I wonder re his wife - I don’t think LE can use anything she tells them as evidence - something about not requiring to give evidence against spouse. I do wonder if they had her in early on, to identify if certain items belonged to her, or whether they just asked whoever he stole them from..

Also maybe that’s where they got the initial 3am from as that was the time he was back home...

I feel for his wife - can’t be easy to find your husband has been doing these things, and possibly worse.
Thank you...I was actually wondering if spousal privilege was a part of the legal system in the UK as well!

Question, and one which I may have missed the answer to. If so, apologies.

15 got some CSI attention early on. Did anybody figure out why? Perhaps because of an earlier incident, or a known sex offender living on the street?

Maybe the house were the earlier incident was reported?

Never got the not giving evidence against a spouse thing.

I'd sing like a canary if I thought my hubby had done that.
I've always wondered...can't you testify against a spouse if you want to, but you are not required to? Or, is it inadmissible simply by being a communication between spouses?

I’m EAST YORKSHIRE, refused to put Humberside!!

Another vote for East Yorkshire. All things Humberside should be abolished

Yeh I think your right. Most sensible thing she could do was answer the questions that were put to her and get out of there with the kids.

I'd actually worry for her wellbeing if she had stayed in the area.

I did wonder what might have made them leave York but pure speculation so I won’t comment.

Am I wrong to think that P’s wife must be of interest to the police, purely because as the only other adult (that we know of!) sharing a roof and a relationship with him, she is likely to have insights into his personality, movements, favoured locations, expensive items of value unexpectedly brought into their home etc. Could she have directed police to items in Raglan Street which led to some of the new charges? Or is she within her rights to just sort of up and leave and remove herself from the situation altogether without speaking to police? She could well have been completely unaware of stolen items in her family home but wouldn’t police want to be satisfied with this by speaking with her? No idea what the process is if you suddenly find out the father of your children is an alleged monster!
Always dodgy to rely on a spouse as a witness even if they are willing to cooperate.

On a personal level I would imagine she would want to get as far away from this as possible.

Until the law was changed a spouse couldn't testify against their other half even if they had committed a crime against them. It's a legal nightmare, the CPS would want to avoid at all costs.

Isn't it the spouse that's in bother that can stop you testifying??

So you could tell the police everything you know but they could not use it in court??

It’s North Yorkshire Police for the York area, for instance Tadcaster, York, Malton etc , but, expect they would be conferring re their open cases.
Doesn't he work in Malton?

Yeah, I would want as many countries as possible between me and my children and that. I can see what you mean, police probably not that interested then because the info Mrs R provides could potentially be clouded one way or another.

At a basic level married couples are considered to be one legal person. Feed in your right not to incriminate yourself and you can see where the complexity arises.

Hello all, new here. I am a lawyer, I don’t specialise in criminal law but I have studied it for many years etc so I can hopefully shed some light on what isn’t quite so obvious.
For burglary, trespass is part of what we call the conduct element of the crime - the actus reus. Trespass must always be proven in a charge of burglary (among other elements, but I won’t go there now). Trespass takes on a different legal meaning, where breaking and entering (by force per say) is not part and parcel to trespassing. Trespassing is simply entering land which you don’t have permission to be on, if that makes sense. So in a nutshell, trespass will always be proven for a charge of burglary, but breaking in by force need not be. It will likely be a sentencing factor though.
Thanks that's really useful

I had a trip to Tadcaster today. There was none of that fancy stuff there! Just a massive John Smith's building and more pubs than people.

I lived in Tadcaster briefly, not a lot there you’re right!

On Hull live Facebook page, people are suggesting they book PR in for a Jeremy Kyle lie detector test...excellent idea that will stand up in a court of law.

Some people.
This definitely means there's trafficking going on too. MmmHmm
