GUILTY UK - Jay Sewell, 18, murdered, London, Dec 2018 *nine on trial*

  • #21
Mr Sewell was fatally stabbed through the car window by Grogan's friend Charlie Dudley, 25, jurors were told Dudley, who lived a few doors from the Grogans, denied murdering Mr Sewell, injuring Mr Pamphlett and violent disorder.

[...]

Giving evidence, Robert Grogan admitted having an axe but said he was unaware that anyone was carrying a knife.

He told jurors he saw Dudley deliver what he thought were "two or three punches" as he stood behind him.

[...]

The 17-year-old defendant admitted being armed with a stick but said he got "scared" and ran away before the stabbing.

The young boxer, who cannot be identified because of his age, said: "I thought these people would bring weapons with them so I got given it. If someone attacked I could use it in self defence.

"It had a tea towel wrapped around it to take some of the impact out. I did not want to cause no harm to anyone. It was not my intention."

None of the other defendants gave evidence but it was claimed on Dudley's behalf that Robert Grogan was covering up for a family member by naming him as the stabber.

However, jurors heard Dudley had been picked out by Ms Hodder in an identity parade and his DNA was found on the handle of a kitchen knife found near Grogan's home.

It was alleged Francesca Grogan and Jamie Bennett were carrying hammers wrapped in towelling, Ann Grogan had a kitchen knife and Hickey had a wooden baton.

How a toxic love triangle led to the brutal stabbing of 18-year-old Jay Sewell

BBM. Manslaughter? And the idea of wrapping hammers and other weapons with towels so they don't cause har

Mother of murdered Jay Sewell speaks after Grogan family convictions

A family impact statement from Jay’s mother, Sharon Louch, has since been circulated by police following the convictions.

The statement read:

“It breaks my heart to know that Jay will never be able to fulfil his dreams.

“He is my first thought when I wake up and last before I go to bed. I try my hardest to shield my children from the pain, but I can’t do it. They all know they will never see their brother again.

“It’s been nearly ten months since that day in December, each one proving as hard as that before it. The trial lasted for what seemed an eternity, I pray I never have anything to compare it to.”

“We as a family have taken whatever steps are necessary to ensure we have been there to support Jay and show him we care. I have not worked and had so much time away from my children at a place in their lives when they need me the most.

“There is no sentence this court or any other can pass which can come close to healing the pain or make up for not being able to look at my Jay’s face or hear him laugh. I haven’t come here expecting or wanting it to.

“However it does provide a glimmer of hope that those responsible have been held to account for their actions.

“Jay you were a blessing and made us proud from the day you came to us until the moment you were taken.”

I must have missed the verdicts on Friday. I'm at a bit of a loss to understand some of these verdicts:

  • Daniel Grogan, 21 - guilty of murder
  • Robert Grogan, 54 - not guilty of murder, guilty of manslaughter and violent disorder
  • Ann Grogan, 54 - not guilty of murder, guilty of manslaughter and violent disorder
  • Francesca Grogan, 30 - not guilty of murder and manslaughter, guilty of violent disorder
  • Charlie Dudley, 25 - not guilty of murder, guilty of manslaughter
  • Liam Hickey, 18 - not guilty of murder and manslaughter, guilty of violent disorder
  • Jamie Bennett, 31 - not guilty of murder and manslaughter, guilty of violent disorder
  • Unnamed, 17 - not guilty of murder and manslaughter, guilty of violent disorder
Man guilty of murdering teenage love rival

It's a bit confusing:

Daniel - murder
Charlie - manslaughter
Daniel's parents - manslaughter and violent disorder
Sister Francesca and her boyfriend Jamie - violent disorder
Cousin Liam - violent disorder
16/17yo - violent disorder

What happened with Peter? He was one of the original nine?

And I thought it was Charlie that stabbed Jay through the car window, so why did he not get murder yet Daniel did?

Peter was freed. If it wasn't for Daniel Grogan then Jay would still be alive he deserves the murder charge and so do they all what about joint enterprise they were all there including peter and contributed to that frenzy. Sentencing was going to be for the last 5 on the 6th December but has now been put back to 7th January.

Jailing [Daniel Grogan] for life with a minimum of 21 years, Judge Wendy Joseph QC said he "desired only revenge on Gemma and Jay" and was driven by "self serving anger beyond logic".

[...]

Jailing [his father Robert, 58] for 14 years and six months, the judge said he "lost control of himself" and acted out of character after being misled by his son.

His mother Ann, 55, who was found guilty of manslaughter and violent disorder, was jailed for seven-and-a-half years.

Her sentence was followed by a disturbance in the public gallery, and Mr Sewell's mother walked out of court saying it was "a joke".

Friend and neighbour Charlie Dudley, 26, was jailed for 16 years for manslaughter, wounding with intent, and violent disorder.

Cousin Liam Hickey, 19, was locked up for three years for wounding with intent and violent disorder.

Why did the mother get half the sentence of the father?
And have we any idea when the sister and her boyf get sentenced?

Also, I'm still confused as to why Charlie Dudley didn't get a murder charge. He was the one that stabbed Jay.

Yeah, the verdicts and sentencing aren't making sense. Looks like sister and bf were sentenced earlier:

Francesca Grogan, 30 (13.03.89), of Sibthorpe Road, SE12 was previously sentenced to 12 months for violent disorder.

Jamie Bennett, 32 (15.10.87), of Sibthorpe Road, SE12 was previously sentenced to 20 months in prison.

A 17-year-old was previously handed a nine-month rehabilitation order and a supervision order.

The mother got less than the father because he was swinging a axe which charlie ducked and left a hole in a fence but they should have all got longer sentences with half there term not being served they will be out within 8 years except daniel grogan who has to serve his 21 years. And of cause as you mentioned the other 3 that were sentenced back in September are already free and were in the gallery for the final sentencing. When are these sentences going to get tougher to become a better deterrent. Jay was my nephew and I was at court ever day of the trial and I was shocked at how the system seems to so heavily tilted on the side of the defendant's. I except they have to have a fair trial but that should not be at the expense of the justice Jay deserved.

I’m so sorry your family has been through this @can't say , and thank you for explaining about the sentences. We’re all pretty disgusted that some of these sentences are so low.

Are you able to clarify why Dudley didn’t get a murder charge, as I believe it was reported he was the one who struck the fatal blow?

The police believe he stabbed Jay and and evidence seemed to show that to be the case. We believe it was dudley but unfortunately the jury for some reason couldn't come to that conclusion so only daniel grogan got the murder verdict. I think it was right that he got that murder verdict but disappointed dudley didn't and really more of them could of got a murder verdict under joint enterprise but that didn't happen. And thank you for your kind words it means a lot to the family to have support. And I forgot to mention the father had Jays blood on his clothing but they all played a part in it.
