GUILTY UK - Emily Jones, 7 stabbed to death by stranger in park, Bolton, 22 Mar 2020

Judge passes sentence
Eltiona Skana has been handed a life sentence, with a minimum term of 8 years.

This will be a hybrid sentence and she will only be sent to prison if her treatment allows it.

Judge Mr Justice Wall told her: “What this means is that you will be detained in hospital until no longer necessary. If or when it’s no longer necessary you will be released to prison.”

If Skana is never fit to be released to prison she will remain in treatment at hospital indefinitely.

Woman to be sentenced for killing seven-year-old Emily Jones - live updates

I wish they'd not set the 8 years. She's basically been handed a life sentence but it makes it sound like a pittance.

Question: Does the 8 years start from now? Or from when/if she goes to an actual prison?

Looking at the sentencing remarks I think the sentence starts now:

What this means is that you will be detained in hospital for as long as necessary. If or when it is no longer necessary you will be transferred to prison. Once in prison you will serve the remainder of the sentence that I have imposed.

A few bits more:

You are 30-years-old and have no previous convictions recorded against you but that does not paint the full picture. You have previously attacked your mother with a number of weapons including an iron and a knife.

On one occasion you went to the house of a neighbour who had a teenage daughter and, for no obvious reason, demanded to see the daughter. Dr Whitworth's report suggests you were in possession of a knife from a restaurant when you did this.

The mother had the presence of mind to refuse you entry. This history means that I cannot treat you as someone for whom this outburst of serious violence was an isolated incident. Rather it is part of a pattern of behaviour set out over a number of years.

[...]

For example Dr Whitworth, in her latest report, wrote as follows: "In the contest of the acute stages of her mental illness Eltiona Skana represents a very high risk of serious, potentially fatal, harm to others. I note with with concern Ms Skana's use of weapons, including episodes when she has armed herself with a knife in response to abnormal beliefs and experiences.

"On other occasions Ms Skana has used improvised weapons, including an iron and has referred to an intention to 'club' those she has incorporated into her delusional belief system."

Every word the judge said as he gave Emily Jones' killer a life sentence

It's just tragically sad all round, and probably avoidable had action been taken sooner. I'm stunned she wasn't under closer supervision.

So senseless and a waste of a lovely young life. RIP Emily and thoughts with her parents who will never, ever recover from such a horrific loss.

She appears to be quite lucid in the video of her arrest considering it was filmed not long after the murder. She communicates clearly and calmly gets into the police vehicle. From what witnesses were saying, I expected her to be acting in a strange or violent manner but perhaps her condition changes rapidly.

thought that as well, and not to sound graphic but there's no blood on her

Emily Jones: Killed girl's dad battling for health care changes

The father of a seven-year-old girl who was stabbed to death in a park by a psychiatric patient says he does not want her "death to be in vain".

During her trial, the court heard Skana had missed taking medication prior to the attack and had a history of becoming violent without it, previously stabbing her mother and her sister.

Mr Jones is calling for reforms at Greater Manchester Mental Care NHS Foundation Trust which was responsible for her care.

"I still think if they would have cared for her better and protected the public from this woman as she was known to be a threat then Emily would be here today," he said.

"The care was nothing short of shambolic."

The trust has conducted an internal review of the case and apologised for its failings.

At the start of an inquest today probing the horrific Mother’s Day killing of seven-year-old Emily Jones, they said it should ‘vigorously’ examine how Eltiona Skana was allowed to stay in Britain.

The parents of a seven-year-old girl whose throat was slashed by a mentally ill Albanian woman as she rode her scooter say their daughter would still be alive if her killer hadn’t been granted asylum.

Now 33, the paranoid schizophrenia sufferer’s trial heard she smuggled herself into Britain on the back of a lorry and claimed asylum on the grounds that she was a victim of traffickers.

Sorry about the long link, but the only one I found.

I live fairly near to Queen's Park, and have been there a few times over the years. A huge area it is, so open and many families take their children to play.

Sure now many people and families will be wary and on full alert when they go there in fear of something again untoward happening.

My heart aches for little Emily's family.
God Bless her, may she Rest in Peace. x
