Mr Mason said Dr Joseph had based his opinion on two untested accounts.

“Where is the fairness in that,” he said.

“He appears to have ignored the account given by Melissa. Here was an actual account of a witness in the case who made it clear that her mum was 90% to blame because her mum was an alcoholic.

“Tracey did give evidence and said he had been behaving in a very odd way.

“He sent her text messages indicating he was having trouble with her new relationship. He was being a pain in the you know what. It was not aggressive, violent behaviour.”

I feel like the bandages are meant to give credence to his mental health claims. (The jury aren't meant to speculate but I can)

I can't see the diminished responsibility defence working, but who knows.

'Look at what he did'
He said the defence had to establish on a balance of probabilities that diminished responsibility was made out.

”Is it more likely than not,” he asked.

“Surely it is more likely than not he was suffering from a depressive illness. Look at what he did. Horrendous. Why else could it have happened?

“We will never know what action caused Billingham to do what he did. How does it help him not to remember what happened?

“If he could have remembered surely he would have helped us.”

Dr Galappathie is in a good position to spot fake memory loss, said Mr Mason.

”Has there been out of the blue a catastrophic deterioration in his condition which caused him to lose all rational control?

“This man has killed his own daughter and in the process destroyed lives and destroyed his own life too.

“It is more likely than not that Dr Galappathie’s opinion is the correct one.”

Mr Mason has now finished his address and the trial has been adjourned until Monday.

I agree Legally - this 24 hour amnesia is all a bit too convenient.

There is no prior for severe depression but there is prior for threatening to kill another child.

I hope the Jury see right through him

I would hope anyone who has had 'mild to moderate' depression, or even knows someone who has, would be side-eyeing depression on its own as an excuse.

I wonder at what point the Jury went out then ? - if they adjourned from 13 03 to 14 15 hrs, they must have gone out straight after that - so 1.5 hours only to bring in the verdict

The jurors were not told he had cut his wrists in his cell - using razor blades.

Billingham underwent surgery after the apparent attempt to end his own life in the early hours of September 21 - a day after his trial was shown CCTV footage of his daughter Mylee.
In legal argument which could not be reported until the end of the trial, defence barrister David Mason QC said seeing CCTV of Mylee had badly affected Billingham, who spent four days in hospital.
Mr Mason told the court his client had experienced "some sort of breakdown" overnight, during which he was injured.

Billingham was eventually brought back to court on Tuesday September 25 - arriving in a taxi with a police escort, as his wounds meant he could not be handcuffed or placed in a prison van.

After being assessed by a psychiatrist as being fit to instruct his legal team, Billingham opted not to give evidence.

Begs he question how on earth did he have access to razor blades in his cell. That being said I am glad he did not succeed and will have to live with this for the rest of his life

No sympathy for this or his previous self inflicted stab wound. Neither appear to have been done with serious intent OIMO.

So even immediately after a 'suicide attempt' he was assessed competent to instruct his legal team. That confirms everything I thought about this person. Manipulative to the last IMO.
