Legal steps to protect five-year-old boy with brain cancer have ended up separating him from his family


Anthony Barnfather, partner at Slater & Gordon, who has extensive experience in dealing with European arrest warrants, said
there would be very little leeway for the Spanish court to refuse the extradition. He said the English police should travel to Spain to interview the parents and subsequently drop the charges, if satisfied that the Kings were simply attempting to get Ashya proton beam treatment and had taken necessary precautions with respect to his health.

"The irony in this case if you're looking at harm to the child, isn't it a little cruel keeping parents away from the child?" he said.

Trevor Tayleur, associate professor at the University of Law, said that the parents wishes would be considered by the high court in exercising its wardship but that the Kings might not be able to have representation at Tuesday's review hearing, given that they are behind bars in Spain. He suggested that their incarceration could also present a further obstacle to the wardship being lifted. "If they [the parents] are unable to take an important decision about the child's welfare because they are in prison then that could have an impact," he said.

Since Hampshire Police has not withdrawn the EAW yet, we must assume that what is happening now and will happen next, is wanted by the British officialdom. :-(

I’m working on getting my constituents, Brett and Naghemeh King, released from jail and reunited with their sick child.

The Spanish judicial authorities, with whom I have been in touch, have no discretion, because the Kings were subject to a European Arrest Warrant. The EAW allows no scope for flexibility, for common sense or for humanity. A document that, we were told, would be used against terrorists is now being used in the most Draconian way imaginable. I can’t imagine why, having opted out of the EAW, Theresa May chose to opt back into it – but that’s an argument for another day.

The immediate priority is for the UK authorities to withdraw the warrant. The heavy-handed way in which this case has been handled reflects badly on all concerned: the hospital, the police, the CPS and, for what it’s worth, Hampshire’s Police and Crime Commissioner, whose initial reaction was, as usual, to back the bureaucracy. We have seen British officialdom at its worst: authoritarian, self-righteous and blundering. A five-year-old child is paying the price.

The government has contacted police and health officials to see whether Ashya King, the five-year-old cancer patient currently in hospital alone in Spain, can be reunited with his mother and father, as Theresa May told the Commons attempts to extradite the parents to Britain were being reviewed.

The new interventions follow a mounting chorus of voices calling for Brett and Naghmeh King, currently held in separate Spanish prisons after removing their son from a Southampton hospital without doctors' consent to seek alternative treatment abroad for his brain tumour, to be brought to Málaga, where Ashya is being cared for at a children's hospital without his family.

David Cameron's spokesman said the Home Office had been in touch with Hampshire police force over the case, while the Department of Health contacted Southampton hospital. The hospital first raised the alarm on Thursday after Ashya was taken away by his parents.

Good News! Arrest warrant withdrawn

The parents of Ashya King will face no further action and should be reunited with their son, say prosecutors.

The Crown Prosecution Service has withdrawn a European arrest warrant enabling Spanish police to detain Brett and Naghemeh King.

Prime Minister David Cameron welcomed the moves to reunite the family.

A CPS spokesman said it had "urgently reviewed the case" and found "insufficient evidence for a realistic prospect of conviction for any criminal offence".

"We have therefore decided to stop the criminal proceedings," he added.

In a tweet, Mr Cameron said: "I welcome the prosecution against #AshyaKing's parents being dropped.

"It's important this little boy gets treatment & the love of his family."

"We are now in the process of communicating this decision to the Spanish authorities so that they can be reunited with their son as soon as possible," the CPS said.

Health Secretary Jeremy Hunt has described as "very unfortunate" the taking of five-year-old Ashya's parents into custody.

"There've clearly been misunderstandings along the way, but right now we want to focus on getting the right treatment for Ashya," he said.

"I hope we have a good resolution in place where they can get good independent advice that they trust."

Mr Hunt said a cancer specialist was being sent to Spain to offer advice on Ashya's case.

The parents of Ashya King have been released from prison and are expected to be reunited with their desperately ill son on Tuesday night, the couple's lawyer has said.

Brett and Naghmeh King were released from separate wings of a Spanish jail hours after prosecutors in London terminated a European arrest warrant and said the couple would face no charges.

The dramatic development meant the couple were free to leave Soto del Real prison near Madrid and make the five-hour journey to be reunited with Ashya, who is receiving urgent medical care for a brain tumour at a children's hospital in Málaga.

Evidence showed the parents had taken steps to safeguard Ashya's health and two independent medical experts had indicated the risk to Ashya's life "was not as great as had been originally thought", the CPS said in a statement.

Southampton magistrates court – where proceedings had been lodged – has now dropped them and discharged the case. Soon after a judge in Spain fast-tracked approval for their release. A source at Spain's Audiencia Nacional – the country's central criminal court – said they had been "working at top speed to make sure the Kings do not have to spend another night in prison".

It's great news but I want to see someone pay for this! These poor people had to suffer tremendously and so did their tiny son, ill and alone. The authorities in Britain far overreached and I'm sure this happens all the time. They have only changed their mind because of intense, international scorn and pressure. Sadly, many families don't receive the same press. What happened here was disgusting. I hope there are fat lawsuits. And I'm sick of hearing how there were "miscommunications". An arrest warrant and taking a child into care, separating him while ill from his family, is not a "miscommunication". It's a decision.

I don't believe the welfare of Ashya was the most important thing to these authorities. I think maintaining their power was.
