Jury sworn in, trial about to begin

A jury of eight women and four men have been sworn to try the case of Andrew Burfield, who is accused of murdering his former partner Katie Kenyon on April 22, 2022. Burfield has pleaded not guilty to murder.

The trial is expected to take two to three weeks, however it will not sit on Friday November 18 or Monday November 21. David Mclachlan QC will now give an outline of the prosecution case. He is assisted by Emma Keough.

Mr Storrie QC, defending, is assisted by Jonathan Woodward.

'Burfield inflicted at least blows to Katie's head', prosecution argues

Mr McLachlan is telling the jury:
Andrew Burfield is now 51 years of age. Katie Kenyon was 33 years of age at the time of her death. In July 2019, they started a relationship. Almost three years later at the end of April this year, Katie Kenyon's body was recovered from a grave in Gisburn Forest. A post mortem showed severe head injuries with multiple fractures. The injuries indicated the use of a heavy weapon such as an axe or spade.
Dr Jamie Robinson [Home Office pathologist] who will give evidence next week, estimated there were at least 12 separate strikes to the head. It is the prosecution case that Andrew Burfield inflicted these blows.

Jury is being shown photos of Katie and Burfield

The jury are being shown a photo of the victim Katie Kenyon, who lived at an address in Padiham with her two children. They are also being shown a picture of Burfield, who lived at Todmorden Road, Burnley.
The jury will hear about difficulties in the relationship between Burfield and Katie Kenyon. On Friday May 28 HMCTS sent Katie a letter involving a claim for £4,419. The claim was from Burfield against his ex partner Katie and required a response by June 16.
As a result of their difficulties, Katie had applied for a non molestation order against Burfield, however nothing came of that and no order was made.

Relationship soured between Katie and Burfield

A social media picture on Andrew Burfield's phone showed a photo of himself with Katie, with the caption 'The gorgeous girl in the pic with me is Katie Kenyon she’s my first, last and only love forever and always'.
On January 16, Katie sent a lengthy email to her therapist telling him she was doing really well with anxiety and speaking to her partner. She ended the relationship with her therapist. However in April 2018, an enforcement notice was issued to Katie purporting a debt of £4,467.03 (plus further charges) owed to Burfield.
On March 2, Andrew Burfield and Katie Kenyon exchanged messages about her wellbeing. Andrew Burfield suggested that she would benefit from a trip to The Priory in Manchester. Burfield offered to pay for outpatient mental health services.
However, by March 8, the nature of their relationship was far from cordial. At 4.09pm, Katie Kenyon sent a message to her mum, Dawn Kenyon:
“I’ve messaged Paul [Fraser, the father of Katie's daughter Honey] to see if he can help me... I’d rather pay him back than this 🤬🤬🤬🤬🤬🤬🤬 prick... I swear I just wanna kill it or make him feel pain... who the 🤬🤬🤬🤬 does he think he is doing this to other people."

Lancashire Telegraph are also reporting live - I will copy them here. There is some overlap with Milly's link, but also some other details, so between the two links we should get more info.

Mr McLachlan is telling the jury: "Burfield is 51. Katie Kenyon was 33 at the time of her death.
"In July 2019 they started a relationship and almost three years later, on April 29 this year, Katie's body was recovered from a makeshift grave in Gisburn Forest.
"You will here from a HM Pathologist, Dr Jamie Robinson, who carried out a postmortem.
"The post mortem confirmed the presence of severe injuries to the head with multiple scalp defects and the shattering of the bones of the skull.
"In summary, multiple head injuries caused Katie Kenyon’s death.
"The nature of the injuries indicated the use of a heavy edged weapon (such as an axe or possibly a spade).
"Dr Robinson estimated that there were at least 12 separate strikes.
"It is the prosecution case that Andrew Burfield inflicted these blows.

You will hear in due course that when interviewed by the police under caution he eventually admitted to inflicting one of these blows accidentally with an axe. The prosecution do not accept this version of events.

Mr McLachlan is telling the jury where Katie lived, in Herbert Street, Padiham, with her two children.
He's also telling the jury that Burfield lived in Todmorden Road in Burnley

Mr McLachlan says: "There were difficulties in their relationship and on May 28 2021, HM Courts and Tribunals Service sent Katie Kenyon a letter relating to a claim for £4,419 made against her by Andrew Burfield.
"The letter required a response by June 16 2021.
"As a result of the difficulties in their relationship Katie Kenyon applied for a non molestation order against Andrew Burfield.
"This was to be heard on June 9.
"You will hear in due course that nothing came of this and a non-molestation order was never put in place.

He continues: "Katie sent an email to her therapist Scott Knowles and in the email she referred to her anxiety being at an all time low and also said: “… I’m talking about my feelings with my partner and we are doing really good”.
She wished Mr Knowles well and thanked him for his help, and that was the end of the relationship between her and her therapist.

In February 2022 a notice of enforcement was issued to Katie Kenyon in relation to the debt of £4,467.03.
Mr McLachlan tells the jury that in March 2022 Burfield and Katie exchanged messages about her wellbeing.
Burfield suggested that she would benefit from a trip to The Priory in Manchester which offers outpatient care for a wide range of mental health conditions.
Burfield offered to pay for this.

Mr McLachlan tells the jury Katie sent a message to her mother saying she'd rather pay the £6,000 and was seeking help from the father of her daughter.
She also sent another message to her mother on March 16 2022, which read: "“I’m paranoid to death hes ganna do summert .. couldn’t sleepall night xxxx”

Mr McLachlan is telling the jury that after Burfield was arrested, messages were found in his notes on his iCloud account, which read: "As from tomorrow morning at 8am Bee will now be your responsibility Paul !!!” (Bee is a reference to Katie Kenyon’s daughter).
Furthermore, the message said: “ … if you can’t handle it or step up as her Dad then take her to Andy’s he will look after her properly”

The prosecution say that the message is important because it purports to be written by Katie but the prosecution say it wasn't, it was written by Burfield.
And Mr McLachlan say that from this message he clearly had murder on his mind and this showed a degree of pre-meditation.

Mr McLachlan says that similar messages were found on Burfield's iCloud, which could have been edited between March and April 4 - they were addressed to her son, himself and her mother.
Mr McLachlan said it was clear that Burfield had death on his mind

Outlining the state of Katie and Burfield's relationship to the jury, Mr McLachlan refers to a message Katie sent to Burfield before her death which read: “Have I put a £6000 debt over your head … that I know you can’t pay just to make your life a little more harder & stressful????”
Mr McLachlan said Burfield also suggested she take two weeks off work, an attempt, the prosecution say, to get Katie back on side.

Mr McLachlan then tells the jury that there are further conversations between Burfield and Katie, with Burfield leaving chocolates and flowers on her car windscreen while it's parked at her place of work, before the pair are seen at a Brewers Fayre on April 12.

He tells the jury there were also messages sent referring to a house they were supposed to be renting together - these were sent on April 20

Mr McLachlan has now moved to the events of April 21, where at 10am, Katie parked her white Ford Fiesta and walked towards Andrew Burfield’s home address.

She was not carrying any luggage or bags. At 2.55pm, she was captured on CCTV hugging and kissing with Andrew Burfield before she left.

The jury is being told that on that same day, April 21, Burfield went to pick up a spade from his dad's house.
Burfield needed that spade to dig a grave, claims Mr McLachlan.

He tells the jury that Burfield is then spotted driving his van to Gisburn Forest at 8.13pm on April 21.
At 9.50pm he is seen driving away from Gisburn Forest.
He is back home at 10.29pm on April 21.

Mr McLachlan says: "He was out on an important mission, to dig a grave, Katie Kenyon's grave and he was in the area the body would be recovered from."
Mr McLachlan says that Burfield receives a text from a woman he's been in a relationship with asking him how he is.
He says in the message that he's proper knackered and has been in bed since 10pm.
Mr McLachlan says: "He may have been knackered but that was because he had been digging a grave for Katie Kenyon."
