LOGAN, Utah (AP) — A Utah man charged with kidnapping and killing his 5-year-old niece made his first court appearance Monday.

Alex Whipple, 21, was handcuffed and silent as a judge read out the charges, including aggravated murder and child kidnapping. He was denied bail.

He is accused of taking Elizabeth “Lizzy” Shelley from her home and killing her on May 25 after spending the night at his sister’s house, prosecutors said.

Authorities searched for the missing girl for five days before he told his lawyer where he’d hidden her, after prosecutors promised to not pursue the death penalty. The girl’s body was found less than a block from home.

Cache County prosecutor James Swink said finding the child’s body allowed the family to lay the child to rest. “Not to have the body of your child, you just can’t cope with that,” Swink told the Salt Lake Tribune.

Man accused of killing Elizabeth Shelley appears in court, found ineligible for bail (copy)

LOGAN, Utah — Alexander Whipple, 21, made his first courtroom appearance Monday after he was charged last week with capital murder in connection with the death of 5-year-old Lizzy Shelley, who was found dead near her home on May 29.

Whipple was also charged with child kidnapping, desecration of a human body and two counts of obstruction of justice. Defense attorney Shannon Demler did not schedule a preliminary hearing in this case. Instead, he asked for a pretrial conference to be held on June 24.

Cache County Attorney James Swink said Monday’s priority was the family, who is in mourning, not the court case.

“Today is the day there will be a viewing of our victim, Elizabeth. We want to give due respect to the family — they are in mourning, and tomorrow (Tuesday), there will be a funeral,” he said.

Although Whipple was charged with criminal homicide-aggravated murder, a capital offense, he will not face the death penalty. Demler said last week that he entered into an agreement with the Cache County Attorney’s Office, which agreed to take the death penalty off the table in exchange for information leading to the discovery of Shelley’s body.

ETA: This was a respectful gesture by AW defense counsel with the DA to defer this mornings hearing to a conference on 6/24 in recognition that family is planning funeral. Judge obviously did not reject this motion.

Wouldn't it be great if AW just pleads guilty and we go straight to him entering a guilty plea and he's sentenced -- end of story, never have to see his face again.

Outside the courthouse, Cache County Attorney James Swink said Monday’s hearing was basically a technicality. He explained that right now, prosecutors are focused more on helping the family grieve the loss of Lizzy.

“The family is in mourning,” expressed Swink. “Those that worked this case, the hundreds of people that helped with this case, from law enforcement to the volunteers, to the victim’s advocates, all of those people are in mourning and our community is in mourning. So today is really about the family, about Elizabeth and being able to put her to rest.”

I'm more impressed with the officials & people of Logan/Cache County every day. It's not often you see a prosecutor making a statement like that.
