Why? Haven't they retired to consider the verdict again? Oh well - we'll soon see I suppose.

I think he's guilty on all counts, it's just hard to tell from the court reporting if the prosecution has enough.

VC's evidence and the judge's summing up worry me a bit.

So almost the end of another day and no sign of a verdict.

They have to be at least 9 - 3 then at the moment ( if not worse ).

I thought, but I may be mistaken, that before the Judge gave them the majority ruling, he asks them if there is a good chance they can reach a verdict based on a majority count. Not sure on that point ?
The other point ( while we're waiting ) is the status of the juror who will depart on Friday ( or Thursday PM ).
If that Juror is one of the 3 on the minority side, then it may be easier for the other 9 to only have to convince one of the remaining 2 jurors to change their mind.

On the other hand, if that juror is on the majority side - assume 9 - then they really will be stuck I think.

Ah no, I was wrong. So they can still get a verdict in with 10 jurors.




What are majority verdicts?

The jury will be told when they first retire that they must reach a unanimous verdict.
Since 1974 juries have been allowed, in certain circumstances, to reach a majority verdict.
This is a verdict of 11-1 or 10-2.

If some jurors have been discharged during the trial, perhaps because of illness, then if there are 11 jurors there can be a verdict of 10-1.
If there are 10 jurors, then 9-1 is acceptable.
If there are 9 or fewer jurors then the verdict has to be unanimous.

Yes...but now the jury in the other case in court 3 has retired too, so the Cilliers jury could conveniently conclude their deliberations and get back into court.
EDIT Spoke too soon. There's another case starting in there now.

I've been checking in here for the verdict since Friday. Am wondering if the sticking points are the other way and only 2 or 3 jurors think he is guilty? :frown:
