If you murder someone and then transport them somewhere it's not kidnap. He's got a kidnapping charge presumably because he drove her somewhere alive first.

Not true. The offence of kidnapping can occur within seconds-- and no surprise that WC was first held under this charge. I have little doubt that he will be indicted for the same.

Kidnapping is a common-law offence --and is triable only on indictment.
(It may be classified in class 2A, 2B or 3—see Criminal Practice Directions XIII Listing, para B: Classification).

The common law definition is not unlike the U.S. where pretty much anytime you're confined, held, or moved against your will is legally kidnapping.

Elements of the offence
In R v D the Court of Appeal held that on a charge of kidnapping the prosecution must prove:

  1. the taking or carrying away of one person by another


  2. by force or fraud


  3. without the consent of the person so taken or carried away, and


  4. without lawful excuse

In my opinion, he led them there. There was talk of an SD card, he has a new car, they have GPS.

"The platform can save each coordinate point to the SD card. After the trip, export the data to the PC through the SD card, and use the map software to display the driving trajectory of the trip, such as querying at a certain point in time."

I have some questions for anyone who lives in the area (or anyone who knows). I'm a little confused about the places being investigated. It looks to me from the map as if Ashford is a while away from Deal and that Great Chart is further away still. How far are these other places from Deal in driving time?
I understand Sarah's body was discovered in Ashford. Do we know what the link to the place is and also what the link is to Great Chart and why they are investigating the old leisure centre? Also where does WC's garage fit into these places in terms of locality?
Sorry, I know that's a lot of questions but after doing so much reading I've got a bit lost.

This has already been discussed on this thread, the perpetrator was found thankfully.

Does the charge of SE's kidnap and murder imply that LE didn't find evidence of other, historic crimes?
Also I really hope to god they monitor him 24/7. I hope he lives an extremely long life, so he has to live with his conscience and all the **** he will get in prison. Evil ****.

Not at all

They can find evidence of other crimes but not charge them at this time.

And normally you only want to have to prosecute one extremely serious crime at a time.

He could have stolen a TV from his neighbor, but if it isn't pertinent to the evidence in this crime. they definitely would not cloud any of the current case with it.

how could he attempt suicide twice in the space of a few days? could the officers be roughing him up and claiming it's self-inflicted?
Just as likely he would self harm and accuse officers?
If he has a strong need for control, if may be that he is highly perturbed to find himself in a place where he has none.

Wow, okay. VERY interesting. Could certainly explain the hire car constantly mentioned in the press. Whether hired from there or not, it suggests that despite having two cars on the drive he wasn’t adverse to using rentals for whatever reason.

It's certainly possible. Everyone seems to believe that he won't be talking at all, but that's purely conjecture based on the fact that he is a police officer and therefore knows the legal system? But really we have no idea. He might be confessing to it all for all we know.

Similarly, EC may have known more than people have presumed and been able to tell them likely or definite locations.

If he did do a long-term hire from them, there's 99% certainty it had a GPS tracker. Vast majority of new electric vehicles do, for a variety of reasons, bu also an ev hiring company would want to track its fleet of cars.

IMO, kidnap and murder are different crimes, both cause extreme harm to the victim, but in different ways.

Being kidnapped means SE suffered terror for a time, was unable to defend herself or try to get away, another person took complete control over her for an extended period. It emphasizes her being made helpless, rather than being physically harmed. A kidnapper can let the victim go, it doesn't imply assault or murder.

Murder means ending someone's life, it could be so quick the victim didn't suffer. Unfortunately, not in this case.

Just to correct you on age of the car .. the two cars taken from his driveway were not new. 100k miles on the clock and almost a decade old. Although worryingly sparkling clean (Seat). That’s not to say they didn’t have GPS or that police hadn’t fitted a tracker. OR we could be talking about the elusive rental car which we haven’t yet had confirmation of.

So does that mean if he was originally held under this charge, and the evidence emerges to support/ prove it, that they would be required to pursue with this charge as well as the murder charge? If the case is fairly strong (hypothetically speaking) for murder, and the evidence holds it up in court, what would the rationale of pursuing a conviction for kidnapping?

Sorry, I'm not very well versed on the legal bit, but find it intriguing.

It's all just devastating, hope they can keep him safe from himself, as the last thing we need is to have another situation mirroring Epstein's.

So strange though .. why would you have two cars at home PLUS a motorbike and feel the need to long term hire? I’ve thought it odd that the press mentioned a hire car when he has access to so many vehicles at home!

The specificity of the search locations has me convinced that this is exactly what happened. Traffic cameras and plate recognition will get you so far, but there’s something about all of these precise locations that have the police convinced they’re worthy of serious, costly and detailed investigation. They seem to know he has been there, and when.

The head injuries and lack of a rape charge rule out the idea of him co-operating and confessing, to my mind.

Deal to Ashford is c. 45 minutes in a car. Deal is a small town so if you wanted to go shopping Ashford would be an obvious choice. Great Chart is a few minutes drive from Ashford Town centre. Not much there at all. Dover is much closer to Deal, 15 minute drive.
