The trial has started, and omg the motive is absolutely not what I expected at all. I really thought this was semi random but turns out it was very deliberately targetted. Justin Robertson was paid £1500 to kill Pennie by Ben Carr, the son of a previous partner of hers, because she had accused him of a sexual assault eight years ago, when he was 14, and was now threatening to inform the police.

Police connected Robertson to the murder scene as he dropped the keys to [fellow accused Samantha] Maclean's car in the field which were later found by officers searching the area.

Oh wow, how the plot thickens. And £1,500 to kill someone, just amazing! Poor lady. :(

Emily James, who picked the accused killer up after he lost his keys, says
he appeared "nervous" and "twitchy".... she said she saw Robertson, who she said was nicknamed ‘Twinkletoes’ because he was always on his feet. ...

When asked if she queried what he had been doing she said "no".

She added: "I didn't ask, I didn't want to know. If I don't know I can't get into trouble."

Jurors were told she thought he might have been "looking around the fields and looking for stuff to sell, pricing things up".

She said she didn't see any blood on him.

Miss James also recalled how armed police stormed her house days later, on Thursday, September 4, with a warrant looking for a murder weapon, as Robertson had been staying at their home.

The next day Lian Doyle and Maclean [accused of conspiracy] turned up at her house, but she asked them to leave as detectives had told her not to let them in.

Under cross examination from Robertson's barrister Rupert Pardoe, Miss James agreed she had never seen him be violent and that she trusted him to look after her children, aged between two and 11.

Drama in court, as accused killer threatens Ben Carr from the witness box:


Robertson turned to Carr and said: “Ben, I swear to you I am going to chase you around every jail in this country.

"I promise you, I am coming for you.”

Turning back to the jury he went on: “I don't care what you lot think, I hope you find me not guilty, but by the end of this my friends and family will know I am telling the truth, that's what I care about.”

Earlier in the day Robertson admitted to the court he was in Beaulieu on the day of Pennie's murder, September 2 last year, but that he was there to burgle a house opposite the field where she was stabbed to death.

He said Beaulieu was a “posh area” which he would target because “it was rich people who didn't know how to protect it” adding “but I only steal things they could claim on their insurance and so didn't cost them”.

He also continued to threaten Carr from the witness box. He said: “Ben I promise you, for what you have done to Lian, I am coming for ya, for what you have done to Sam, I am coming for ya, for what you have done to this family and my family, I promise ya.”

Carr is claiming the death was accidental and he only wanted Robertson to scare her off from reviving the sexual assault claims:

Ben Carr described the moment Justin Robertson revealed that their plan to "scare" Pennie Davis had "gone wrong".

He told jurors that Robertson told him he and Pennie had a "scuffle" in the horse field at Leygreen Farm, Beaulieu, during which she had pulled off his balaclava, revealing his identity.

Carr said that Robertson explained that he "panicked", stabbing her three times and expected that she was dead.

He said his head started to spin and that his "worst nightmare had come true".

He added: "I had a sick feeling in my stomach. I didn't know if I could believe him, I sort of know Justin and thought he's not capable of doing something like this."

Asked why he never told police any of this during his interviews, he said it was because he feared for his safety and the safety of his family as Robertson had told him to keep his mouth shut.

He was also asked about the threats made to him by Robertson when Robertson was giving his evidence and Carr said that to him they meant he was "coming to kill me".

Ben Carr admitted that Pennie's threats to resurrect historic allegations that he had indecently assaulted girls, couldn't have come at a "worst" time in his life.


Under cross-examination from prosecutor Richard Smith QC, Carr agreed that due to his dad's upcoming wedding and his own prospects of a new job working with children, the threats left him "seething".

Mr Smith asked Carr why, when Robertson allegedly confessed to killing Pennie to two different people, did he describe her as someone who was a paedophile.

Carr said Robertson made that up himself adding "he's saying that to justify why he's killed a woman" because that is not "acceptable" even in prison.

The trial resumed today after a break over the Easter holidays, with closing speech from the prosecution:

HATRED, fear and a cocktail of emotions is what drove the former step son of Pennie Davis to concoct an "evil" plot to have her killed, a court heard.

Prosecutor Richard Smith QC told jurors it was a "genuinely tragic case" ...

He said she was killed at the hands of Justin Robertson in what was a murder "hatched" as a plan by Ben Carr, who wanted to stop her resurrecting historic claims he had indecently assaulted girls.

Mr Smith told jurors that it was a "meticulous" plan that may well have succeeded if Robertson had not dropped the key of Maclean's car beside Pennie's body in Leygreen Farm.

He said: "It is a cold thought, chilling for many sat in this court, but for the loss of that key, the police may have never actually unraveled this jigsaw.

Mr Smith said that there is "overwhelming" evidence pointing to Robertson's guilt and that any suggestion that he was in Beaulieu that day, September 2, last year, to burgle was "incredible".

Mr Smith admitted that Maclean's involvement may have been less than Carr and Robertson, but he said her decision not to give evidence from the witness box was because she knew her answers would not stand up to cross examination.

Penny had 13 knife wounds, the knife struck at least 10 times, sounds like a contract killing to me. Carr wanted her dead and if not for the key Robertson dropped, might never have been caught, so he better toughen up and take his punishment. JMO
