Debt collector​

On Friday May 4, Katie called the debt collector and said someone had paid the full balance on her behalf. However the call handler said the money had not been received and it had been passed on to enforcement agents.
She was told the debt had now gone up to £5,000. She asked Burfield to drop cash off to pay the debt like he had promised. But Burfield told her 'that was before you spoke to me like a t***.'
He told her if the bailiff came to ask for seven days. She asked him to come with the cash so it could be paid. She was worried about losing her car which she needed for a job.
"What have I done that's so awful to you that you would put me through this?" she asked.
"Whatever Katie," was the reply.
"I am a good person and a good soul, a good mum. We fall out and you have to go one step too far and do this to me. I haven't had an affair or done something awful so why have you done this to me? What have my children done? They both know what you have done to us. i hope that sits well with you."

Messages to mum​

Katie said Burfield was showing his true colours in his "revenge game".
She said in a message to Burfield: "This is abuse. Financial and mental abuse, whether you admit it or not."
She then messaged her mum, saying: "Karma needs to get this t*** back. It's not right he can get away with this. He's crazy, psychopath, a monster".
Katie asked Burfield to call the debt collectors and arrange a payment plan for her. She said she had been sitting in her house like a prisoner all day, waiting for him. Burfield said it would be sorted on Monday but the bailiff was not coming that day.

Debt payment plan​

On Monday March 7, an agent from DCBL debt collectors told Burfield the debt had ben passed to high court enforcement. Burfield said Katie had offered £250 a month. However DCBL explained the debt would be expected to pay in full.
On Tuesday March 8, Katie spoke to DCBL and said Burfield had said he would pay the balance and she would have an informal arrangement to pay him back. She said she did not want to deal with Burfield.
However when Burfield spoke to DCBL he said he had not agreed to that and said he wanted the enforcement to remain in place. That evening Katie messaged her daughter's father asking how much money her daughter had in her savings. She said she had hidden her car and all her belongings. She said she would rather owe him money than Burfield.

"Tinder swindler"​

She messaged her mum, saying: "I swear I just want to kill it or cause him pain. Who the f.u.c.k does he think he is?"
"He's literally another Tinder Swindler. He's done this before. Lives off that money, then gives me money and gets it back off me. How TF has he got away with it again. Why the f.u.c.k me? Why did this have to happen to me?
"I f.u.c.k.i.n.g hate myself right now. Conned out of £6,000. I've blocked him now. I'll look at getting a new phone this weekend. I don't know whether to keep this one and turn it off. It's got everything he's done. He's getting into my phone somehow."

Draft messages​

A message recovered from Burfield's iCloud, which was written between March 3 and April 4, said he was not prepared to accept the £200-a-month offer from 'the debtor'.
He said if the enforcement officer were to put more pressure on, then the debtor would be able to pay. She had assets in the house and a car, stating where it would be parked. He said the best time to catch her would be when her children were going to school. He added she had family who would help her.
The message was drafted, although it was not necessarily sent.
Katie contacted the debt collection agency DCBL, saying she was struggling with her mental health. DCBL asked for proof.

Messages in iCloud to father of Katie's daughter​

A message, backed up to Burfield's iCloud, was drafted to Paul Fraser, the father of Katie's daughter.
It said: "As from tomorrow morning, 8am, she will be your responsibility Paul. I'm sick to death of you and everyone else taking the p*** out of me... I know this may be a bad time but you've ruined my life Paul and took the p*** out of me. It's your turn now."
The message was saved on Burfield's iCloud on April 4. It could have been created or edited at anytime from March 17 to April 4.
A second message, to her son's father, said from 8am the following day her son would be his father's responsibility. "All you have ever done is take the p*** out of me. Well who's laughing now? If you can't step up and look after your son, take him to Andy's. Enjoy your weekend in Edinburgh? You can find money for that. I hate you for making me do this."

Debt collectors​

On Monday March 21, DCBL debt collectors said a claim of vulnerability had been made by Katie and a hold had been placed on the account. However a later call said enforcement would continue following instruction from the client, Andrew Burfield.
On March 22, Katie messaged Burfield asking why he had rejected her offer of £200 a month, and made false claims he would pay the debt off. She said she was a single parent living on Universal Credit and a part time wage.
She said she and her children were living in fear, waiting for the bailiffs to call. After two-and-a-half years together, she said this was Burfield's 'revenge' for her wanting to leave
Burfield said he lost her the day he called her child a s** stirrer. He said: "I asked you not to sabotage us Katie, but no trust, no love". He said Katie had accused him of controlling her, put his name and number on gay sites, lied about a pregnancy and made posts on social media about him.
She offered a payment plan of £300 a month. "Cheers for seriously destroying my life and my kids", she said.
Burfield said: "Now breathe and calm down. When you get your head good you will see this for what it is. Really Katie"
That evening DCBL received an email from Burfield saying he would accept the £300 payment plan.

Katie messaged that evening. She asked if Burfield knew anyone who would buy her car.
Burfield said he had a house ready for her. "You won't need your car Katie."
"I told you I'd been busy with only you in mind. Katie, I couldn't leave you if I tried. I love you way too much for that and this is not how our story ends."
Katie replied: "You really hurt me. I'd rather youd have punched me or given me a beating than what you did with the bailiffs. Because of that you do scare me."
"I scare you?"
"Yeah, you did that to me. You put me in a really vulnerable poisition and that hurt my soul. It scares me you could do that to me."
He replied: "Ahh, I get it. Then you also scare me Katie."
Later Burfield messaged: "I'm thinking we need to get you on the right path. That's why I need you for a day. There will only be one sacrifice for you to make but it will be worth it, I promise."
"Sacrifice?" Katie asked.
"Yeah, your job babs, unless they give you time off. It's too long for text, I will show you. On your next day off you will need two weeks off work."
She replied: "I can't take two weeks off. I've only just started. You can't just talk to me in riddles with no explanation."
Burfield said when she had moved house he would take the kids and she could start her course at The Priory, then they would do meetings together. Katie replied: "The job means nothing compared to my healing and our future."
On April 2, Katie asked: "Would you do anything that could hurt me? Would you hurt me Andy?"
Burfield replied: "No"

"Earth day"​

A message in Burfield's phone notes, created between April 2 and April 4, was drafted to one of Katie's children. It said they needed to contact their dad and have him look after them for a 'wile', as she needed to get her mind straight.
In a message on April 4, Burfield told Katie: "22nd is Earth Day, babs". Det Con Ackers says April 22 is the day Katie was murdered.

Blocked on WhatsApp​

On April 5, Katie blocked Burfield on WhatsApp.
However the following day, Burfield emailed her, saying he took it from the block that she had ended their relationship. "I'm sorry you feel the way you do Katie and we weren't worth talking about things properly. I wish you the best this life can bring you. I only want you to heal properly. I wish you the best and I'm sorry I failed you on all fronts. I only wanted you to elevate your life. Please take care Katie. You will be truly missed and always remembered."

Katie replied: "Andy I'm not sure what you want from me anymore and it's all taking its toll.
"We argue every day and don't see each other. I'm tired of being the lost little girl with you and not the strong woman I know I can be. I wish you could walk a day in my shoes then you would see. I too wish you all the best and I hope you can find happiness on this earth.
"I love you very much but I am one lost, broken soul at the moment. I have literally lost everyone, including you. maybe one day it will make sense."

The judge and the jury are now back in court

Mr McLachlan is telling the jury they will now hear evidence from Alison Baldry (a Forensic Archaeologist) with an expertise in the excavation of human remains in a forensic archaeological context.
He says that she attended the scene in Gisburn Forest where Katie's body was found.
He tells the jury about other evidence - including an axe and a spade that were found at Burfield's home during a police search

He says that by the end of April 28, it was the archeologist's view that the evidence revealed from the search of the forest was ambiguous, as the area was remarkably clean
The prosecution say this was a thorogh attempt by Burfield to cover up and conceal any grave digging.
Mr McLachlan said: "This was the product of a very thorough attempt to conceal all the evidence of grave digging at the location.

"The presence of an undisturbed and established root that extended over the whole of the area was evidence against the potential presence of a clandestine grave.
"However, there were cut moss and the clay clods found indicative that something untoward had happened.

The archeologist, Alison Baldry, was informed Burfiled had gone to the scene with the police and told the police where the grave was.
She then conducted a further examination and that's when Katie's body was found and excavated.
Her opinion was: "With consideration to the meticulous and organised construction of the grave, the thorough and detailed attempt to conceal the burial, and the timelines provided by FMIT, there is very strong support to indicate that the grave was dug as a premeditated clandestine grave on Thursday 21st April 2022, and not as a single event on 22nd April 2022."
In other words, this was not done on the day, this was done before
Ms Baldry's report went on: "The degree of care in the ‘de-turfing’ of ground vegetation and separation of soils in both excavation and back-filling would take considerably longer than 46 minutes. The evidence of the extension of the grave also supports that this was not a single event”.

Mr McLachlan said Dr Robinson a HM pathologist also attended at the scene and saw the body.
He is telling the jury they will also hear from a forensic botonist about plants which covered the grave

Mr McLachlan is telling the jury that a post morten revealed severe injuries to Katie's head with multiple scalp defects and chop-style wounds.
In Dr Robinson's opinion there were multiple blows with a weapon to Katie's head - at least 12 separate strikes that had been delivered with force.
Her skull had been extensively shattered.
There were no other injuries to her body and no defensive wounds

Mr McLachlan says it is Dr Robinson's opinion that her injuries were unsurvivable, and they were highly consisten with them having been caused by multiple blows with an axe.
He says it's Dr Robinson's opinion that the explanation provided by Burfield in his interview was completely implausible.
A cause of death was given as 'head injuries'

He says: "It is the Prosecution case that this was a pre planned murder.
"On Thursday 21st April Andrew Burfield went to Gisburn Forest in order to prepare a grave for Katie Kenyon’s body the day after.
"On Friday 22 April he took Katie to Gisburn Forest and it was there he killed her and put her in a carefully constructed grave. He killed her by striking her head numerous times with an axe with force. The amount of injuries to her head and the severity of the injuries is testament to how many times he struck her and the force he used.
"She simply, says the prosecution, stood no chance.
"The eventual suggestion that came from him in the penultimate interview was that this was an accident and involved him throwing the axe once at a tree but striking her dead is nonsense and is not borne out by the evidence.
"We say that knowing full well it's up to you to decide what the facts of this case are."

The note on his iCloud created on March 17 reads: "From 8am tomorrow Paul, Bee is your responsibility...."

Another note was created in Burfield's iCloud on Thursday March 17, which reads: "As from 8am tomorrow (son) is now your full responsibility.
"I'm sick to death of doing this on my own with no helo or no money, it's your turn now to step up and be the father you said you'd be.
"If you can't step up and have your son then drop him at Andy's he will look after him properly.
"I hate you for making me do this."

These notes were intended for the fathers of Katie Kenyon's children

Another note was then created in Burfield's iCloud, the note was intended for Burfield himself from Katie asking him to look after her children, and telling him that she's taken the £6,000 he gave her to help with her treatment and that she loves him

On March 19, another note was created in Burfield's notes and saved to his iCloud, this was intended for Katie's mother.
The note detailed how Katie had sent messages to the fathers of her children and was telling her mother she was going away for a while with the £6k Andy (Burfield) gave her. The note asked Katie's mum to look after her dog Indie, which was spelled Indi.
Katie would spell the name Indie, but Burfield spelled it Indi.
The same happened with the spelling of the word while - Katie spelled it 'while', but in the notes on Burfield's phone which were later sent as messages, he spelled it 'wile'

The message is addressed to one of her children telling them to call their father as he will be looking after them for a while, and she needs to sort herself out.
In this message the word 'while' is spelt 'wile' again

Burfield sends a message to Katie telling her that April 22 is Earth Day.
Mr McLachlan asks Det Sgt Acres what the relevance of that date is - he tells the jury that April 22 is the date Katie went missing

I'm tired of being the lost little girl with you and not the strong woman I can be. I am tired Andy. You have your life and I am not a priority. I wish you all the best. I love you and always will but I am one messed up broken soul at the moment and I've lost everyone around me. Maybe one day it will all make sense.'
