barrier played such a big role, but that's me ... on Spanish websites many are still convinced that the faith of the parents has something to do with this, because that is what the media are reporting :-(

Anyway, I had a twitter-conversation with a British lawyer and he suspects that the EAW will not stand...
BUT the Family Court is a separate legal issue and that may be far more problematic for the parents in the long run.

Portsmouth City Council revealed today that on Friday - 24 hours after he vanished - they made a High Court application for judges to be made temporary guardians for Ashya because the boy was in 'serious danger'.
Southampton General Hospital had said the battery in Ashya’s tube feeding unit was due to run down and his life was ‘in grave danger'.
The court order meant that as soon as he was found he would have to be taken to the nearest hospital and any decision to move him will have to be agreed by the High Court in London first.

The High Court in London will decide on Wednesday on the case of Ashya.
The lawyer that I contacted on twitter explained that Ashya was made ward of the court by an intervention of the Family Court but that those orders usually are not made public and the public won't be aware of those.

HOSPITAL DIRECTOR MAKES STATEMENT

A doctor and medical director at University Hospital Southampton NHS Foundation Trust has said that critically ill Ashya King has a "70-80% chance of survival".

Dr Marsh said that the hospital trust "regretted" that the communication and relationship with the King family had "broken down" and for "whatever reason they have lost confidence in us".

Hampshire Constabulary obtained a European arrest warrant on the grounds the Kings neglected their son, who was receiving specialist care for his condition when he was taken from the UK.

A Crown Prosecution Service (CPS) spokesperson said there was not yet sufficient evidence to charge the parents with an offence, but added that a decision on whether to prosecute will be made once further evidence is examined.

The five-year-old, from Portsmouth, was made a ward of court at the request of Southampton General Hospital.

Julian Wooster, Portsmouth City Council's director for children's services, said: "At the request of Southampton Hospital the council obtained a temporary wardship order on Friday, only to direct that Ashya King be presented for medical treatment."

The order will be reviewed on Wednesday.

The BBC's legal affairs correspondent Clive Coleman said it means any major decision on Ashya will need to be approved by the court.

It also means the local authority takes on parental responsibilities and could seek his return to the UK when he is fit enough.

"For whatever reason"? I think they need to grab that doc by the collar who threatened to get an injunction against the parents and keep them out of the hospital.

Ashya's dad makes a very compelling case in the video. He's not a whacko, he's a very concerned and intelligent Dad. Hospital staff, wake up and smell the coffee. And then apologize and quit threatening parents of ill children.

Maybe if they didn't threaten to take their son, there wouldn't have been a "breakdown in communication." Such modsnips.

The way this whole situation has been handled is rediculous, since when is it a crime to question medical procedures, and ask for alternatives? Ashya is their son, when he was in uk hospital, he wasn't under any care orders acting with parental rights!

The family appear very clued up on Ashya's condition and available treatment. All they were doing was going for a different treatment, that may have been better for Ashya long term.

Now the parents are in custody in Spain, poor Ashya was surrounded by strangers, until the judge today decided his brother could visit him. I should think so too!

And now, children's services have stepped in and took over parental rights, any decisions regarding Ashya need to go befor a judge!

My thoughts are with the family xx

This story has a more complete quote from the medical director at the hospital.

“We have discussed proton beam radiotherapy with Ashya’s family and there are some tumours that respond well to this type of treatment, but there are some cases where there isn’t the evidence that this is a beneficial treatment. Where the evidence supports this treatment we have made a referral and patients have been treated abroad.”

BBM It sounded from what Mr. King said that the doctor indicated that medulloblastomas could not be helped by proton beam. This isn't true. It may be that Ashya's particular tumor isn't likely to be helped for some reason, but obviously Mr. King did not understand or believe that. Proton beam has fewer side effects, so most parents would want to try that first, especially if they are willing to pay for it out of pocket. JMO

Dr Marsh added: “As events have unfolded we recognise that this must be a very distressing situation for the family. In situations where children who might be very young are suffering from life-threatening illnesses it is vital that a relationship is maintained between the family and medical staff so that treatment options can be openly discussed and agreed.

BBM I hope the medical director is investigating exactly how the communication broke down and who shut down discussion of treatment options. IMO if the professionals had been patient and compassionate in the face of the parents' distress, this might have been avoided. What a mess!
